El mutuo disenso es un medio extintivo obligacional que proviene de un consentimiento prestado de manera opuesta o contraria al primigenio. Se trata, entonces, de un contrato cuyo contenido es justamente lo inverso a la constitución del vínculo obligatorio, con el cual se elimina, en virtud de la voluntad de ambas partes, el acuerdo anterior. En el presente artículo, los autores se encargan de analizar el contenido del artículo 1313 del Código Civil y precisar los alcances y limitaciones de esta figura. The mutual consent is a mean used to extinguish obligations coming from a consent granted from an opposite or contrary manner against the original one. This is, therefore, a contract which essence is exactly opposing to the formalization of the binding relation, with which is terminated the former agreement, under the will of both parties. In this article, the authors are responsible for analyzing the subject-matter of article 1313 of the Civil Code and to specify the extent and limitations of this figure.
