Conflito e negociação : estudo de caso em uma indústria de transformação do Rio Grande do SulMichelon, Regina Maria Coelho January 2003 (has links)
Esta pesquisa trata do tema conflito e negociação. O objetivo geral foi mapear e analisar situações de conflito e o seu processo de negociação em uma indústria de transformação do Rio Grande do Sul. Utilizou-se tanto o método do estudo de caso para uma pesquisa exploratória e de caráter descritivo, como a pesquisa-ação. Os sujeitos da pesquisa foram 21 alunos de um curso de “Negociação” em abril de 2002, o superintendente e a chefia do setor Talentos Humanos da empresa. Para a coleta dos dados foram utilizadas observações participantes, análise de documentos, filmagens e entrevistas semi-estruturadas. A coleta de dados ocorreu entre abril de 2002 e abril de 2003. Investigou-se e foi realizada intervenção na dinâmica dos conflitos no âmbito interno da empresa, diagnosticando os conflitos e analisando os resultados obtidos por meio do método de negociação desenvolvido na Universidade de Harvard. Os resultados demonstraram que a iniciativa para a escolha do modelo negocial integrativo ou competitivo partia da chefia; os subordinados apenas reagiam seguindo o modelo proposto, ou seja, de forma integrativa ou competitiva. Em se tratando de negociações entre colegas e com fornecedores, o modelo integrativo era adotado por iniciativa dos sujeitos, inclusive virando jogos competitivos em integrativos. Também foi constatado que a utilização do processo integrativo para solução de conflitos/problemas no âmbito organizacional é uma forma apropriada para melhores resultados e mais satisfação para todos os envolvidos, humanizando e trazendo a ética para as relações. A participação de uma terceira pessoa na reformulação da forma de negociar trouxe desdobramentos significativos para os sujeitos, atribuindo-se a isso a postura imparcial e a credibilidade alcançada. Finalmente, as conexões entre o pensamento de Habermas desenvolvido na Teoria da Ação Comunicativa e o método de negociação de Harvard ficaram evidentes. / This research deals with the subject of conflict and negotiation. It was also noticed that the use of the integrative process for solving conflicts and problems in the organization proved to be an adequate way to attain better results and more satisfaction for all the parts involved, humanizing and bringing ethics into the relations. The participation of a third person in reformulating the negotiation way has brought significant unfoldings for the subjects, making it possible the reach of an impartial position and greater credibility. Finally, conexions was evident beteween ideas of Habermas and the method of negotiation adopted.

Collective bargaining in Brazilian manufacturing, 1978-95Horn, Carlos Henrique Vasconcellos January 2003 (has links)
Collective bargaining, it is widely claimed, has been on the increase in Brazil since the late 1970s. This is seen as part of a broader change in Brazilian industrial relations towards a hybrid system of interest representation, in which elements of both the old state corporatism and pluralism now coexist. However, there is little or no systematic empirical evidence available to support this conclusion. This thesis addresses the question of the strengthening of collective bargaining as a method of job regulation in Brazil by providing a detailed empirical study. The questions of this study are: (a) how important has collective bargaining become in establishing provisions on the terms and conditions of the employment relationship which are not simply reproducing rules established via state regulation?; and (b) what factors accounted for changes in the content of these provisions? An analysis of 10,734 provisions in 287 collective agreements in manufacturing industries in the Metropolitan Area of Porto Alegre, the capital of the southernmost state of Rio Grande do Sul, was carried out for the period of 1978-95. This analysis offers support for the thesis that the significance of collective bargaining has increased. It shows that: (a) most substantive provisions created rules that were not established in other forms of regulation; (b) provisions that replicate the contents of regulatory legislation accounted for one out of seven substantive provisions, but in spite of being a copy of the law, these provisions are not entirely neutral for job regulation; (c) collective agreements also laid down substantive provisions benefiting employers, and not simply employees; and (d) the pace of change in bargaining outcomes oscillated with changes in the economic, legal and judicial contexts. This pace of change was mostly affected by (i) the rate of unemployment, (ii) the degree of openness of the economy to foreign competition, (iii) the capacity of employers to pass on costs to costumers, (iv) stabilisation policies aimed at curbing inflation, (v) the Federal Constitution made in 1988, (vi) the official rate of minimum wages, and (vii) the conduct of the labour judicial system in settling collective disputes.
