The Great re-freezing? Requirements for establishing native title in post-Yorta Yorta jurisprudence

Masters Research - Master of Philosophy (Law) / In Yorta Yorta, it was expressly found that native title law could not support a ‘frozen in time’ approach. It was held that the rights making up native title could not be considered static and archaic instruments, but must be given reign to adapt. However the question must be asked whether, in its examination of the requirements of native title, Yorta Yorta has in the same breath re-introduced the ‘frozen in time’ approach, albeit in a different form. Specifically, it is a question of whether the continuity of connection requirement means that the evolution of rights is frozen and claimants are burdened with the task of proving they relate to land in exactly the same manner as their ancestors did, over 200 years ago. That is the question which this thesis attempts to answer. It will do so by examining in detail not only the requirement of continuity of connection as espoused in Yorta Yorta, but the evidentiary analysis which was performed under that requirement. It is the nature of this analysis in which the effect of continuity of connection on the nature of native title rights is revealed. This thesis will also examine the effect of Yorta Yorta on subsequent cases, particularly how subsequent Courts have interpreted the continuity of connection requirement and how it has affected the questions of proof they felt the claimants were required to answer. Particularly highlighted will be the cases of Larrakia and Single Noongar, two cases which have brought about starkly different outcomes for the claimants. The approach taken will be to discuss whether the requirements of native title in Yorta Yorta have produced a native title system which equitably and in justice recognises traditional owners’ rights to land in modern times, or whether they consign native title to being an historical relic, of little utility in reflecting the modern-day relationships of traditional owners to their land. In other words, was Yorta Yorta ‘the great re-freezing’?

Fishways and freshwater fish migration on South-Eastern Australia.

University of Technology, Sydney. Faculty of Science. / In the last 100 years there have been dramatic declines in the range and abundance of native freshwater fish in south-eastern Australia. These declines have been attributed to habitat loss and degradation (including river regulation, water quality, erosion/siltation, instream cover and riparian vegetation), alien fish species, overfishing, and the obstruction of fish passage. In south-eastern Australia there are 86 species of freshwater fish and 36 of these have some migratory component of their life history that requires free passage along streams. The migrations of these fish in this region have been inhibited or prevented by the existence of more than 1500 dams and weirs. To mitigate this impact there are only 69 fishways. Most of these fishways are based on designs suitable for the swimming ability and behaviour of salmonids from the Northern Hemisphere. There are, however, no native salmonids in Australia. I assessed one of these salmonid fishways, at Euston on the Murray River, for its suitability for passing native fish. Fish were trapped at the top and bottom of the fishway over eight paired days. Although this fishway has one of the lowest slopes of the older fishways, and therefore potentially one of the easiest to ascend, very few of the fish that entered the fishway could get to the top. For example, 777 +/- 238 [x +/- s.e.] golden perch (Macquaria ambigua) per day entered the fishway but only 4 +/- 2 per day were collected at the top of the fishway. This and other data highlighted two points: i) the ineffectiveness of the salmonid-type fishways for native fish; and ii) assessing fishways by counting fish at the top only, although widely used throughout the world, is insufficient to assess the performance of a fishway. Counts of fish from the top of a fishway can, however, be useful to monitor fish populations over time. An excellent example of this is provided by long-term monitoring of the Euston fishway, which shows massive declines in the upstream movements of silver perch (Bidyanus bidyanus), Murray cod (Maccullochella peelii peelii) and Macquarie perch (Macquaria australasica) between 1940-45 and 1987-90, indicating corresponding declines in the populations of these species. The failure of salmonid fishways for non-salmonid fishes has been a common experience throughout the world. It stems partly from a lack of knowledge of the migratory patterns of non-salmonid fish, and from a lack of quantitative experimental research into the swimming ability and behaviour of these fish in fishways. To redress this situation for south-eastern Australia, I tested fish in experimental fishways in a hydraulics laboratory. The fishway design tested was the vertical-slot fishway, which is a pool-type fishway where water flows between each pool via a vertical slot. The design was considered to potentially suit the hydrology of Australian rivers and the behaviour of native fish. For these experiments I selected fish species and life stages representative of the migratory fish fauna of the two major drainages of south-eastern Australia. For the south-eastern coastal rivers I chose juvenile Australian bass (Macquaria novemaculeata)[mean lengths of 40, 64 and 93 mm] and barramundi (Lates calcarifer) [43 mm]. These two species are catadromous, with the adults migrating downstream to the estuary to breed and the juveniles migrating upstream. For the large inland Murray-Darling river system I chose adult golden perch (Macquaria ambigua) [441 mm] and silver perch(Bidyanus bidyanus) [258 mm]. At the beginning of this study, adults of these two species were considered to be the main life stage migrating upstream. In the laboratory experiments fish were tested at different water velocities and probit analysis was applied to the proportion of fish that negotiated these velocities. I used this approach to produce values which I called the NV90 and the NV95, which are the maximum water velocities that 90% and 95% of the fish could negotiate in the fishway. For bass, barramundi and golden perch these values ranged from 0.7 to 1.8 m s-1. These values are well below the standard maximum water velocity for salmonid fishways of 2.4 m s-l. The silver perch results were too variable to analyse. The data obtained from the laboratory experiments were used by water resource agencies to build eight new vertical-slot fishways in coastal and inland rivers of southeastern Australia. One of the largest of these new fishways was at Torrumbarry Weir on the Murray River, which consists of 38 pools, each 3 m long, ascending a 6.5 m high weir. The fishway, if successful, would provide access to 350 km of habitat above the weir. To determine whether or not the fishway was successful in passing native migratory fish it was assessed for 2.5 years by: i) sampling monthly above and below the fishway with a standard set of independent, replicated nets; and ii) sampling within the fishway. The netting showed that there were major aggregations of migratory fish below the weir when the fishway was not operational. However, when the fishway was completed and operational, 13 months after the commencement of sampling, there were no further major aggregations of migratory fish below the weir. These data, combined with high numbers of fish successfully ascending the fishway, indicated the success of this vertical-slot fishway design. It was estimated that from February 1991 to June 1993 20,7 14 native fish and 16,595 alien fish (all carp [Cyprinus carpio]) had successfully ascended the fishway. Sampling at the top and bottom of the fishway showed that the fishway passed almost all the species and sizes classes of native migratory fish, except for Australian smelt (Retropinna semoni). The latter is a small species 15 to 40 mm long that only entered the lower few pools of the fishway. The widespread distribution of this species indicates the migration is facultative. Experiments within the fishway showed that the laboratory experiments had underestimated swimming ability. However, it was discovered that fish still needed over 1.5 hours to ascend the full length of the fishway. In addition, some species only migrated upstream during daylight and if their ascent of the fishway was not completed in daylight the fish moved back down the fishway. I concluded that the original water velocity criterion from the laboratory experiments was appropriate and that future fishways need to consider ascent time and fishway length as well as water velocity. I also concluded that it is more difficult to obtain realistic results from 'off-site' experiments, where fish are transported to a laboratory or other facility, than from in situ experiments where naturally migrating fish are used and are not handled until the end of the experiment. Sampling at Torrumbarry Weir provided detailed information on the biology of the migratory fish species, which is essential to designing effective fishways. Carp(Cyprinus carpio), an introduced or alien species, and bony herring were newly identified as migratory, and golden perch and silver perch were confirmed as migratory. A major finding was that 95% of golden perch and 87% of silver perch moving upstream were immature fish. Previously the upstream movement of immature fish in this river system was considered insignificant. Fortunately the conservative water velocities in the Torrumbarry fishway accommodated these smaller fish(approximately 100 to 300 mm in length). The reason for the large numbers of immature fish migrating upstream is not clear, but it may be to optimise feeding, enhance colonisation, or to compensate for the downstream drift of the pelagic eggs and larvae. Migration of all species was seasonal. Spring, summer and early autumn were the main periods of upstream movement for native fish, and carp moved upstream in spring and early summer. Migration of carp was stimulated by rising water temperature only, but golden perch and silver perch were stimulated to move upstream by small changes in river levels. This small scale variation in streamflow is frequently suppressed by river regulation, and this is likely to have contributed to the significant decrease in the numbers of migrating native fish. Upstream migration of all species often occurred during low flows, as well as higher flows. This also occurs in coastal rivers of southeastern Australia. For both the coastal and inland rivers of this region it will be important to design fishways and environmental flow releases to accommodate this aspect of fish migration and the often semi-arid hydrology of these streams. Golden perch and silver perch were aged using sagittal otoliths and validated using known-age fish. The data showed that the immature fish were all over one year old, suggesting that younger fish are not migrating upstream. More research is needed to determine the location and habitats of the less than one year old fish. Ageing and examination of gonads indicated the size and age at maturity for these fish. This suggested that minimum size limits currently used to regulate the recreational fishery are not allowing fish to reach maturity. Golden perch and silver perch were found to be long-lived fish, up to 26 and 27 years respectively. Interestingly, samples of these two species from other rivers within the Murray-Darling river system show that the maximum sizes of these fish can vary significantly between rivers, suggesting that the ecology of different rivers within this large river system varies considerably. The development of fishways for non-salmonid fishes throughout the world has frequently met with failure. From the work in the present study and from reviewing other work I suggest there are five steps for the development of effective fishways. 1. Determine which fish species are migratory: - it is important to identify the smallest and largest fish that are migratory, as this affects the initial choice of the size of the fishway to test. 2. Test fish in an experimental fishway: - in situ experiments are recommended; - avoid handling of fish before and during experiments. 3 Design the fishway: - first decide on the location of the fishway entrance; - extrapolate research results with caution; - do not reduce pool sizes from the experimental model; - avoid tunnels; - design the fishway to operate over the full range of flows during which fish migrate. 4. Link the fishway with the operation of the dam or weir: - maintain flow and temperature regimes that stimulate migration; - manage flow releases over the spillway to guide fish to the fishway entrance. 5. Assess the fishway: - use quantitative and relevant performance criteria to assess the fishway and not only counts of fish from the top of the fishway. The most common strategy in the past has been to design the fishway and ignore steps 1, 2, 4 and 5. With fishways being increasingly recognised as important tools in the rehabilitation of aquatic biota in temperate river systems, and as a potential tool in the development of water resources in tropical rivers, it is essential that they are appropriately designed, constructed, and assessed. Otherwise the mistakes of the past will very likely be repeated.

The characterisation of Australian freshwater fish immune systems and their response to immunomodulators

The Murray-Darling basin is the largest river system in Australia with significant economic, social, recreational and cultural value. It supplies water for drinking and agriculture to a large inland area of the eastern and southern states of Australia. It is also the ultimate sink for many environmental contaminants that result from human activities within the catchment. Aquatic organisms live intimately with their environment and may be continuously exposed to these contaminants through the water column or the food chain. Some chemicals are bioaccumulated and biomagnified in tissue to reach high body burdens. Populations of native fish species within the Murray-Darling basin have been in decline since human settlement, yet little is known about the lethal and sublethal effects of environmental pollutants on native freshwater fish and many of the Australian water quality guidelines are based on data from exotic fish species. Researchers have correlated levels of pollution with immune dysfunction and an increased incidence of disease amongst wildlife populations. Many of the pollutants of the Murray-Darling basin have known immunotoxicity in both mammals and exotic fish species. The immune system is a sensitive target organ because, in order to maintain integrity, it requires constant renewal through the rapid proliferation and differentiation of cells. Efforts to increase numbers of native fish in the wild have led to an aquaculture industry that produces fingerlings for the restocking of waterways. In more recent years, this industry has matured and now produces table-size native freshwater fish for local and international markets. Although the industry has researched areas of reproduction, nutrition and stocking, there is little understanding of the immunology or immunotoxicology of Australian freshwater fish. This research project investigated the immunology of three large native fish species (i.e. 2 Murray cod, golden perch and silver perch), which are the basis of the native freshwater aquaculture industry. Additionally, a small fish species native to the basin (i.e. crimsonspotted rainbowfish) was studied as an alternative to the use of large fish. Of the four species, Murray cod possessed characteristics that made it an excellent candidate for ecoimmunotoxicity testing.

Effects of trees on temperate native pasture productivity

The goal of this work was to quantify the effects of eucalypt woodland blocks on the productivity of native pastures. This research was conducted on the Southern Tablelands of New South Wales. Tree planting or retention is seen by many as an important tool in addressing the problems of soil degradation resulting from clearing and pasture improvement that threaten the sustainability of pasture systems. In particular these are dry land salinity and erosion, both of which affect large areas of agricultural lands in the south east of Australia. Whilst native tree cover remains over substantial portions of Australian pasture lands, mainly on steeper slopes and poorer soils, little has been done to measure the effects of trees on pasture productivity and soil fertility on the Southern Tablelands. Previous studies in other areas have shown a range of effects�from facilitation to inhibition�of pasture growth in the presence of trees. Soil fertility beneath trees has been shown by a number of workers to be elevated in comparison with situations in the open. Given that the range of effects may be highly site dependent, application of results from one area to another may not be valid. Thus it is necessary to measure tree effects on a regional scale if results are to be reliable. Pasture productivity was assessed over a two year period on four sites in the vicinity of Bungendore, New South Wales. A pair of plots was selected on each site, one plot in a block of eucalypt woodland, and the other nearby in an exposed, open situation. Plots were chosen to be as similar to each other as possible with the exception of tree cover. Treed plots had a tree basal area of between 10 and 20 m2 ha-1 and plots had an area of 900 m2. Two of the sites were on granitic soils and had a tree cover consisting predominantly of Eucalyptus pauciflora. The remaining two sites were on soil derived from sedimentary rocks with tree cover consisting mainly of E. mannifera, E. dives and E. melliodora. Perennial native pasture species present were similar across all sites, although their relative contributions to standing biomass varied between sites. As the plots were grazed during the period of measurement, productivity and offtake were measured seasonally using exclosure cages on each plot. Pasture standing biomass was assessed using the comparative yield technique. Microclimate was monitored in each plot by automatic weather stations. Soil moisture to a depth of 45 cm was measured by time domain reflectometry using permanent probes in each plot. Ten additional survey plots on each site, covering the range of tree basal area from 0 - 30 m2 ha-1, were assessed each season in the second year for standing biomass, soil fertility and pasture quality; expressed by nitrogen content and dry matter digestibility. Pasture floristics were measured using the dry-weight-rank method. These additional plots were chosen to be as representative of the paddocks as possible. Over the two years that productivity was measured, it was found to be higher under trees than in the open. This was predominantly due to higher winter and spring growth within treed plots. Grazing offtake was also found to be higher under trees, partly accounting for lower standing biomass found in the treed plots. Wind run, evapotranspiration and photosynthetically active radiation were all reduced by the presence of trees. Beneficial effects of shelter from winds may largely explain the higher productivity observed in the treed plots, and could outweigh negative effects of below ground competition and radiation interception by tree canopies at low to moderate tree densities. Soil moisture was not affected by the presence of trees. Soil fertility also did not differ between treed and open plots nor was there any difference in pasture nitrogen content or dry matter digestibility. On the sites where soils were derived from sedimentary rocks, pasture floristics were found to be related to tree basal area. Themeda ausfralis biomass was negatively related to tree basal area, and was partially replaced by large tussock species such as Poa sieberiana and Chionochloa pallida. A reduction of pasture quality resulted, particularly as the latter species is not grazed to any significant extent. Given the desirability of having deep rooted perennial components in grazing lands, the results of this study indicate that it may be possible to utilise trees to assist in preventing or reducing a range of adverse environmental consequences arising from agricultural activities, without unduly compromising pasture productivity. Additionally, the wide range of environmental conditions provided by a mix of treed and open pasture promotes a higher degree of heterogeneity of the herbaceous layer. This may assist in maintaining productivity over a greater range of climatic conditions than would be the case with a more homogeneous pasture.

Molecular systematics of the native Australian waterfowl (Aves: Anseriformes)

A consensus classification for the waterfowl (order Anseriformes) has never been reached. There have been many revisions of the relationships within the order including those of the monotypic Australian genera. The Southern Hemisphere anseriforms comprise a large number of monotypic, endemic genera which have traditionally been linked to the established genera and tribes of the Northern Hemisphere. More recently, however, with the recognition of endemic Australian radiations of marsupial mammals (Main and Bakker 1981) and passerine birds (Cracraft 1976; Sibley and Ahlquist 1985; Christidis et al. 1988; Christidis and Schodde 1991), the affinities of the six monotypic Australian genera of anseriforms have been questioned (Delacour 1954; Frith 1955, 1964a, b, 1982; Johnsgard 196la, b, 1966; Davies and Frith 1964; Fullager 1990). In particular, whether they are more closely related to one another, or whether some or all of these monotypic genera have closer affinities with the Northern Hemisphere genera. Classification of the taxonomic relationships of the aberrant Australian endemic species may also corroborate or refute the recently advanced hypothesis of a Southern Hemisphere origin for the Anseriformes (Cracraft 1976, 1980; Livezey 1986; Olson 1988). A 307bp fragment of the mitochondrial cytochrome b gene of the 19 native Australian anseriforms and four Northern Hemisphere species was enzymatically amplified by PCR and manually sequenced. The Chicken (Gallus gallus) and Muscovy Duck (Cairinia moschatd) cytochrome b sequences were obtained from Genbank. The patterns of evolutionary dynamics within the cytochrome b gene of Anseriformes appear to conform to those reported in studies of avian and other vertebrate mtDNA. A new phylogenetic classification for the Anseriformes is proposed. The phylogenetic trees generated in this study indicate that the monotypic Australian genera, the pygmygeese and the swans and geese are members of the subfamily Anserinae which appears to represent a Southern Hemisphere radiation. Within the Anserinae, the Cape Barren Goose and Freckled Duck link most closely with each other, the Pink-eared Duck appears to be closely related to the true geese, the Musk Duck is a sister taxon to the Pink-eared Duck and may be less closely related to the Oxyura than previously thought and the Magpie Goose is the most divergent member of the Anseriformes included in this study. The Maned Duck and the remaining native Australian anseriforms are members of the established European genera and tribes of waterfowl. These species probably represent a secondary radiation of recent Northern Hemisphere invaders of Australia. Finally, the data provides some support for the theory of a Southern origin for the Anseriformes.

The constitution of the Northwest Territories

The general theme of the thesis is a broad examination of the nature and structure of the constitution of the Northwest Territories, including the relationship of the Territorial Government to the Federal Government and an examination of some possible future developments in the area.<p> Following a review of the constitutional history of the Northwest Territories and a summary of relevant legislation, past and present, Chapter Two contains an examination of the status of the Government of the Northwest Territories, concluding that it is a government in the true sense and not simply an agency of the Federal Government. It has powers similar to those exercised by the Provincial Governments but differs from them in its lack of responsible government and its continuing legal and practical domination by the Federal Government.<p> Some examination is made of the forces promoting change in the constitutional structure and status of the Territories. The two dominant forces examined are the existence of major non-renewable resources, particularly hydrocarbons, and the pressure for settlement of native land claims and native self-determination. An examination of the current law concerning control of natural resources and Federal Government policy statements indicates that the Federal Government has, and will endeavor to retain, virtually complete control over all non-renewable resources with a significant economic impact or national demand.<p> A general review of some of the proposals for the settlement of native claims leads to the conclusion that the claims will be settled in the same manner as previous claims by native people in Canada but will be coupled with changes in the governmental structures of the Territories, consistent with Canadian political traditions, designed to promote and guarantee the involvement of native people in government.<p> It is concluded that, for the most part, the constitution of the Northwest Territories will continue to evolve towards responsible government and full participation by the Territories as a member of the Confederation. That evolution will follow a pattern similar to that established by the development of the prairie provinces with the only significant differences being found in the role of native people in the political life of the community and the strengthened determination of the Federal Government to retain control of non-renewable resources for an indefinite period.

A description of variables related to the occupational choice of Indian/Native teachers

The purpose of this study was to identify and describe the variables related to the occupational choice of Indian/Native teachers in Saskatchewan. In addition, four questions were posed to determine the extent of influence of specific people, internal agents, and ethnic concerns.<p>The sample for the study consisted of 115 Indian/Native teachers, all graduates of the Indian/Native Teacher Education Programs, and employed within Saskatchewan schools. Data was collected by a mail-out questionnaire. Through analysis of the data, the variables were identified, as was the extent of influence of specific people, internal agents, and ethnic concerns.<p>The major finding of this study was that Indian/Native teachers chose teaching as an occupation for reasons related primarily to ethnic concerns, rather than to variables identified in occupational choice approaches. Important differences were found in the variables of choice between Status Indian and Metis teachers; between younger and older teachers; and among those who had decided to become teachers within different age groups. These findings suggested the need for specially designed career education programs and the presentation of occupational information that would be relevant to Indian/Native students.<p>The five statements ranked most important by the total group in the decision to become a teacher were:<p>1.I enjoy working with children and/or youth. <p>2.Indian/Native teachers were needed in the school.<p>3.I wanted to help my people. <p>4.Indian/Native people are responsible for their own survival as a people.<p>5.I wanted to help Indian/Native people gain control of their education system.<p>Only the first statement related to occupational choice approach with the remaining four stemming from Indian/Native concerns.<p>Five research hypotheses were tested to answer the research questions. Significant differences were found leading to the acceptance of the hypotheses and the findings that differences existed between the variables related to the occupational choice of teachers classified on the basis of:<p>1. Age when the questionnaire was completed: The younger teachers, 19 30 years, differed from older teachers in their search for improved self identity; in being influenced by the opportunity to be a role model; and in desire to work against discrimination in schools. The older teachers, 31 years and older, were more influenced by positive family support; by the need to be with people; and by the desire for better living conditions.<p>2. Age when the decision was made to become a teacher: Respondents who had chosen teaching between the ages of 6 to 18 years,highlighted the importance of having supportive family; the desire to develop a positive self image; and the wish to gain professional recognition. Those who made the choice between 19 to 25 years, also pointed out self image needs. For them, the opportunity to be a role model was important, but family influence had been a minor factor. Those who decided at a later age, 26 years or older, wished to work with people and thought that teaching matched their interests.<p>3. Ethnic identity: Status Indian teachers had been strongly influenced by the family in contrast to the Metis group, which did not include family elements in their selection of 10 very important statements. The Me.tis teachers were motivated to teach because of perceived discrimination within schools; the need for an improved self image; and the perception that in teaching they could do what they liked to do.<p>4.Type of school attended.<p>5.Source of funding received while attending a teacher education program.<p>Teachers who had attended either a federal or residential school, and had received funding from Indian and Northern Affairs Canada were likely to be Status Indians.They had been strongly influenced by their families, by wanting to attend an Indian training program, and by wanting a better standard of living.Teachers who had attended a provincial school and received funding from the province of Saskatchewan were likely to be Metis.They had been strongly influenced by personal concerns for identity and independence. Family influence was a lesser factor.<p>In a further step of data analysis, the computation of mean response scores, individual family members, teachers, and the community were found to be relatively unimportant variables related to the decision to become a teacher.<p>Personality needs, interests, and abilities were important; the desire to improve socio-economic status and identification with a role model were found to be relatively unimportant.<p>The demand for Indian/Native teachers, the desire to help Indian/Native people, and Indian/Native control of the education system were found to be important variables. The desire to attend an Indian/Native training program and to receive funding during training were relatively unimportant variables related to the decision to become a teacher.

Liberating community education and social change : the Regina Native women's group (1971-1986)

This thesis examines and interprets a social movement organization, the Regina Native Women's Group, as an organization that uses liberating community education as a method of improving the social, economic, cultural and political conditions of Native women and their families in the city of Regina. The study focuses on the issues of the housing and community-living crises that developed in Regina during the 1970's to portray the Group's utilization of liberating community education. The study examines factors such as racial and gender oppression, co-option by the state and dilemmas within the Regina Native Women's Group that often hindered it from obtaining social change. As well, the support that the organization received from grassroots organizations and society's institutions that enabled change to occur is also examined.

Captain death strikes again: tuberculosis and the Stó:lõ 1871-1907

Tuberculosis has cast a long shadow on the history of Native-Newcomers relations in the Pacific Northwest. Malicious and deadly, it has dramatically affected the lives of thousands of Aboriginal people and become a permanent part of life in Stó:lõ communities. However, its history, especially the period 1871-1907, has been underrepresented in historical scholarship. Due to perceived scarcity of available quantitative information, scholars in general have paid little attention to tuberculosis, focusing instead on the early contact period, the sanatorium period that began in British Columbia in 1907, or on another disease altogether, usually smallpox. Moreover, when tuberculosis has been studied, it has been approached as a disease within a western bio-medical perspective.<p> In contrast to much of this historiography, this thesis examines tuberculosis more holistically as an illness best understood culturally, as it has been experienced by communities as well as by the individual. Through story and song as well as a thorough reading of familiar government records under a different lens, this thesis engages the perceptions and understandings of both Aboriginal people and Euro-Canadians, patients and government agents, to produce a more balanced, meaningful, and culturally reflexive understanding of the history of tuberculosis. Following a historiographical discussion in the introduction, chapter two explores Stó:lõ oral archival sources to engage Stó:lõ peoples perspective of tuberculosis and illness. These stories and songs, generated by Stó:lõ people themselves, demonstrate the profound influence that tuberculosis has had on Stó:lõ communities throughout the latter part of the nineteenth century. With this new framework in mind, chapter three re-examines the historical record and specifically government documents created by the Department of Indian Affairs and other preceding agencies. This more holistic interpretation of tuberculosis reveals that rather than alleviating the severity and prevalence of tuberculosis in Stó:lõ communities, certain DIA initiatives likely exasperated its affects. By thus addressing the historiographical gap in tuberculosis literature and by generating a more meaningful, balanced, and culturally reflexive analysis of the history of tuberculosis among the Stó:lõ, this thesis contributes to Canadian medical history, the history of Native-Newcomer relations, and the history of the Stó:lõ people.
