EMH is necessary to prove that price follows a random walk model. But EMH is established on market, which is independent normal distribution and variance existing. But the market is a complicated interdependent system. A lot of cases are what EMH can¡¦t explain, such as scale effect, season effect etc. So a lot of theories that explain these special cases have appeared. Let researchers taking more attention about the use of non-linear theory in financial market. Fractal theory is one kind of nonlinear analysis and has only decades since it developed, because it can efficiently expenses many complicated problem, such as economics phenomena, so it has became the strong analysis tool of the nonlinear capital market theory. There are five parts in our paper, the first is an introduction; the second is introduced the theories of EMH and FMH simply, and list internal and overseas research results; the third is introduced the method of Hurst index and the method of estimation Hurst index particularly; and in the forth we uses the exchange rate return of the ten developed nations and ten developing nations to see whether the exchange market of these nations exist long-time memory; The fifth is a conclusion. Comparing countries difference after grouping them bases on development degree and exchange rate institute. Our results show that country development degree would affect Hurst index and nonperiodic cycle, but exchange rate institute would not affect them.

Abolishing the death penalty in international law on human rights has been developed for many years. However, the death penalty remains as an important instrument against crime in some countries. This essay focuses on restriction in using the death penalty and the measure to suspend the execution in those countries which still have the death penalty in their criminal justice systems. In response to international trend to abolish the death penalty, Taiwan¡¦s government has made some efforts to reduce the possibility to impose the death penalty on offenders in recent years including the abolishment of absolute death system in criminal code, and has no execution in practice in last two years. On the other hand, Mainland China has also restrained its use of the death penalty in 1997¡¦s criminal code. Especially Mainland China has established a unique system concerning suspension of execution which has never been used by other countries. Also in the United States, some states have declared a moratorium by their governors in last decade as the call for moratorium has become stronger than ever. Before the Taiwan society reaches a consensus to abolish the death penalty, there must be some methods to adopt to restrict the employment of the death penalty and to suspend the execution. By reference to the measures employed by Mainland China and the United States, this thesis tries to suggest some steps to achieve these goals.
