České atomové právo / Czech nuclear law

Tématem této práce je České atomové právo. Atomové právo je tvořeno soustavou právních norem, které regulují činnosti právnických a fyzických osob související s mírovým využíváním atomové energie a ionizujícího záření. Atomové právo je velmi úzce spojeno s přírodovědnými vědními obory, a proto je pro jeho pochopení důležitá alespoň základní věcná znalost této materie. Stručný souhrn nejdůležitějších vědně-historických milníků uvádím v první kapitole této práce. Následují kapitoly věnované historickému vývoji právní úpravy atomového práva a současné právní úpravě atomového práva. Vývoj atomového práva je nahlížen jak z hlediska mezinárodního a evropského tak národního. Českou právní úpravu atomového práva porovnávám s právní úpravou finskou a zamýšlím se nad jejich odlišnostmi a možnostmi, jak by jedna mohla obohatit druhou. U obou úprav porovnávám kromě formální stránky také nástroje ochrany životního prostředí a zásady, které jsou pro ně stěžejní. Vzhledem k možnému zneužití jaderných materiálů k válečným účelům a rovněž s ohledem na potenciální přeshraniční dopady případné jaderné havárie se právní regulací mírového využívání jaderné energie a ionizujícího záření zabývají mnohé mezinárodní organizace, kterým v této práci pro jejich důležitost a autoritu věnuji samostatnou kapitolu. This master thesis called ''Nuclear devices in the view of law'', deals with the current legal arrangement of civil nuclear facilities (devices) in the Czech Republic. Due to the fact that the Czech Republic is bound by the international commitments and its membership in the EU, the master thesis also covers the international and European regulations. The master thesis is composed of four parts, which are subdivided into chapters and subchapters. The first part is devoted to the concept of the nuclear facilities, its kinds, position in the legal system and the relevant legal instruments. The second part deals with a particular legal framework of the nuclear law, which governs the issue, including the international, European and Czech regulations. A separate chapter discusses the principles, which are common to the all relevant branch of law. The third part is concerned with the life cycle of the operation of the nuclear facility and the conditions for execution of its particular stages. The final part deals with the safety and security of nuclear facility and its realization as the key issue of the nuclear facility legal regulation.

Contribuição à legislação brasileira no setor de energia nuclear / CONTRIBUTION TO THE BRAZILIAN LEGISLATION IN NUCLEAR ENERGY FIELD

Tecnologia nuclear, ter o seu domínio é, considerado nos dias de hoje, um diferencial para um país frente aos demais, podendo representar uma ameaça internacional a ser contida ou um aspecto de valorização tecnológica e política para aqueles cuja credibilidade internacional é reconhecida. Diante do uso crescente de novas tecnologias no setor e a necessidade de uma regulamentação, de acordo com os padrões de segurança internacionais, para assegurar a sua utilização, o objetivo desse estudo foi demonstrar se a radioproteção ocupacional e ambiental praticada em nosso país está de acordo com os padrões internacionais de segurança radiológica e nuclear. Para tanto, foi atualizada e revisada a legislação brasileira na área da energia nuclear comparando-a com as da União Europeia, contextualizados os pontos fortes e os pontos fracos da legislação nacional, apontadas críticas e sugestões para que reformas sejam realizadas visando a sua adequação aos padrões internacionais. A hipótese considerada demonstrou que mudanças na estrutura de regulação do setor nuclear brasileiro são necessárias, visando a criação de uma agência reguladora de atividades nucleares, com o intuito de assegurar que o estado da arte e da tecnologia, em termos de segurança nuclear, seja a base do exercício de suas atividades normativas de fiscalização e de avaliação de segurança na preservação do meio ambiente, da saúde do público e dos trabalhadores, frente às aplicações da energia nuclear. / Nuclear technology: to keep its domain is actually considered a differential for a country in relation to other ones, being able to represent an international threat to be contained or an aspect on technological and political valorization for those ones with recognized international credibility. Face to a raising use of new technologies in the field and the requirement asking for regulation in accordance with international safety standards, in order to assure its employment, the objective of this study was to demonstrate whether occupational and environmental radioprotection performed in our country is within radiological and nuclear safety international standards, and so it was updated and revised the Brazilian law in nuclear energy area, by comparing it with European Union, contextualized strong and weak points from national law, indicating criticisms and suggestions, in order that modifications will be able to be accomplished, aiming to its adequacy to international standards. The considered hypothesis showed that are required changes in the regulation structure in Brazilian nuclear area, aiming to the creation of a regulator agency of nuclear activities, with the purpose of assuring that the state of art and of technology, in terms of nuclear safety, to be the basis of the exercise related to their normative, control and safety assessment activities, on environment preservation, public and workers health, face to nuclear energy applications.

L'autonomie du droit nucléaire : Contribution à l'étude de la nature et des caractères d'un droit nouveau / The autonomy of nuclear law

La découverte des réactions nucléaires à la fin du XIXe siècle est à l’origine de l’apparition d’un ensemble de nouvelles activités concernant la médecine, l’industrie, la recherche ou la défense. Le droit nucléaire permet l’exploitation des réactions nucléaires en limitant leurs effets néfastes. Les enjeux relatifs au droit nucléaire sont multiples puisqu’il régit des domaines tels que la sûreté des installations nucléaires de base, la responsabilité des exploitants, la protection de la santé humaine et de l’environnement ou encore l’information et la participation du public. Cette thèse met en évidence les particularités du droit nucléaire et participe à en démontrer l’autonomie. Celle-ci apparaît lorsque sont applicables des règles dérogatoires du droit commun et elle se traduit principalement par l’existence de principes propres. Elle peut aussi procéder de particularités liées aux sources, aux caractères, ou aux finalités poursuivies. L’autonomie du droit nucléaire souffre cependant de limites puisque des éléments communs avec d’autres droits peuvent être identifiés comme c’est le cas pour les principes de prévention, de protection ou de développement durable. Le caractère autonome du droit nucléaire conduit ainsi à s’interroger sur la portée réelle de concepts plus larges et notamment celui de système juridique. / The discovery of nuclear reactions at the end of the 19th century lead to the apparition of a whole set of new activities in the fields of medicine, industry, research and defense. Nuclear law allows the exploitation of nuclear reactions while limiting their noxious effects. Multiple issues are at stake when it comes to nuclear law, as it holds sway over domains such as the safety of nuclear installations, the responsability of managers, the protection of human health and environment, and also the information and participation of the public. This paper highlights the distinctive features of nuclear law, and demonstrates the autonomy of this division of law. Nuclear law is autonomous when derogatory rules of common law are applicable. It translates into the existence of principles of its own. This autonomy can also be based on specificities linked to the sources, the characters, and the overall purposes. The autonomy of nuclear law remains limited, as common elements with other laws can be identified. It is the case, for instance, of the principles of prevention, protection and sustainable development. The autonomy of nuclear law thus leads to interrogations on the real impact of broader concepts, especially the concept of legal system.

This thesis goes into the czech nuclear law, i.e. the set of legal norms adjusting the terms of use of ionizing radiation and nuclear energy in order to ensure the protection of citizens, workers, property and environment against ill-effects of irradiation. The thesis has two main objectives. The first one is to provide a systematic insight into the corresponding existing czech legislation and its structure. To that end, the object and the subject matter of the nuclear law including the legal and real substance of its basic terms are analyzed. Furthermore, the text concerns itself with the international and european enactment, i.e. international treaties effective in the Czech Republic, organizations, in which the Czech Republic participates, Euratom and its secondary law. The role, recent importance and also original intent of organizations and treaties are emphasized. It is followed by the analysis of the existing municipal law of the Czech Republic, which is mainly inherent in the nuclear act and subsequent implementing legislation. The topic of this thesis is Czech nuclear law. The purpose of the nuclear law is to regulate the conditions of use of nuclear energy and ionizing radiation in order to ensure protection of people and environment from the adverse effects of ionizing radiation. Because of highly technical nature of nuclear law, the first chapter is devoted to possibilities of use of ionizing radiation, and to outline few of relevant technical terms. The second chapter of this thesis deals with international cooperation in the area of use of nuclear energy and ionizing radiation. The third and fourth chapters are devoted to Czech nuclear law with main focus on environmental aspects. While the third chapter defines the principles and tools of environmental protection in the field of nuclear law and introduces the structure of legal norms in this area, the fourth chapter analyzes the regulation of specific activities related to the use of ionizing radiation. Included are chapters concerning construction of nuclear facilities, transport of radioactive substances, decommissioning of nuclear facilities and radioactive waste management. Legal regulation of a deep geological repository of nuclear waste Abstract The topic of the thesis is the legal regulation of a deep geological repository of nuclear waste in the legal system of the Czech Republic. The thesis aims to summarize the administrative law aspects of preparation, construction, operation and termination of operation regarding the deep geological repository, while simultaneously analyzing legislation regulating the deep geological repository. The structure of the thesis corresponds with this aim, and reflects the phases of preparation and existence of the repository. First part of the thesis, following the introduction, defines the principal legal terms in nuclear waste handling and its disposal.
