No. of bitstreams: 1 JanedeOliveiraRabelodeAlmeidaDissertacao2016.pdf: 1758339 bytes, checksum: 3e9677fa5ca1963932cfd2cf81d5d806 (MD5) Previous issue date: 2017-05-05 / The objective of this study is to verify that the main issues may involve the social acceptance of the right to the implementation of ortotanasia in the context of the transformations brought about by the evolution of technology, Bioethics and, consequently, Law. It is a current theme, complex in itself, therefore involving the view of diverse disciplines, such as Biology, Philosophy and Sociology, which are represented in their constituent elements, such as common sense, science and culture, respectively. Religion stands out in this context, because the subject has the object of death and the treatment given to it. Theoretically, it was tried to characterize the evolution of the law in front of the social development resulting from the technological transformations and the emergence of Bioethics; analyzing ortotanasia in the context of the unfolding of the terminality of life; highlighting cultural aspects that can mobilize popular acceptance of controversial issues in general and ortotanasia in particular (common sense, science); to raise, among law students, objective and subjective aspects that may justify the non-undertaking of the artificial prolongation of life in terminal patients by the physician. Empirically, the results showed that there is still a lot of ignorance on the subject, which hinders or prevents answers that clearly point out the main difficulties of the social acceptance of ortotanasia. However, the tendency to recognize the right to refuse to therapeutic obstinacy was clear, which in itself already represents an advance against traditional culture. / O objetivo deste trabalho ?? verificar que principais quest??es podem envolver a aceita????o social do direito ?? implementa????o da ortotan??sia no contexto das transforma????es trazidas pela evolu????o da tecnologia, da Bio??tica e, consequentemente, do Direito. Trata-se de um tema atual, complexo em si, por isso mesmo envolvendo o olhar de disciplinas diversas, como o Biodireito, a Filosofia e a Sociologia, essas representadas em seus elementos constituintes, como senso comum, ci??ncia e cultura, respectivamente. A religi??o se destaca nesse contexto, pelo fato de o tema ter como objeto a morte e o tratamento dado a ela. Teoricamente, buscou-se caracterizar a evolu????o do Direito frente ao desenvolvimento social resultante das transforma????es tecnol??gicas e do surgimento da Bio??tica; analisar a ortotan??sia no contexto dos desdobramentos da terminalidade da vida; destacar aspectos culturais que podem mobilizar a aceita????o popular de quest??es pol??micas em geral e da ortotan??sia em particular (senso comum, ci??ncia); levantar, entre estudantes de Direito, aspectos objetivos e subjetivos que podem justificar o n??o empreendimento do prolongamento artificial da vida em pacientes terminais pelo m??dico. Empiricamente, os resultados demonstraram que ainda h?? muito desconhecimento sobre o assunto, o que dificulta ou impede respostas que claramente apontem as principais dificuldades da aceita????o social da ortotan??sia. Por??m, ficou clara a tend??ncia ao reconhecimento do direito de recusa ?? obstina????o terap??utica o que, em si, j?? representa um avan??o frente ?? cultura tradicional.
