Regime semi-aberto e facções organizadas: motivação das fugas no Instituto Penal de Viamão

For this, the reports of prisonization, the interaction of the groups inside the jail, and the confusion there is between the inside and outside world of an utter institution have been presented. The research shows the reality of the prison in Brazil due to the disobedience of Bill no. 7210, 1984 (Penal Execution) where an informal power and a parallel culture represented by the formation of organized factions emerge among the prisoners. Based on the interviews carried out with the prisoners, psychologists the, social assistants, and penitentiary agents, it has been evidenced a host of difficulties prisoners face in order to move to the semi-open regime. In this sense, it has been demonstrated the problematic of escapes in this modality of sentence fulfillment. When analyzing the motivation of the escapes in the Penal Institute of Viamão in the year of 2007, it has been observed that the incompatibility of prisoners with the organized factions is the main reason why most of the cases of evasion have been happening in regimes of semi-freedom. / O trabalho aborda o processo de cumprimento da pena privativa de liberdade em regime semi-aberto. Para tanto, foram apresentadas as relações de prisionização e interação dos grupos dentro do cárcere e a confusão existente entre os mundos interno e externo de uma instituição total. A pesquisa demonstra a realidade carcerária existente no Brasil, apresentada em descumprimento com a Lei n° 7. 210, de 1984 (Lei de Execução Penal), de onde emergem, entre os presos, um poder informal e uma cultura paralela representados pela formação das facções organizadas. Com base nas entrevistas realizadas com presos, psicólogos, assistentes sociais e agentes penitenciários, ficaram evidenciadas as inúmeras dificuldades que os presos enfrentam ao progredirem para o regime semi-aberto. Neste sentido, foi demonstrada a problemática das fugas nessa modalidade de cumprimento da pena. Ao proceder à análise da motivação das fugas no Instituto Penal de Viamão, no ano de 2007, constatamos que a incompatibilidade dos presos com as facções organizadas é a grande responsável pela maioria dos casos de evasão que vêm ocorrendo nos regimes de semiliberdade.
