Legal perspectives on the function of public- private partnerships in local disaster management in South Africa / Angela van der Berg

It is anticipated that the occurrence and intensity of disasters will increase globally and in South Africa where typical disasters include droughts, floods, extreme hailstorms, gales, structural fires, as well as earthquakes and the occurrence of sinkholes in dolomitic areas arising from mining activity. Disasters such as these, result in human suffering and damage to the resources and infrastructure on which South Africans rely for their survival and the maintenance of their quality of life. In addition, such disasters impact severely on people’s economic and social activities and have particularly negative consequences for those living in vulnerable conditions due to their high levels of poverty, their lack of access to resources, their lack of education, the degradation of the environments in which they live, and the nation’s slow economic growth. Section 24 of the Constitution of the Republic of South Africa, 1996 affords to everyone the right to an environment that is not harmful to his or her health and well-being. It may be argued that a person’s sense of environmental security in relation to the potential risks and danger of disaster falls within the scope of the protection provided by section 24. The responsibility to intervene for the protection of the interests inherent in the constitutional environmental right lies with the government of South Africa. Disaster management specifically is a functional area of competence of national and provincial government, but, practice has shown that the actual implementation of and planning for disaster management happens in the local government sphere. Against the backdrop of these introductory discussions and, given the fact that several municipalities in South Africa are under-resourced this study very specifically aims to question from a legal perspective, the potential and function of public-private partnerships (PPPs) between local government (municipalities) and the private sector (industries etc.) in fulfilling the legally entrenched disaster management duties of municipalities. Evaluating the financial robustness of special purpose vehicles involved in the delivery of defence private finance initiatives

Public sectors in the developed and emerging economies have been witnessing a period of intense change over the past three decades as a result of the development of free-market economy across the globe. In the UK, the public sector in 1970s (that comprised of nationalised industries) was severely criticised for being wasteful, and subject to political intervention, thereby making them inefficient systems for delivering public services. To put matters right, successive governments from the late 1970s embarked on public sector reforms. These reforms centred on increasing the role of private sector in delivering public services. Privatisation, the implementation of accruals-based accounting and application of compulsory competitive tendering in the public sector were some of these reforms. Public-private partnerships, including private finance initiatives (PFIs), introduced in the 1990s, were a continuation of these reforms. In the defence sector, various reforms carried out prior to 1990s failed to completely remove cost and time overruns in defence projects. PFIs were introduced to further rectify the failures of previous reforms in the defence sector because they were purported to provide better value for money. Defence PFIs are long-term agreements whereby the Ministry of Defence, MoD, contracts to purchase quality services on a long-term basis from the private sector (through the special purpose vehicle, SPV) in which the private sector provides all the finance required in constructing the asset that is used to provide the services. Value for money of PFIs is about economy, efficiency and effectiveness. The question, though is whether, Defence PFIs provide value for money as claimed by the MoD? The purpose of this thesis is to evaluate the effectiveness of three categories: 1) accommodation, 2) equipment and 3) training of Defence PFIs by assessing the financial robustness (over a six-year period) of the SPVs engaged in their delivery. This research employs a multi-method methodological approach to gather data. Qualitative research methods were employed in exploring and understanding customer-supplier relationships and included, PPPs, PFIs in general (and Defence PFIs in particular), the public sector reforms that brought about private sector integration, 4 defence reforms, and Defence PFI policies. Quantitative research was used to collect and evaluate financial data on SPVs (used in Defence PFIs). Research analysis provided mixed results regarding the financial robustness of SPVs employed in the delivery of Defence PFIs. The profit margins of SPVs involved in the delivery of Defence PFIs relating to the category of accommodation were the highest. This is followed by SPVs in the category of Defence equipment and then by SPVs in the category of Defence training. Interestingly, the majority of SPVs involved in the delivery of Defence PFIs relating to accommodation have sound financial health. On the other hand, most SPVs relating to the other two categories have serious financial problems and therefore show cause for concern. Based on research findings of this study, a number of important policy recommendations are advanced to raise the effectiveness of PFIs in the defence sector and the wider public sector.

School, family, and community partnerships as pathways to support Vietnamese immigrant children's early learning in Saskatchewan: A case study within the Saskatoon Vietnamese community

The purpose of this qualitative case study was to understand Vietnamese immigrant parents’ conceptualizations and practices related to school, family, and community partnerships that support their children’s early learning and development in a Canadian context. The study was guided by three research questions: In what ways do Vietnamese immigrant parents conceptualize school, family, and community partnerships related to their children’s early learning and development? What supports and challenges do Vietnamese immigrant parents have in building and maintaining school, family, and community partnerships that facilitate their children’s early learning and development? What practices related to the partnerships do Vietnamese immigrant parents employ to assist their children’s early learning and development? Joyce Epstein’s (1997) Theory of Overlapping Spheres of Influence and her Six Types of Involvement Framework were employed in this study. Data were collected from semi-structured interviews and observations to answer three research questions. Participants of the study included three sets of Vietnamese immigrant parents, three teachers, two Vietnamese immigrant children’s grandmothers, and one friend of a Vietnamese immigrant family who was selected on the basis of relational proximity with the focal child. The findings of this study confirmed those of previous studies that immigrant parents share interests in and responsibilities for their children’s early learning and that the partnerships are significantly beneficial for immigrant children’s early learning and their transition to a new environment out of their home setting. In addition, the findings contributed to previous theories in the field of school, family, and community partnerships. Specifically, guidelines for parental involvement that better represent the involvement of immigrant parents were suggested to extend Epstein’s (1997) framework. Additionally, this study shed light on some misaligned perceptions and interpretations related to language barriers, time constraints, the significance of grandparents’ involvement, the principle of equity and respect for diversity, and the expectation for immigrant children’s academic early learning. In addition to implications for theory, the researcher also attempted to provide some implications for practices and future research. Noticeably, some practices related to “Parenting”, a dimension of the partnerships significantly acknowledged by the Vietnamese immigrant parents, were presented in detail.

However, governments alone can no longer deliver the much needed projects mainly because of lack of money, but also due to the lack of technical skills and a changing type of citizenry. In today’s world, governments have to consult the market place to efficiently and optimally deliver the much needed infrastructure. The case for Public-Private Partnerships being better than the options of government run projects or fully privatized projects is that Public-Private Partnerships offer real advantages in three major areas: 1) risk benefits (financial, legal and project related benefits), 2) management and communication benefits (within the partnership but also importantly between both partners and the general public), and 3) the value addition to the public common good. / text

An assessment of operations and maintenance costs in public-private partnerships

Public-private partnerships (PPPs) for the delivery of transportation infrastructure are said to offer increased efficiency resulting from the private sector’s life-cycle approach to design and construction. While the literature on PPPs endorses such efficiencies, studies don’t provide empirical support for that claim. The goal of this thesis was to assess that notion. Four tasks were carried out to explore that issue. First, a literature review searched for evidence of such efficiencies and methodologies to evaluate them. Second, a simple methodology to evaluate the life-cycle cost-efficiencies of the public and private sectors was proposed. Third, since most PPP projects in the U.S. are recent and currently subject to routine operations and maintenance (O&M), indicators to compare those costs were proposed as well. Fourth, a case study compared the routine O&M costs of a PPP and of those of a system of publicly developed and managed tollroads. The literature review found no empirical evidence of superior O&M cost-efficiency of PPPs, and also, that most studies focused on design and construction cost and schedule overruns. While some studies assessing performance and/or efficiency were at times theoretical and not likely employed in practice, one methodology is proposed to evaluate life-cycle cost-efficiency. The case study results showed that the concessionaire was more cost-efficient in terms of operating expenditures (OPEX) per mile (-60%) and per lane-mile (-53%) than the system. The public system was more cost-efficient in OPEX per vehicle-miles travelled (97%), number of toll transactions (332%), and toll revenue (20%). However, those three indicators depend on traffic volume which during the study period was overwhelmingly greater on the public system. While the case study showed cost-efficiency differences between the public and private sectors, additional research is needed to empirically test the hypothesis of greater efficiency of the private sector. The proposed framework can be used, but adequate data and further assumptions about O&M costs are needed; for that, it is recommended that more comprehensive case studies be performed to obtain detailed empirical data. A better understanding of the differences in cost-efficiency between publicly and privately managed roads will help decision-makers minimize the life-cycle cost of their investments. / text

Evaluating ICT for education in Africa

This thesis is situated at the intersection between the three themes of education in Africa, impact assessment, and Information and Communication Technologies (ICTs). Specifically, it seeks to develop a critique of current practices regarding monitoring and evaluation of ICT for education within Africa, and explores plausible alternatives to such practices that would make the benefits of education and technology more available and structured towards the poor and marginalised. Two participatory case studies of ICT for education programmes in Malawi and Ethiopia were used as the main empirical focus for the research. These involved working in partnership with implementing organisations, whilst simultaneously abstracting myself so as to evaluate the evaluation process and assess the underlying reasons for what was occurring. These case studies were supplemented by three international participatory workshops and a pan-Africa survey of ICT for education practitioners. The findings from the empirical work are examined within four analytical contexts. The first of these analyses the different methodological approaches employed in the case studies and considers the limitations and opportunities encountered. The second focuses on the role of partnerships within ICT for education programmes, especially in regard to their impact in defining the nature of monitoring and evaluation processes. The third investigates the marginalising of pedagogy within many ICT for education programmes, especially in regard to educational outcomes. The fourth explores the significance of aspiration within technology related development initiatives, focussing on consequences for effective impact assessment. The applied nature of the research emphasises the need for both critical rigour and innovative alternatives in assessing ICT for education in Africa. This thesis concludes by demonstrating the ways in which monitoring, evaluation and impact assessment can be positively reframed in the light of the research findings to emphasise process, participation, capacity enhancement, and the centrality of education.

Learning partnerships : the art of handling ambiguity

This intrinsic case study is about people who worked in partnerships. Each of the partnerships emerged from relationships formed between the business, education, government and community sectors. A principle aim of the cross-sector partnerships was to enhance learning opportunities, integral to which was the incorporation of ICT. The study explores through interweaving narratives, some of the key interrelationships that emerged from the evolving partnerships as they strived to accomplish their aims. The partnerships represented a rich and complex context for dynamic and strategic change occurring, not only in the evolving partnerships, but also in the systems they intended to consolidate and optimise. Furthermore, such complexity pervaded ideological notions of instability and discontinuity arising from difference that may be implicit or explicit in open, distributed complex systems. The metaphor of hypertext serves to both retain textural qualities of organisation and address key problematics associated with visualisation and representation and also as a means to reflect upon the study by encouraging improvisatory processes akin to those experienced by the participants. In this respect, hypertext is not used to simply challenge artificial boundaries, linearities and determinisms but rather, prompt the construction of meanings further to those partially represented. It also serves to maintain a clearer relationship between those contexts within which research has been, or becomes situated. The thesis largely rests on its representational form in terms of its self-sufficiency to portray, convey, express, evoke, engage and inform. Ambiguity forms a fundamental facet of the thesis. In addition to those that rest within the texts, graphic illustrations are used to provide narratives in different forms whereby, readers are not bound by the same inadequacies or constraints in drawing meaning about the subject from text alone. By taking the view of the artist, the illustrations provide a flexibility that overcomes some of the dimensional limitations of the thesis and further emphasises its connectionist, constructivist and aesthetic undertones. The links between components and nuanced meanings emphasises the interdependencies in terms that transcend the representational form of discursive language. The case is thus, synthesised in the following illustration:

A Seat At The Table: The Unspoken Values And Benefits Of Student And Academic Affairs Collaboration And Partnerships In Higher Education

After almost two semesters as a graduate student at the University of Vermont, I decided that I wanted to do more in my second year of graduate school. It was through conversations with my colleagues that I determined that stepping out of my comfort zone of student affairs and looking into academic affairs would help develop me as not only a student affairs professional but as an educator as well. During the fall semester of 2016, I participated in an independent study where I served as a Teaching Assistant for a university diversity requirement course titled “The Political Economy of Race”. For this course I worked directly with a faculty member in the Department of Economics to cultivate a holistic classroom experience for the students in the course. Throughout the course of the semester, I was able to witness many different dynamics that were helpful to not only the students but to the professionals in the room as well. Upon completing the semester, I determined that I wanted to do more research and explore the benefits of collaborative partnerships between faculty and staff on college campuses; my focus for this research was to be around partnerships between professionals in student affairs and academic affairs. Although there has not been a lot of research around this particular topic in Higher Education, it is beginning to be studied as colleges and universities are expected to produce more valuable experiences for students. Through both research and experiential learning, I have found that there are benefits to collaborative partnerships between academic and student affairs in Higher Education as well as drawbacks to these partnerships. I have also made recommendations for future collaborative projects between faculty and staff as well as recommendations for future research in this area. Overall, there is value in the collaboration of student and academic affairs; however, it is the duty of Higher Education professionals to understand that value and work more collaboratively to ensure that students are served holistically.

Interorganizational Collaboration: An Examination of Factors That Influence the Motivation for Participation in a Collaborative Partnership of Homeless Service Providers

This project was a mixed methods study that examined the collaboration dimensions of Homeward's planning process and the factors that motivate organizations to participate. The study examined the collaborative strategy used by an organization called Homeward located in Richmond, Virginia. Homeward is a broker organization (Chaskin, Brown, Venkatesh, & Vidal, 2001) that was created in 1998 to mediate and nurture relationships among partnering organizations in order to facilitate the collaborative process required by the United States Department of Housing and Urban Development (HUD) to receive Continuum of Care funding. During the quantitative component of the study, a survey was sent to Homeward's partners (n = 44) to identify partner perceptions of Homeward's leadership, organizational structure, benefits and drawbacks of participation, and relationships with partners. The follow-up survey and focus group in the qualitative component explored themes related to organization affiliation with Homeward, benefits and drawbacks of participation, relationships with partners, challenges that impact the ability of Homeward to facilitate collaboration, and strategies to involve key stakeholders. The findings from both methods have provided an overview of how Homeward's collaborative process is perceived by its partners and have raised issues that may impact Homeward's partner recruitment and retention efforts in the future. Implications for Homeward's model of collaboration include developing an organizational structure that will support the existence of both loosely and tightly coupled systems under the auspices of a single collaborative effort for long-term planning.
