A public policy review of technical regulatory reform : the case for the African continent

Tariff and non-tariff barriers to trade are measures that are put in place in a country to which an exporter wants to export to. These barriers make it difficult for a new manufacturer to export their products. These measures may be considered undesirable in the context of world trade, because they restrict the flow of goods and are detrimental to the consumer because they drive prices up. The Uruguay Round of multilateral trade negotiations significantly reduced tariff barriers to trade. During the same round, the World Trade Organisation Agreement on Technical Barriers to Trade was negotiated with a view to ensure that countries use technical regulations (non- tariff barriers) for no other purpose than to protect the health and safety of the public and the environment. Many of the developing countries have not yet been able to take full advantage of this agreement. It is often difficult and costly for exporters from developing countries to meet the technical requirements of standards and technical regulations and to provide evidence of compliance. This stems from a lack of resources available to developing countries to participate and influence the work of international standards-setting bodies serving as a basis for technical regulation. The absence of internationally recognised national infrastructure for standardisation, accreditation and metrology also prevents acceptance of African products in export markets. Various regions such as Asia and Europe have initiated technical regulatory reforms to align their technical regulations with the requirements of the World Trade Organisation requirements and to establish appropriate technical institutions. These reforms are also expected to assist member countries to gain a competitive edge in global trade ensuring increased gains from trade liberalisation initiatives which provide fair market access for goods and services. Africa appears to be lagging behind the abovementioned regions. The current technical regulatory system in Africa is still too inefficient and ineffective to position African countries competitively. The technical institutions are underdeveloped and under funded and can not support market assess and thus economic development. It is in this context that this study is conducted to explore the technical regulatory framework in Africa against the background of reforms in Asia and Europe with a view of providing public policy recommendations for the establishment of an African technical regulatory system supported by appropriate institutional capacity that may expedite economic recovery for the continent. / Thesis (PhD)--University of Pretoria, 2010. / School of Public Management and Administration (SPMA) / Unrestricted

Effective Practices to Facilitate Rural Reentry: A Policy Analysis

The United States is home to a large percentage of incarcerated individuals, a majority of whom re-offend upon release. Reentry efforts focus on lowering recidivism through policy and programming to help returning citizens successfully reintegrate into society and become productive, law abiding citizens. Although research on reentry has increased, the primary focus has been on urban reentry programming. Thus, the unique challenges that plague rural reentry, such as rural employment, housing, treatment and healthcare, transportation, and cultural qualities have been largely neglected. The current policy analysis used the rational model of policy analysis in which information on existing policy and programming was gathered via an extensive literature and policy review, then thoroughly described; problems within these current practices related to rural reentry were identified; and alternative strategies to amend policy to aid rural reentry were reported or recommended. Per the current analysis, most policies and programs are designed for, and examined in, urban communities. While there were several domains in which existing policy was, in fact, beneficial to rural returning citizens, all domains demonstrated need for improvement. A major limitation for the current analysis was the lack of research in rural communities. Future directions include examining reentry policy through the lens of specific offense-types for rural offenders, studying the effect of privatized prisons on U.S. rural reentry, and exploring reentry efforts in other countries as a model for change in the U.S. correctional system.

Prescription Drug Monitoring Programs: A Policy Review and Recommendations for States

OBJECTIVE: To review existing PDMP statutes, and to provide recommendations for good legislative drafting that will create effective statutory components that will enhance the function and increase the use of PDMPs. METHODS: This policy review was conducted from July 2014 to December 2014, using articles dated January 01, 2004 to July 01, 2014. All PubMed searches were artificially limited to peer reviewed articles that were available as “free full text.” To ensure a comprehensive review of the policies, statutes from all fifty states were surveyed using the legal database, Westlaw Next. The search used terms associated with PDMPs. Each statute was reviewed by title and content to determine applicability to the study. The list of statutes compiled from Westlaw Next was compared with existing publications that survey PDMP statutes. The recommendations are based on the investigator’s experience and training in law and public health in consultation with a legislative expert, and supported by peer reviewed articles and legislative drafting guides. RESULTS: There are twelve main topical components that are addressed in existing state PDMP statutes. The policy brief’s primary three recommendations are to implement an advisory committee with an outlined membership, impose a duty for the committee to routinely review database information and to report on the findings, mandate practitioners to consult the database prior to administering controlled substances, and enact a PDMP educational component for practitioners. Appendix A of this policy review (attached) provides a full list of the recommendations for effective legislation on all twelve topical components.

Honouring the stories of student-survivors: trauma informed practice in post-secondary sexualized violence policy review

Rape culture permeates the landscape of post-secondary education throughout Canada. In recent years, student-survivors and advocates have been influential in the creation of provincial legislation mandating colleges and universities to develop stand-alone sexualized violence policies. In British Columbia these policies are to be institutionally reviewed every three years, but there is no clear legislative direction as to how these reviews should be conducted, or how survivors and advocates voices will be included. My thesis examines the impacts of campus sexualized violence and the integral role that student-survivors and their stories play in transforming rape culture. Through the voices of nine University of Victoria student-survivors and five community-based service providers, I demonstrate that student-survivors and those who support them act as both change-agents and subject matter-experts regarding campus rape culture; as such, their inclusion in policy development and review is essential. However, my thesis also demonstrates that student-survivors and advocates navigate an increasingly corporatized post-secondary environment, whereby the stories of student-survivors are considered dangerous to the campus brand and reputation. In taking seriously the trauma associated with sexualized violence and the consequences of the corporate campus, my thesis offers a Trauma Informed Consultation Guideline. This guideline provides a trauma-informed and community based approach to consulting student-survivors in policy review with the intention of creating safer opportunities for story to inform future policy directions. / Graduate

Anaerobic digestion technologies have been utilized in Vietnam for more than 30 years with thousands of domestic small scale plants, mostly for agricultural and livestock wastes. For municipal solid waste (MSW) the development of biogas plants is far below the current high waste generation rates. The aim of this paper is to present the results of a feasibility assessment of implementing AD to treat the organic fraction of municipal solid waste (OFMSW) in Vietnam. For this purpose, an environmental analysis was performed comparing three treatment scenarios: two hypothetical AD technologies (a wet and a dry fermentation system) and the existing industrial composting facility at Nam Binh Duong Waste Treatment Complex in South Vietnam. This study sought for the technology to recover the most possible resources and energy from the OFMSW, and reduce greenhouse gas (GHG) emissions. The results were then combined with a policy review to support a holistic approach on the feasibility of these technologies in Vietnam. The outcome indicates that by implementing the dry AD system, up to 16.7 GWh of power and 14.4 GWh of heat energy can be generated annually and it can potentially save up to 5,400 Mg of CO2 equivalent per year, presenting the highest resource/energy benefits. The performance of the wet system and composting facility present some advantages particularly if there is a previous segregation of the organic material from the rest of the household wastes. Moreover, current reforms in Vietnam demonstrate the government’s interest in AD technologies, translated into the development of fiscal and financial revenues which incentivize participation from the public and private sector. Finally, these technologies are constantly under development and have the potential to be further improved, which gives hopes that waste treatment systems can be optimized to meet the waste and energy challenges of the future generations. / Phương pháp lên men kị khí đã được áp dụng tại Việt Nam từ hơn 30 năm nay với hàng nghìn các công trình nhỏ chủ yếu xử lý chất thải nông nghiệp và chăn nuôi. Sự phát triển hiện nay của các nhà máy sinh khí biogas còn quá ít cho xử lý lượng phát thải cao rác thải đô thị. Bài báo này trình bày các kết quả việc đánh giá tính khả thi khi áp dụng công nghệ lên men kị khí xử lý phần hữu cơ của chất thải rắn đô thị tại Việt Nam. Với mục đích này, phân tích môi trường được thực hiện để so sánh ba kịch bản xử lý: hai công nghệ lên men kị khí giả định (một cho công nghệ lên men ướt và một cho công nghệ lên men khô) và nhà máy hiện hữu lên men hiếu khí làm phân bón compost tại khu liên hợp xử lý chất thải Nam Bình Dương ở miền Nam Việt Nam. Nghiên cứu này tìm kiếm giải pháp công nghệ để thu hồi nhiều nhất có thể các tài nguyên và năng lượng từ rác thải đô thị và và giảm phát thải khí nhà kính. The media, public opinion and British foreign policy

Are foreign policy officials responsive to policy preferences of the mass media and the public in making their decisions? That question has dogged scholars for decades but there has been little agreement among them on what is the true nature of mass media- and public opinion-foreign policy link. In terms of mass media impact, there are two media theories which dominate the debate. First, the CNN Effect theory claims that, by their nature, the mass media have the power to compel policy officials to adopt their policy preferences. Second, the Manufacturing Consent theory counters with the claim that foreign policy is too serious a matter for officials to yield to mass media demands. Scholars are similarly divided on the impact of public opinion on foreign policy. Lacking in almost all the known studies is an appreciation that foreign policy emerges out of a process involving policy stages. These policy stages have different characteristics. In addition to the nature of those stages in themselves, relationships between policy actors - including the mass media, the public and officials - are different in those stages. Officials tend to react differently at each stage of policy when pressured by the mass media and public opinion. Therefore, in this study, I propose that we will have a better understanding of mass media and public opinion influence on foreign policy officials if we study official responsiveness or sensitivity at the stages of the foreign policy process - policy initiation, policy implementation and policy review. I further argue that official responsiveness to mass media and public opinion depends largely on the stage of policy. For this research, I carried out a case study of Britain's war with Iraq in 2003 to test my theory. Principally, I tried to answer the question: Does foreign policy officials' responsiveness to mass media and public opinion depend on the stage of policy? I found that official response to the mass media and public opinion was not as precise as suggested by the dominant camps in the debate. More importantly, Official response to mass media and public opinion varied in the stages of policy. Specifically, I found that British officials were most responsive to mass media and public opinion at the policy initiation stage, very unresponsive at the implementation stage and even more unresponsive at the policy review stage. As a result of the variations in official responsiveness at the stages, I argue that there is a need to re-evaluate the way we study mass media- and public opinion-foreign policy link. To better understand the impact of the mass media and public opinion on foreign policy, I conclude that we need to examine how policy actors interact at different stages of the foreign policy process.

Mechanismus přezkoumávání obchodní politiky: osvětlení nedodržování závazků? / The Trade Policy Review Mechanism: Shedding light on non-compliance?

This thesis examines the notion of monitoring mechanisms and their ability to identify non-compliance. The Trade Policy Review Mechanism (TPRM) of the World Trade Organization constitutes the main focus of analysis. The purpose of the thesis is to improve the current empirical account of the functioning of the mechanism, and to examine the extent to which the mechanism is able to detect rule violations before they are taken up to the court, as well as factors affecting this ability. From theoretical standpoint, the thesis draws mainly upon rational institutionalism and other approaches related to notions of transparency and compliance. In particular, the thesis focuses on the concept of the so called information systems in international regimes. As regards methodology, the thesis relies on the method of content analysis the purpose of which is to procure empirical evidence of occurrence of matters related to non-compliance in trade policy reviews. Thus procured empirical evidence is then subjected to statistical analysis, including logistic regression. The thesis finds that TPRM covers surprisingly large number of matters that later become subjects of judicially confirmed rule-violations at the WTO. Public certificate management : An analysis of policies and practices used by CAs / Offentlig certifikathantering : En analys av policys och praxis som används av CAs

Certificate Authorities (CAs) carry a huge responsibility in today's internet security landscape as they issue certificates that establish secure end-to-end connections. This thesis conducts a policy review and survey of CAs' Certificate Policies and Certificate Practice Statements to find similarities and differences that could lead to possible vulnerabilities. Based on this, the thesis then presents a taxonomy-based analysis as well as comparisons of the top CAs to the Baseline Requirements. The main areas of the policies that were focused on are the issuance, revocation and expiration practices of the top 30 CAs as determined by the use of Tranco's list. We also determine the top CA groups, meaning the CAs whose policies are being used by the most other CAs as well as including a top 100 CAs list. The study suggests that the most popular CAs hold such a position because of two main reasons: they are easy to acquire and/or because they are connected to several other CAs.  The results suggest that some of the biggest vulnerabilities in the policies are what the CAs do not mention in any section as it puts the CA at risk for vulnerabilities. The results also suggest that the most dangerous attacks are social engineering attacks, as some of the stipulations for issuance and revocations make it possible to pretend to be the entity of subscribes to the certificate rather than a malicious one.
