Fundamentos y límites de la analogía in bonam partem en el derecho penal

Una adecuada interpretación del principio de legalidad ofrece buenas razones para admitir la analogía in bonam partem en el Derecho penal aunque de un modo limitado. Incluso cuando el juez mediante ésta excluye o limita el ejercicio del ius puniendi, el aplicador del Derecho penal debe seguir apegado a la ley. De este modo, la analogía in bonam partem debe ser vista como un mecanismo excepcional de integración del Derecho penal frente a inconsistencias axiológicas no previstas ni deseadas por el legislador. Estas excepcionales facultades creadoras reconocidas al juez tienen lugar frente a concretas instituciones jurídico-penales y dentro de un determinado marco argumentativo. En este sentido, la analogía in bonam partem es un medio para crear supralegalmente causas de justificación, causas de exculpación y atenuantes, mientras que no para crear excusas absolutorias. Igualmente, el juez puede crear Derecho solamente a partir de la analogía legis o la analogía institutionis, sin resultar posible acudir a la analogía iuris. / An adequate interpretation of the legality principle offers sound reasons to accept analogy in bonam partem in Criminal Law, though only in a limited way. Even when the judge excludes or limits the ius puniendi through the use of analogy, she should still be strictly subjected to the norm. Therefore the analogy in bonam partem must be seen as an exceptional mechanism of Criminal Law's Integration in the presence of axiological inconsistencies that the Parliament didn't foresee and didn't want. These exceptional law-making powers awarded to the judge refer to specific Criminal law institutions and in a specific argumentative framework. In this sense, analogy in bonam partem is an instrument to supra-legally create justifications, excuses, and mitigating circumstances, but not other types of punishment excluding institutions. In the same manner, the judge can create new Criminal Law only through legis Analogy and institutionis Analogy but not through iuris Analogy.

My dissertation deals with the contribution of practical activities as scope for the factors developing creativity of primary school pupils. Firstly, the definitions of the terms creativity, technical education and project teaching, based on specialised literature, are introduced. These three theoretical spheres focus in detail on the creative process and product, creative factors, convergent and divergent thinking skills, the creative person and the methods that help develop his or her creativity. I try to clarify the technique as a means of development of practical activities. After that I deal with the educational area "Man and the World of Work" and present possible topics for the development of creativity in working education. My thesis demonstrates a project together with its types and focuses on the implementation and benefits of project-based learning. The practical part is focused on the development of individual projects. Fifteen individual projects, helping to develop creativity of pupils at primary schools, were offered to twenty-one teachers. These teachers participated in a questionnaire survey and they were given an opportunity to provide feedback on the above mentioned individual projects. The results of the survey are described in the sixth chapter of this thesis.

Ke každému ročníku je vytvořen výběr písní, které se týkají problematiky intonační výchovy příslušného ročníku. Pod notovou osnovou písně je uvedeno, kde se nachází první stupeň dané tóniny, podle které se žáci mohou orientovat, a text písně, který je psán drobným písmem, aby žákům nenapověděl, která píseň k této melodii patří, a který slouží jako případná pomůcka pro učitele.

Real impossible worlds : the bounds of possibility

Lewisian Genuine Realism (GR) about possible worlds is often deemed unable to accommodate impossible worlds and reap the benefits that these bestow to rival theories. This thesis explores two alternative extensions of GR into the terrain of impossible worlds. It is divided in six chapters. Chapter I outlines Lewis’ theory, the motivations for impossible worlds, and the central problem that such worlds present for GR: How can GR even understand the notion of an impossible world, given Lewis’ reductive theoretical framework? Since the desideratum is to incorporate impossible worlds into GR without compromising Lewis’ reductive analysis of modality, Chapter II defends that analysis against (old and new) objections. The rest of the thesis is devoted to incorporating impossible worlds into GR. Chapter III explores GR-friendly impossible worlds in the form of set-theoretic constructions out of genuine possibilia. Then, Chapters IV-VI venture into concrete impossible worlds. Chapter IV addresses Lewis’ objection against such worlds, to the effect that contradictions true at impossible worlds amount to true contradictions tout court. I argue that even if so, the relevant contradictions are only ever about the non-actual, and that Lewis’ argument relies on a premise that cannot be nonquestion- beggingly upheld in the face of genuine impossible worlds in any case. Chapter V proposes that Lewis’ reductive analysis can be preserved, even in the face of genuine impossibilia, if we differentiate the impossible from the possible by means of accessibility relations, understood non-modally in terms of similarity. Finally, Chapter VI counters objections to the effect that there are certain impossibilities, formulated in Lewis’ theoretical language, which genuine impossibilia should, but cannot, represent. I conclude that Genuine Realism is still very much in the running when the discussion turns to impossible worlds.

Distributed Support Vector Machine With Graphics Processing Units

Training a Support Vector Machine (SVM) requires the solution of a very large quadratic programming (QP) optimization problem. Sequential Minimal Optimization (SMO) is a decomposition-based algorithm which breaks this large QP problem into a series of smallest possible QP problems. However, it still costs O(n2) computation time. In our SVM implementation, we can do training with huge data sets in a distributed manner (by breaking the dataset into chunks, then using Message Passing Interface (MPI) to distribute each chunk to a different machine and processing SVM training within each chunk). In addition, we moved the kernel calculation part in SVM classification to a graphics processing unit (GPU) which has zero scheduling overhead to create concurrent threads. In this thesis, we will take advantage of this GPU architecture to improve the classification performance of SVM.

This diploma thesis deals with behavioural problems of pupils in a school setting, particularly with aggression and bullying, as well as the possibility of their prevention. It consists of a theoretical part, a practical part, and appendices. The theoretical part treats behavioural problems in pupils, presenting the separate disorders in all their possible forms, accounting for both internal and external factors triggering them, explaining their causes and the conditions under which they occur, and, finally, surveys the possibility of their prevention and treatment. The practical part uses a questionnaire designed by the author of the thesis and discussions conducted in schools to identify the most common types of behavioural disorders. The results of the research are presented in charts and graphs and are complemented by data obtained in the discussions. This part is concluded with a thorough analysis of the data. The appendices contain real-life examples of behavioural problems encountered by teachers, the minimum prevention programme implemented by the basic school in Jistebnice and its evaluation for the school year of 2008/2009, the crisis management scheme of the same school, and additional materials relating to the topic.

Reconocimiento de gestos corporales, utilizando procesamiento digital de imágenes para activar sistema de alarma

La investigación realizada a los sistemas de seguridad electrónica de edificios, plantea como objetivo principal el reconocimiento de tres gestos de un lenguaje corporal del personal de vigilancia, y la consecuente activación de alarma en forma automática. Inicialmente se realizó una encuesta dirigida a las administraciones y personal de edificios, para saber cuales eran las ocurrencias que vulneraban la seguridad de un edificio multifamiliar, luego se observaron y analizaron las imágenes capturadas por una cámara de vigilancia ubicada en la recepción, identificando las ocurrencias más vulnerables y gestos asociados a dichos eventos; se seleccionaron tres gestos que en forma inconsciente realizaba el personal de vigilancia ante dichas situaciones. A determinados cuadros que comprenden estas imágenes se le aplicaron técnicas de procesamiento espacial, con ayuda de una iluminación artificial que era más intensa en la parte posterior del sujeto de análisis, consiguiéndose la definición de una silueta binarizada en el entorno Matlab, técnicas como selección del plano rojo, plano de bits más significativo, invertir imagen y transformaciones morfológicas tipo cerradura, definieron una silueta que ayudó a desarrollar un algoritmo matemático para generar una señal eléctrica en el puerto serial USB del ordenador, donde se conectó físicamente una plataforma de hardware Arduino que activa la alarma. La elección de esta plataforma se debió a que Matlab cuenta con un grupo de instrucciones para Arduino, con el objetivo de lograr una comunicación sincronizada entre ordenador e interface. Las técnicas utilizadas reconocieron 62,5% de los eventos descritos en las encuestas realizadas y que no son mencionadas en temas de investigación similar. Para lograr el objetivo fue necesario analizar un cuadro por segundo. The research poses as their main objective the three gestures recognition of a body language of surveillance personnel and the consequent activation of alarm automatically. It was initially carried out a survey of the administration and the offices of the buildings to know which were the occurrences that violate the security of a multi-family building, then were observed and analyzed images captured by a surveillance camera located in the reception, identifying the most vulnerable occurrences and gestures associated with these events; were selected three gestures that unconsciously performs surveillance personnel before such situations; to certain pictures that comprise these images were applied spatial processing techniques, with the help of an artificial lighting that was more intense in the back of the subject of analysis, getting the definition of a silhouette binarized in the Matlab environment, techniques such as plane selection red, more significant bit plane, to invest an image and convolution close type, defined a silhouette that allowed to develop a mathematical algorithm that generated an electrical signal in USB serial port of the computer, where it is physically connected a hardware platform Arduino that active the alarm.This platform choice is due to the fact that Matlab has a group of instructions for Arduino, achieving an orderly communication between computer and interface. The techniques used recognized 62.5 % of the events described in the surveys carried out and which aren’t mentioned in similar research topics. To achieve the objective was necessary to analyze a picture per second.
