determining factors to respect the principle of the human dignity. The goal is initially to show
the devaluation of work from antiquity to the early twentieth century, when the constitutions
began to standardize protective devices. This way, the consecration of the social labor rights
in the Constitution of 1988 represents the culmination of the historical achievements. This
work demonstrates that such rights can not be reduced or suppressed by political
conveniences, once these rights are included in the list of immutable clauses. It is displayed
that to achieve the fundamental right to work is not well advised to encourage the creation of
jobs that maculates the worker s dignity. The outsourced work is, therefore, a classic example
of the advancement of precarious forms of contemporary labor. It is inferred that the presence
of various forms of harassment results in a degradation of working environment, bringing
about dire consequences on professional and personal life of the worker. Thus, decent work
must be the appropriate benchmark for the creation of new jobs. It is also shown that the
flexibilization of the propaganda rights by certain pressure groups has as main goal to reduce
or eliminate rights, based on fallacious data depicting an increase of competitiveness and jobs.
In addition, the flexibility implies a growth of the precarization of the work - a reality felt by
many workers subjected to such a situation due to the unemployment phenomenon whose
origin is not in the protectionism of the norms. It is necessary to expand and structure the
constitutionally legitimate institutions to monitor and curb the precarized work, as well as all
practices that go against the dignity of the worker. It is also shown the loss of power of the
sindicates in the last few years as a consequence of the pulverization workes and the capital
attacks through the productive restructure whose outsourcings and privatizations are notorious
examples / Este trabalho tem por objetivo mostrar que a prote??o da rela??o de emprego ? um dos fatores
determinantes para o respeito ao princ?pio da dignidade da pessoa humana. Busca-se,
inicialmente, mostrar a desvaloriza??o do trabalho desde a antig?idade at? o in?cio do s?culo
XX, quando as constitui??es come?aram a normatizar dispositivos protetores. Desse modo, a
consagra??o dos direitos sociais trabalhistas na Constitui??o de 1988 representa o ?pice das
conquistas hist?ricas. O trabalho demonstra que tais direitos n?o podem ser reduzidos ou
suprimidos por conveni?ncias pol?ticas, haja vista a inser??o destes no rol de cl?usulas
p?treas. Demonstra-se que para a concretiza??o do direito fundamental ao trabalho n?o ? de
bom alvitre o est?mulo a cria??o de empregos que maculem o trabalhador em sua dignidade.
Nesse sentido, o trabalho terceirizado ? um exemplo cl?ssico do avan?o de formas
precarizadas de labor contempor?neo. Infere-se que a presen?a das diversas formas de ass?dio
resulta numa degrada??o do meio ambiente de trabalho, trazendo conseq??ncias nefastas na
vida profissional e pessoal do obreiro. Destarte, o trabalho decente deve ser a refer?ncia
adequada para a cria??o de novos postos de trabalho. Mostra-se ainda que a flexibiliza??o de
direitos propagada por determinados grupos de press?o, tem como objetivo central reduzir ou
eliminar direitos, com base em dados falaciosos de aumento de competitividade e de postos de
trabalho. Outrosssim, a flexibiliza??o implica num incremento da precariza??o do trabalho,
realidade sentida por muitos trabalhadores submetidos a tal situa??o em virtude do fen?meno
do desemprego cuja origem n?o est? no protecionismo das normas. ? necess?rio ampliar e
estruturar as institui??es constitucionalmente legitimadas a fiscalizar e coibir o trabalho
precarizado, assim como todas as pr?ticas que atentem contra a dignidade do trabalhador.
Demonstra-se, tamb?m, a perda do poder da a??o sindical nos ?ltimos anos, resultado da
pulveriza??o dos trabalhadores e das ofensivas do capital atrav?s da reestrutura??o produtiva
cujas terceiriza??es e privatiza??es constituem exemplos not?rios

The central research question is to what extent this flexibility of labor relations incorporates items claimed by ?recent? Decent Work Agenda of the International Labour Organization (OIT) or, on the contrary, the ?epidemic? of outsourcing makes it even more challenging the world of work in the third millennium. The research hypothesis is that the Bank of Brazil has a growing subcontracting / outsourcing of labor (companies and individuals) and that not only contributes to the deterioration of working conditions, but also opposes the Work Agenda decent. Aiming to prove or disprove the hypothesis, the study includes a survey and secondary field. The literature review focuses on the trend towards casualization of labor in capitalism, and yet, in an effort to systematize data and analysis on ?outsourcing? from the viewpoint of different actors. This theoretical framework is anchored in important classical sources and present that address the topic in the world and in Brazil. The field research was conducted with the actors related to the theme of ?outsourcing? the Bank of Brazil - Paraiba, precisely branch managers, permanent employees of the bank, union representatives (bank workers), union bank and outsourced. The results confirm, in part, the study hypothesis, by demonstrating that there are several meanings and forms of precariousness that the contractors surveyed are submitted, highlighting the issue of salaries, the work environment, union representation and health worker. All these themes, each for himself, are contemplated by the Decent Work Agenda of the ILO and show, according to field research, rather fragile / Esta Disserta??o analisa a terceiriza??o em ag?ncias do Banco do Brasil S.A., no Estado da Para?ba. A quest?o central da pesquisa ? saber em que medida esta flexibiliza??o das rela??es de trabalho incorpora itens reivindicados pela recente Agenda do Trabalho Decente da Organiza??o Internacional do Trabalho (OIT) ou se, ao contr?rio, a epidemia de terceiriza??o torna ainda mais desafiante o mundo do trabalho no terceiro mil?nio. A hip?tese da pesquisa ? que o Banco do Brasil apresenta uma crescente subcontrata??o/terceiriza??o de m?o-de-obra (de empresas e de indiv?duos) e isto n?o apenas contribui para a precariza??o das condi??es de trabalho, mas tamb?m se contrap?e ? Agenda do Trabalho Decente. Visando comprovar ou n?o a hip?tese, o estudo contempla uma pesquisa secund?ria e de campo. A revis?o bibliogr?fica centra-se na tend?ncia ? precariza??o do trabalho no capitalismo, e ainda, num esfor?o de sistematiza??o de dados e an?lises sobre o tema terceiriza??o a partir da vis?o de diferentes autores. Esta fundamenta??o te?rica est? ancorada em importantes fontes cl?ssicas e em atuais que tratam o tema no mundo e no Brasil. A pesquisa de campo foi realizada junto a atores relacionados ao tema terceiriza??o no Banco do Brasil - Para?ba, precisamente os gerentes das ag?ncias, funcion?rios efetivos do banco, representantes sindicais (dos trabalhadores banc?rios), sindicato dos banc?rios e os terceirizados. Os resultados confirmam, parcialmente, a hip?tese do estudo, ao demonstrar que s?o diversos os sentidos e as formas de precariza??o a que os terceirizados pesquisados est?o submetidos, com destaque para a quest?o salarial, o ambiente de trabalho, a representa??o sindical e a sa?de do trabalhador. Purposes to apprehend the results of the actions of the professional education in a basic level, offered by the National Plan of the worker qualification ( PLANFOR ), as well as the effects on the assisted exits, starting from the experience appreciated on the Plan of Qualification developed in the state of Maranh?o between 1996 to 2000. It adopts a theoretical-methodological conception by an ontological nature, if being worth of categories as the one of totality and of mediation that together, makes possible the apprehension of a dialectical movement that happens among the analysis object, the professional education politics in a basic level, performed by PLANFOR and your context, the underdevelop and heterogeneous Brazilian capitalism and the consequent job market generalized precarious and informal, making possible that the reality investigated become to understood rationally. This paper uses the indirect documentation technique, instruments of the bibliographical research and documental research. This study is based on those that aren?t part of PLANFOR, qualified by professional education courses in basic level,they didn't get to be inserts at the formal job market, just occupying precarious occupations in the informal job market. Aims to presents and discusses the productive process and your restructuring globally in progress. It focuses at the impacts on the workers, the precariousness of the work that appears like a new phenomenon calls new informality. Talks about the particularity process of productive restructuring assumed in Brazil highlights, showing that the informality, was always a structural phenomenon in the country. Previous issue date: 2016-02-29 / The purpose of this research was to analyze the experiences of workers enrolled in the
health systems of Colombia and Brazil, taking into account the interesting fact that these two health systems emerged from opposing guidelines. On one hand, among the countries which suffered the intense economic crisis of the 1980?s, Colombia was unified in the most rigorous and systematic model because of hegemonic sanitary controls required by the World Bank and the International Monetary Fund On the other hand, in Brazil, which also experienced the economic crisis, it was possible the creation of the Unified Health System (SUS ? Portuguese acronym), as a product of demands of popular movements, managing to establish health as a right of all citizens, which was written into the Federal Constitution of 1988. Thus, the SUS was born in the midst of the economic crisis of 1980, in a neoliberal scenario, in opposition to capitalist tendencies which were characterized by the search for new markets in the health sector, a tendency completely adopted by Colombia. Given this context, the present study aimed to understand the common experiences of basic care workers in Colombia and Brazil, against the capitalist logic. Based on the Social Psychology of Work?s approach, this research is qualitative in nature and has empirical style. It was developed by analyzing reflexive interviews of two groups of workers belonging to healthcare and administrative sectors of the Basic Attention: one in Bucaramanga, Colombia and the other in Campinas, Brazil. Content Analysis was used for the analysis process, which is understood as a set of research techniques, which aims to find sense or senses manifested in more diverse forms of communication. In the course of this investigation it was revealed that, in both countries, the main experiences of the health professionals, determined by neo-liberal logic, are related to the transformations introduced in the labor conditions and relations, and also in the organization of work. In the Colombian context, we find that the main problems presented by those interviewed have their origins in the transition process introduced by those reforms which gave rise to its current health care system. Such problems are reflected, mainly, in the deterioration of relations with patients, as well as, in the detriment of the configuration of the work teams, forced to live divided by the stark contrast between different contractual relations. This condition, which eventually causes an inherent difficulty to generate cohesion within the working groups, also appears in the Brazilian context, as a result of outsourcing, which has come to constitute an effective mechanism to weaken the SUS, to facilitate its waning and to place it on a path pointing in the direction of the current Colombian health system. Finally, in the two studied stages, this panorama of job insecurity, permeated by instability, intensification of responsibilities and overworked employees, reduction in wages, among others, has generated major consequences to the life and health of the workers, which
are reflected in the deterioration of their mental and physical health, in the lack of social
recognition, the deterioration of ethics and morality, also in some cases, even in constraints for the construction of a life project. / A presente pesquisa visa a analisar as viv?ncias de trabalhadores dos Sistemas P?blicos de Sa?de da Col?mbia e do Brasil, tendo-se em vista que esses dois casos ganham interesse de estudo por exemplificarem sistemas de sa?de cujo surgimento se d? a partir de diretrizes opostas. Por um lado, tem-se a Col?mbia que, dentre os pa?ses latino-americanos a sofrer a intensa crise econ?mica da d?cada de 1980, foi aquele que incorporou de maneira mais rigorosa e sistem?tica os crit?rios centrais do modelo hegem?nico das reformas sanit?rias estabelecidos pelo Banco Mundial e pelo Fundo Monet?rio Internacional. Por outro, observa-se a situa??o do Brasil, que tamb?m experimentou a crise econ?mica, onde foi poss?vel a cria??o do Sistema ?nico de Sa?de (SUS), produto das exig?ncias dos movimentos populares os quais conseguiram estabelecer a sa?de como um direito de todos os cidad?os, legitimando-se na Constitui??o Federal de 1988. Toma-se em considera??o, ent?o, como nasce o SUS, num cen?rio neoliberal em meio da crise econ?mica de 1980, em oposi??o a tend?ncias imperialistas que se caracterizavam pela busca de novos mercados no setor sa?de, enquanto a Col?mbia se subjugou totalmente a elas. Levando em conta esse contexto, o estudo aqui apresentado teve como objetivo compreender as viv?ncias de trabalhadores da Aten??o B?sica dos Sistemas P?blicos de Sa?de da Col?mbia e do Brasil, frente ? l?gica capitalista. Baseada no enfoque da Psicologia Social do Trabalho, esta pesquisa ? de natureza qualitativa e de tipo emp?rico. Desenvolveu-se mediante a realiza??o de entrevistas reflexivas em profundidade, com dois grupos de trabalhadores da Aten??o B?sica de n?vel assistencial e
administrativo: um em Bucaramanga, Col?mbia e, outro, em Campinas, Brasil. Para o processo de an?lise, elegeu-se utilizar a An?lise de Conte?do, a qual ? compreendida como um conjunto de t?cnicas de pesquisa cujo objetivo ? a busca do sentido ou dos sentidos manifestos nas mais diversas formas de comunica??o.
O percurso desta pesquisa revelou que, em ambos os pa?ses, as principais viv?ncias dos profissionais da sa?de, determinadas pela l?gica neoliberal, est?o relacionadas com as transforma??es introduzidas nas condi??es, rela??es e organiza??o do trabalho. No contexto colombiano estudado, identificamos a origem das problem?ticas centrais apresentadas pelos entrevistados no processo de transi??o induzido pela reforma que constituiu seu atual sistema de sa?de. Essas problem?ticas se traduzem, essencialmente, na deteriora??o das rela??es com os usu?rios, bem como na configura??o das equipes de trabalho, marcadas pelo contraste entre pessoas com diferentes v?nculos empregat?cios. Esta ?ltima condi??o, empecilho para a coes?o dos grupos de trabalho, tamb?m ? observada no contexto brasileiro pesquisado, como produto da terceiriza??o, que parece ter se tornado um efetivo mecanismo para enfraquecer o SUS, facilitar seu desmonte e coloc?-lo no mesmo caminho atualmente percorrido pelo sistema de sa?de colombiano. Por fim, exp?e-se como, nos dois cen?rios estudados, tal panorama de precariedade do trabalho, permeado
pela instabilidade, intensifica??o e sobrecarga laboral, pela redu??o de sal?rios, dentre outros fatores, tem ocasionado graves consequ?ncias para a vida e a sa?de dos trabalhadores, que se refletem na degrada??o de sua sa?de f?sica e mental, na falta de reconhecimento social, na deteriora??o da ?tica e da moral e nas restri??es para a constru??o de um projeto de vida.
