The thesis is focused on the legal regulation of protection of personality rights. This topic is up to date not only because of the media exposure, but also with regard to the recodification of private law. The focus of this thesis lies on Act no. 89/2012 Coll., Civil Code, which is compared to the antecedent legal regulation. The personality protection belongs to fundamental human rights therefore the thesis includes the constitutional overlap and interpretation of international agreements. The work is divided into six chapters. The first chapter deals with the development of personal rights from a historical perspective. There is also mentioned legislation of Czechoslovakia and the Czech Republic. The second chapter deals with the interpretation of the concept of personality, the theoretical concept of general personality right and possibilities of its limitations. Part of this chapter shows a non-exhaustive list of values protected by the general personality right, namely the right to physical and mental integrity, the right to personal liberty, the right to a name, the right to likeness, the right to honor and dignity and right to privacy. The submitted diploma thesis provides an introduction into the topic of conflict of the personality rights of an individual with the freedom of expression of media and right to receive information of others. The emphasis is put on the Czech and European case law. Marginally is mentioned also the topic of new media, especially the latest case law of the European Court of Human Right on this matter. The diploma thesis is divided into introduction, conclusion and three chapters. The first chapter introduces the basic definitions and theoretical basics of the topic. The reader is acquainted with the concept of human personality and its components, with the concept of personality rights and their nature as well as with the possible infringements of these rights. The chapter also provides the definitions of media and new media. The objective of this thesis is to provide an overview of general part of the protection of personality in the Czech legal system, as well as a detailed analysis of selected aspects of personal rights. The thesis focuses on protection provided by the Act Nr. 89/2012 Sb., Civil Code, and the European Convention on Human Rights. Initial chapters of the general part of the thesis deal with brief introduction to the historical background of personality rights in the Czech legal environment, as well as with the definition of personality and personality rights as such, together with a demonstrative list of values protected by the general right of personality. The subsequent chapter provides an overview of Czech and international sources of law concerning personality protection. This thesis deals with the ban on racial discrimination and protection against it in international law and its application in the legal order of the Czech Republic. The aim of this study was to examine the provisions prohibiting racial discrimination and mechanisms of protection against racial discrimination established by various conventions on the international and European level and the status of implementation of these commitments in the legal order of the Czech Republic and their implementation. Ochrana práv dětí v České republice / Protecting children's rights in the Czech Republic

This thesis was initially concerning protecting children's rights. Due to wide variety of this topic, it was neccesary to focuss the thesis more specificly. I decided to explore the field of work with childen from desintegrating families, where there is also a difficult parental conflict. Content is divided into two integrated parts. In the first one, there was build the theoretical bases using variety of sources and authors in three different chapters. First chapter concerned desintegrating of families, its psychological, legal and sociologic contexts and effects. Second chapter reflected the history of defending rights of children and there were also analysed both czech and international documents on protection of children's rights. I also analysed the term "best child's interest" and its impact on practising the law. In the third chapter I described different approaches in work with desintegrating families, including nameless current approach practised in the Czech Republic, the Cohem praxis and others, less known approaches. In the second part, the practical segment of my work was presented. The project of research included interviews with seven professionals. The diploma thesis deals with the issue of respect and protection of human rights in the Russian Federation, with particular emphasis on the European view on this topic. Within the content of the thesis is the presentation and explanation of the difference between the approach of the Russian Federation and the European Union to the protection of human rights based on the application of two different theories of access policy - the theory of commitment and the theory of compliance. The thesis focuses mainly on political and civil rights and freedoms, and submits the main factors behind the Russian approach to the protection of human rights and the current situation of human rights in the Russian Federation. The aim of the thesis is presentation and evaluation of different approaches to the protection of human rights of the Russian Federation and the European Union by applying the theory of commitment and the theory of compliance, and to highlight the main causes that lead to the current human rights situation in the Russian region.

À la lumière du droit international, la présente thèse a pour objet de proposer une voie médiane entre l'exercice des droits de l'État sur les ressources naturelles, découlés du principe de la souveraineté permanente sur les ressources naturelles, et la protection des droits de l'homme de sa population (et notamment des populations locales et des peuples autochtones) affectée directement par l'exploitation de ressources naturelles. Ayant pour but de mettre en question la place actuelle du principe de la souveraineté permanente sur les ressources naturelles et de contribuer à la sauvegarde des droits de l'homme dans ce cadre, il sera proposé une relecture contemporaine du principe de la souveraineté permanente sur les ressources naturelles, consacré en droit international, il y a plus de cinquante ans, par la Résolution de l'Assemblée générale des Nations Unies 1803 (XVII) de 1962. Par le biais de cette relecture contemporaine, i! serait possible d'admettre que le principe de la souveraineté permanente sur les ressources naturelles peut conférer à État des droits relatifs à la jouissance de ressources· naturelles dans son territoire et, simultanément, des obligations relatives aux droits de l'homme dans le cadre de l'utilisation des ressources naturelles. / In the light of international law, this work aims at showing that there is an "intermediate way" between the exercise of State's rights over natural resources, issuing from the principle of State sovereignty over natural resources, and the protection of human rights of the State's population (especially local population or indigenous peoples) directly affected by the exploitation of natural ,esources. In order to question the current scope of the principle of permanent sovereignty over natural resources and to contribute to human rights protection in this context, our aim is to endorse a contemporary interpretation of the principle of permanent sovereignty over natural resources, recognized, more than fifty years ago, by the United Nations General Assembly's Resolution 1803 (XVII) of 1962. By this contemporary interpretation, it would be possible to conceive that the principle of permanent sovereignty over natural resources can confer to the State rights related to the enjoyment of natural resources in its territory and, at the same time, can confer obligations to such State related to the human rights of its population in the context of use of natural resources.

This diploma thesis analyses the status of social rights in the case-law of the European Court of Human Rights. It aims to show, particularly through the analysis of selected court decisions, how the European Court of Human Rights, as a control mechanism established by the Convention for the Protection of Human Rights and Fundamental Freedoms seeking to provide recognised rights and freedoms with practical and effective protection, deals with the absence of social rights in the Convention's catalogue. The thesis is divided into four chapters. The first chapter is dedicated to the brief description of the Convention, its control mechanism and the catalogue of declared fundamental rights and freedoms. In this section the thesis also deals with the question, what were the reasons that lead to the absence of social rights in the Convention's catalogue and what consequences can be draw from this fact for the status of social rights. Le droit des contrats subit depuis quelques années des mutations importantes, au premier rang desquelles figure l’émergence de sources nouvelles, à l’instar des droits fondamentaux issus de la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales (Convention EDH). Leur application classique dans les relations verticales unissant l’État à l’individu a connu un prolongement évident par la reconnaissance de l’effet horizontal du texte en droit interne, impliquant leur respect jusque dans les relations privées.L’interprétation du contrat, consistant à en révéler le sens et les obligations qui en découlent, constitue l’objet de l’étude menée. La lecture de l’acte contractuel doit se faire en conformité avec l’interprétation opérée par le juge européen de la Convention EDH. De ce constat émerge tout l’intérêt de la recherche, consistant à mettre en avant la confrontation évidente pouvant naître entre d’une part le contrat - porteur de principes forts (particulièrement l’autonomie de la volonté, et ses corollaires telles la liberté contractuelle et la force obligatoire du contrat) - et d’autre part le respect des droits fondamentaux. Dans quelles mesures ces derniers peuvent-ils influer sur l’interprétation d’un contrat privé ?Le travail de recherches entrepris révèle un rôle sensible des droits fondamentaux sur l’interprétation du contrat - le respect des droits fondamentaux prime de manière générale la force obligatoire - et constate que cette influence est le fruit d’une démarche complémentaire du juge européen, lequel dicte, et du juge interne, lequel réceptionne les droits fondamentaux dans l’interprétation.Cette étude - bien que certains de ses aspects paraissent encore empiriques - témoigne d’une influence perfectible des droits fondamentaux sur l’interprétation du contrat. En ce sens, des pistes d’améliorations, tant au niveau européen qu’interne, ont pu être envisagées / The law of contracts has known for some years important changes, particularly the emergence of new sources like the fundamental rights of the European Convention on Human Rights. Their classic application in the vertical relations uniting the State to the individual knew an obvious continuation by the recognition of the horizontal effect of the text in internal law, implying their respect to the private relations.The interpretation of the contract, to determine the sense and the obligations which it contains, is the object of this thesis. The reading of the contractual act has to be done in accordance with the interpretation operated by the european judge of the European Convention. The interest of the thesis consists in advancing the evident confrontation which can appear between the contract (the autonomy of the will, the contractual freedom and the binding effect) and the protection of the fundamental rights. To which extent can these last ones influence the interpretation of a private contract?The study reveals the important role of the fundamental rights, and their respect dominate mostly. This influence is the fruit of a complementary approach of the european judge, who dictates, and of the internal judge, who receives the fundamental rights in the interpretation.This study - although some of its aspects seem still empirical - testifies of a perfectible influence of the fundamental rights, and improvements were envisaged at the internal and european level
