This actual theme has been chosen due to the fact that I have worked with social security practice for several years as a public employee, and also together with the studies on material social security. The choice is also justified with the purpose of a reinterpretation or a change in the legislature concerning social security proceeding rules, which are at a perceptible state of retrocession, harnessed into those old precepts, despite having being prepared after the publication of the present Constitution. In short, after some brief considerations regarding the conception about Social Security, Social Welfare, Health and Social Security, as well as the various forms of Social Security benefits, the paper will investigate the applied evidences on the social security proceedings, among which, documentary evidence, testimonial evidence, expert evidence, administrative justification and evidence to prove economical dependency and to prove performed activities under special conditions, all in agreement with jurisprudence and its due procedural legislation. In this context, several problems on the social security procedural legislation will be examined all with its due legal proceedings and with the basic rules based on the Code of Civil Procedure. Finally, some important conclusions obtained during this present study, which confirm the necessity for a change on the jural-social security legal system in such a way that its proceeding rules (clearly expressed or implied) are interpreted and applied in favour of the weakest part on the jural-procedural relation, in casu, the insured / O presente trabalho tem por escopo abordar as provas no processo previdenciário sob uma perspectiva prática e teórica, em consonância com a jurisprudência e com o devido processo legal. A escolha do presente tema se deu em virtude dos vários anos atuando na prática previdenciária exercida como servidor público, em conjunto com o estudo do direito material previdenciário. Justifica-se ainda a escolha com o propósito de uma reinterpretação ou uma mudança legislativa no tocante às normas processuais previdenciárias, as quais se encontram num visível retrocesso, atreladas àqueles velhos cânones, embora elaboradas posteriormente à promulgação da Magna Carta vigente. Em suma, após breves considerações no tocante aos conceitos da Seguridade Social, Assistência Social, Saúde e Previdência Social, adentrar-se-á as provas utilizadas no processo previdenciário, dentre as quais a prova documental, testemunhal, pericial, justificação administrativa, provas para a comprovação de dependência econômica e para a comprovação de atividades exercidas em condições especiais, todas em consonância com a jurisprudência e com o relativo processo legal. Nesse contexto, serão observados os vários descompassos da legislação processual previdenciária com o devido processual legal e com as regras básicas do Código de Processo Civil. Finalmente, apresentar-se-ão as conclusões indispensáveis obtidas durante o estudo, as quais corroboram a necessidade de mudança legislativa no ordenamento jurídico-previdenciário, no sentido de que sejam as normas do processo previdenciário (explícitas ou implícitas) interpretadas e aplicadas em prol da parte mais fraca da relação jurídico-processual, in casu, os segurados
