The subject of the thesis is "The Budgetary Management of Contracting Authorities With Relation To Public Contract Awarding". It attempts to point out some relations between the budgetary law and the law of public procurement on the example of public contract awarding carried out by public contracting authorities. The thesis is composed of six chapters. The first chapter deals with the definition of the budgetary law, it subject matter and its legal sources. The second chapter presents the definition, the subject matter and the legal sources of the law of public contracts. The third chapter follows in which the basic concepts and legal institutions of the budgetary law and the law of public contracts are presented. The fourth chapter describes the main principles by which the budgetary law and the law of public contracts respectively are governed. In the sixth chapter some aspects of the public contract awarding and their impacts on budget management are briefly mentioned. The last chapter shortly discusses the field of a budget management control in connection with the public procurement.

Sekundární cíle při zadávání veřejných zakázek / Secondary objectives in public procurement

The thesis provides a comprehensive analysis of the horizontal policies in public procurement with the aim to determine whether public procurement may be used as a legitimate tool in the pursuit of such policies. Horizontal or secondary policies refer to the policies not inherently connected to the functional objective of public procurement - i.e. to the purchase of goods and services. These may among other strike at social or environmental issues. For this purpose, the descriptive and analytic methodics are used. The case-law of CJEU was the primary source of the thesis along with the relevant literature and both EU and Czech legislation. The thesis is structured into two chapters. The first chapter provides essential introduction to the legislation in place in respect of the horizontal policies in public procurement. The second part of the chapter then analyses relevant case-law of CJEU. Particular attention is paid to the case law in respect of public procurement used as a tool to pursue employment policies. The second chapter named taxonomy of horizontal policies elaborates on the relationship between economic and legal aspect of the public procurement in general. 75 ABSTRACT The goal of my diploma thesis is to complexly analyze the institute of estimated value of a public procurement and issues related to it, while reflecting relevant decisions of the authorities competent to reviewing a public procurement, that is the Court of Justice of the European Union (the European Court of Justice), the Supreme Administrative Court, the Regional Court in Brno and the Office for the Protection of Competition. The relevant case-law is mentioned in the whole text in accordance with scheme of thesis as it is described below. Doctrinal interpretations are also taken into account. Among the most common mistakes made by contracting authorities, who are required to act in accordance with Act no. 137/2006 Coll., is wrongly determined estimated value of a public procurement. In this context it is necessary to point out that the determination is very important especially for the right categorization of contracts according to their values, which affects how strict conditions would apply for the specific contract. The work is conceived as a summary of the decision-making practice. Analýza tržní koncentrace ve vybraných odvětvích veřejných zakázek / Analysis of the market concentration in public procurement markets

This master thesis is focused on the market concentration in six sectors of public procurements in the Czech Republic, and the relationship between level of market concentration, profitability of the companies, final price and number of bids. The analyzed procurements refer to food industry, electricity, postal and telecommunications services, solar energy, IT and automotive sector from period of 2007-2010. Concentration ratio, Herfindahl-Hirschman index and Gini coefficient were used to quantify market concentration. The first four of above mentioned public procurement markets seem to be highly concentrated according to these indicators; the remaining two cases are unconcentrated or moderately concentrated. Correlation analysis was used for each sector. The analyzed variables were: market shares of the companies, their profitability, average number of bids and average proportion of the final and expected price in tenders which the company won. Further, the relationship between market concentration indicators and average variables for the relevant sectors was assessed.

(angl.) The diploma thesis covers placing public orders, which represent a large amount of expenses of the public sector - approximately 14% GDP in the Czech Republic. In detail, it focuses on the area of ICT, which is often mentioned in context with overpriced orders. The goal of the thesis is to analyze processes of placing orders in public sector via comparison and qualitative interviews with adequate respondents. Based on the outcomes of the analysis, there are proposed possible new system solutions. The work also deals with applicability of the Agency theory in this particular area.

Transparentnost veřejných zakázek / Transparency of public procurement

In the theoretical part I tried describe most basic terms of the law of public procurement, because of easier understanding of this topic. In this part I also tried assess the condition of transparency of public procurement in Czech Republic. Then I desribed the basic principles, which relating to standards of transparency of public procurement. These principles were defined by the OECD. I also tried to explatin, how European legislation solves the issue of transparency in public procurement. In the practical part, I focused on several practical examples related to non-transparent public procurement, where are seen various shortcomings in the process of public procurement. In one of the other chapter of thesis is shown a short statistical overview about public procurement in Czech Republic and also overview about public availability of informations related to public procurement in selected OECD countries. In this part I made a short comparison of legal measures in Czech Republic with the principles of transparency of public procurement, which are defined by the OECD. I also tried suggest possible effective solutions to improve the current situation.

Procurement centralization is a process that includes policy decisions on the appropriate level of collaboration, aggregation and standardization. We analyse the main aspects of collaborative procurement: centralization, scope and different market structures. We use a unique dataset that combines Czech tender-level data with the manually-collected data on centrally procured tenders and financial firm-level data for the time span 2008 - 2016. We apply vector generalized linear model to the compulsory centralized procurement sectors and assess the market competition and concentration. We find several key aspects of centralized procurement: the centralization has a significant positive impact on the competition in selected sectors. The framework agreement is recognized as a positive setup of public procurement. We identified a strong negative evidence of the heterogeneity of the procured commodity. The design of centralization process and the degree of centralization is always bound by two elementary questions: the flexibility or unification trade-off and the set-up costs or unit costs trade-off. This thesis deals with the issue of electronic public procurement. The aim of this thesis is to confirm or disprove the following hypotheses. The first hypothesis of this dissertation is the claim that the current legislation constitutes an adequate legal basis for the implementation of electronic public procurement. The second hypothesis states that the electronic public procurement is more efficient and more transparent than the public procurement without electronization. Examining the first hypothesis was chosen in order to determine whether it is necessary to change the law for the possibility of fully electronic public procurement. The second hypothesis, then, in essence asks whether electronization of public procurement improves the efficiency of public procurement and whether it contributes to increase the transparency of public procurement.
