Farahmand, Shiva, Masic, Maria January 2012 (has links)
Discussion about the connection between severe mental disorders and criminal acts is constantly ongoing. Violent crimes committed by persons with severe men-tal disorders get a lot of media attention in today´s society. This arise general questions regarding the penalties that these offenders are sentenced to. It is known that the responsibility for these people lies on the forensic psychiatry, however, the media does not draw attention to what is happening in this organization. The purpose of this study is to describe the forensic psychiatric organization from a staff perspective and from a legal perspective. The intention is to clarify the re-habilitation process in this organization and how this rehabilitation is perceived by the staff. Our research shows that there are several laws that govern the forensic psychiatric organization. Although the laws Lag (1991:1129) om rättspsykiatrisk vård and Lag (1991:1137) om rättspsykiatrisk undersökning are the primary laws that describe the forensic psychiatric care and psychiatric examination, the foren-sic psychiatric care is also based in other laws such as the Hälso – och sjukvårdslagen (1982:763).However, it is through the law Brottsbalken (1962:700) that forensic psychiatry becomes possible for offenders with mental disorders. The forensic psychiatric organization focuses on two factors, care for the patient and society protection, both equally important. The forensic psychiatric health care is based on collaboration between all professions and the professionals always try to meet the patient's rehabilitation needs, but this aim is often in conflict with the compulsory component of the forensic psychiatry. The rehabilitation is also characterized by an approach that is based on empowerment and representation. Furthermore, our research shows that the staff’s care of patients in the forensic psychiatric organization is characterized of humanistic values that direct their work.
