A representatividade como requisito intr?nseco da representa??o processual adequada na tutela coletiva de direitos dos trabalhadores : an?lise sob uma perspectiva sociol?gica do direito

Thus, this thesis aims to suggest criteria for the judicial review of the appropriate procedural representation by the magistrate, on a model of collective procedure for the protection of fundamental rights of working people, considering the various actors involved, their representativeness across the group and the peculiarities of the labor subsystem. The methodology of this qualitative study involved the analysis of concepts, institutes and theories under a sociological perspective of law. Initially were pointed theoretical paradigms to guide the work, followed by the analisys of the institution of collective protection in the english, american, italian and brazilian systems, in order to highlight commonalities and contributions to the adequate procedural representation. In a second moment, this work studied the Brazilian trade union movement in order to understand their part in the conduct of collective movements, whether judicial or extrajudicial, considering the central role of trade unions in collective defense of labor rights, in the light of the contents of the provisions of the article 8, paragraph III of the 1988 Brazilian Constitution. Ultimately it was proposed a collective protection model for labor rights through different categories: the representation by unions in labor court rules; the representation by unions in metaindividual labor jurisdiction; and the representation by an individual group member, whereas in each of the proposals was discussed the need for representativity as a requirement for proper procedural representation. The conclusion of this study is that representativeness does not ensure adequate procedural representation, but qualifies the process and makes possible the representation by the individual member of the group when it comes to protecting the environment of the work, given the existence of constitutional provision for its defense by popular action. / A representa??o processual ? tema que suscita debates quando se estuda a tutela coletiva de direitos, diante da necessidade de que esta se d? da melhor forma poss?vel, a fim de garantir a defesa daqueles que n?o se fazem diretamente presentes no processo. Assim, esta tese de doutorado tem como objetivo sugerir crit?rios para o controle judicial da representa??o processual adequada pelo magistrado, diante de um modelo de processo coletivo para a defesa dos direitos fundamentais dos trabalhadores, considerando os diversos atores envolvidos, sua representatividade frente ao grupo e as peculiaridades pr?prias do subsistema trabalhista. A metodologia deste estudo qualitativo envolveu a an?lise de conceitos, institutos e teorias sob uma perspectiva sociol?gica do direito. Inicialmente foram apontados paradigmas te?ricos norteadores do trabalho para, em seguida, analisarse o instituto da tutela coletiva no sistema ingl?s, estadunidense, italiano e brasileiro, no intuito de destacar pontos em comum e contribui??es para a representa??o processual adequada. Em um segundo momento, estudou-se o movimento sindical brasileiro, a fim de compreender sua atua??o na condu??o de movimentos coletivos, sejam eles judiciais ou extrajudiciais, considerando o papel central dos sindicatos na defesa coletiva de direitos trabalhistas, a teor do estabelecido no artigo 8?, inciso III da Constitui??o Federal de 1988. Por fim, prop?s-se um modelo de tutela coletiva de direitos trabalhistas, atrav?s de diferentes categorias: a representa??o pelos sindicatos na jurisdi??o trabalhista normativa, a representa??o pelos sindicatos na jurisdi??o trabalhista metaindividual e a representa??o pelo indiv?duo membro do grupo e em cada uma delas discutiu-se a necessidade de haver representatividade como requisito de uma representa??o processual adequada. A conclus?o do estudo ? que a representatividade n?o garante uma representa??o processual adequada, mas a qualifica e que al?m da representa??o sindical, ? poss?vel a representa??o pelo indiv?duo membro do grupo em se tratando de prote??o ao meio ambiente do trabalho, diante da exist?ncia de previs?o constitucional para sua defesa por meio de a??o popular.
