Orientador: Elisabete Maniglia / Banca: José Luiz Quadros de Magalhães / Banca: Antonio Alberto Machado / Resumo: Abordou-se a questão agrária, principalmente através da temática da reforma agrária, imbricando-a com a reflexão sobre a democracia, e sobre o Estado democrático de Direito, buscando-se compreender a forma como o Direito atua na configuração destes institutos. Tratou-se dos elementos jurídicos pertinentes à reforma agrária, com a finalidade de se esboçar um panorama crítico das previsões jurídicas centradas, principalmente, na Constituição de 1988 e no Estatuto da Terra. Lado outro, a reflexão dirigiu-se para a democracia contemporânea e suas deficiências, bem como para a necessidade de se ir além do paradigma democrático vigente, e da forma como a democracia se liga visceralmente à reforma agrária no contexto brasileiro, e de como a participação popular dos movimentos sociais rurais é de suma importância para esta aproximação. Por fim, o presente trabalho enfrentou a questão do embate entre dois projetos díspares de reforma agrária, a de Estado e a de Mercado, posicionando-se em favor da necessidade do protagonismo popular e da massiva atuação estatal para a reconfiguração do rural. Refletiu-se, então, sobre o Estado democrático de Direito, e sobre a necessidade de sua abertura à participação popular para que o projeto de reforma seja formatado participativamente, com a decisiva atuação da população envolvida / Abstract: Addressed the land question, primarily through the issue of land reform, imbricando it with reflection on democracy, and the democratic state of law, seeking to understand how the law works in the setting of these institutes. This was the legal elements pertaining to land reform, in order to sketch a critical overview of the legal forecasts centered mainly in the 1988 Constitution and the Land Act. Other hand, the reflection headed for contemporary democracy and its shortcomings as well as the need to go beyond the current democratic paradigm, and how democracy viscerally binds to land reform in the Brazilian context, and how popular participation of rural social movements is critical to this approach. Finally, this study faced the issue of the clash between two disparate projects of agrarian reform, the State and the market, positioning itself in favor of the need for popular protagonism and massive state action for the reconfiguration of rural. Reflected then on the democratic rule of law, and the need for its openness to public participation for the renovation project is formatted participatory, with the decisive actions of the people involved / Mestre
