Although the contracts of lease and leasing have been used for many years by airline companies, increase in traffic volume predicted for the following years will certainly determine a greater need for aircrafts and consequently a greater demand for use of these kind of contracts. / Not only do they offer economic benefits but they are also very important instruments in the hands of an airline for fleet planning. / Operating and financial lessors have a wide market for their costly "toys", but, as the market and profits expand, so does the need for lessors to be at any time able to keep total control of them. In fact, one of the biggest fears for a lessor is to loose his property because he is not able to repossess it after a default of the lessee. / This thesis first briefly overviews the contract of lease and leasing and how the latter, being a contract of common law origin, has been included in the legal systems of two civil law countries like Italy and Quebec. Subsequently, the main clauses of a contract of aircraft lease or leasing are analysed not only to see the duties that a lessee entering into such a contract has, but also to see if these clauses follow the provisions which govern the contract, in general, and the contract of lease and leasing, in particular, in Italy and Quebec. / Chapter II deals with the remedies that, in case of the lessee's default, a lessor has, in Italy and Quebec, in order to repossess his aircraft; whether these remedies can guarantee speedy repossession and whether the remedy of the "self-help repossession", which is a typical common law legal instrument, can be applied in Italy and Quebec. / Finally there is a short analysis of the "Convention on International Interests in Mobile Equipment" which is being drafted by Unidroit and its possible help in solving the problem of quick repossession in the case of a default by the lessee.

Accounting for the Social Element in Access-Based Consumption

This dissertation examines how the inclusion of the social element in access-based consumption can influence affective and behavioral responses. The first essay builds upon the dimensions proposed by Bardhi and Eckhardt, who found that market mediation, anonymity, temporality, consumer involvement, type of accessed object and political consumerism are key dimensions on which to study access-based consumption. A reconceptualization of these dimensions is proposed in the current work to incorporate the social element. Foremost, a separation of renting and sharing based on the presence or absence of economic exchange is proposed. The implications for the remaining dimensions of anonymity, temporality, consumer participation, type of accessed object, political consumerism and governance are then discussed. Finally, key outcome variables of community, cooperation, loneliness and contagion are reviewed. In Essay 2, the guiding theory of social distance is used to empirically test the impact of the social element on evaluations of a rental service on the outcomes of satisfaction, attitude, disgust and community. In the rental context examined, users are interpersonally anonymous indicating that there is no relationship between the current user and other users. In addition, users must engage in extra-role behaviors because no intermediaries are present. In three experiments, it is shown that encounters with other users can lead to increased feelings of disgust and decreased satisfaction and attitude towards the rental service. Having information about other users, provided in the form of avatar images, can enhance feelings of community, as can certain types of communication between users. Given the benefits that emerge from feelings of community, Essay 3 explores factors that can enhance or detract from sense of community. Factors such as apathetic participation and similarity are considered. In addition, positive outcomes that emerge from feelings of community, such as sign-up likelihood and care behaviors, are measured. / 2015-04-17

This thesis contributes to the growing literature on low-income renting and affordable housing in Latin America. Through a case study of Independencia – a consolidated community in Lima’s northern cone – I examine the socio-economic foundations and potential implications of self-help renting in lives of participants. Low-income renting has a long history in Lima, but has largely operated outside of State intervention. While these policy decisions were the result of contextually specific political and economic pressures, they seem also to be a symptom of the changes in influential social and economic theories informing academic thinking on the region and their contributions to bias in the housing policies of many Latin American countries. In addition to several policy considerations based on research in Lima, some general considerations for future renting research are offered. / text
