Faced with a historical perspective of the issue, we leave for a practical analysis: the implementation of the right to health with regard to the supply of medicines by the Judicial Courts, in Brazil and abroad. We intend to draw a comparative study among Brazilian and many foreign jurisprudence, with two main purposes: (i) verify the convergence between the Brazilian system and various international and foreign systems and (ii) with the support of foreign jurisprudence, check what are our shortcomings and discover examples in which we can support to improve our system of protection of the right to health / O objetivo desta dissertação é analisar o direito à saúde, seu surgimento enquanto direito social, sua positivação em nossa Constituição Federal e sua previsão em organismos internacionais. Diante de uma perspectiva histórica do assunto partiremos para uma análise prática: a efetivação do direito à saúde no que toca ao fornecimento de medicamentos pelo Poder Judiciário, brasileiro e estrangeiro. Pretendemos traçar um estudo comparativo entre as jurisprudências brasileira e a estrangeira, com duas finalidades principais: (i) verificar as convergências entre o sistema brasileiro e diversos sistemas internacionais e estrangeiros e (ii) com o apoio da jurisprudência estrangeira, verificar quais são nossas falhas e em quais exemplos podemos nos amparar para melhorar nosso sistema de proteção ao direito à saúde
