Reviewing traditional premises that founded the classic scientific speech of the Law to the light of a new paradigm, that has been established in the Brazilian juridical law, after the promulgation of the Constitution of the Federal Republic of Brazil 1988. Deconstructing the desires such as "truth", "certainty" and "order", and themselves committed with the fetish of "juridical safety", it ingrained to the traditional dogmatic, which institutionalized the vision of a neutral right and without critic, in total mismatch with life itself. Moving away from that modern mechanistic paradigm, based on the created certainty, it intends to focus on the value of juridical safety. It is based on an open, no-linear and chaotic juridical system, that embraces the uncertainty and complexity of the human condition, giving vivacity to the Law through a renewed and committed juridical speech with aim for Justice. Without disrespecting the pattern of previsibility that is no-deterministic and that reveals itself with attractors of the system, they are magnetized in the fundamental rights. / A presente disserta??o, por meio de um estudo transdisciplinar, objetiva um novo olhar sobre o sistema jur?dico e sua ?ntima rela??o com o ideal de seguran?a. Revendo premissas tradicionais que fundaram o discurso cient?fico cl?ssico no Direito ? luz de um novo paradigma, que se instaura no ordenamento jur?dico brasileiro ap?s a promulga??o da Constitui??o da Rep?blica Federal do Brasil de 1988. Desconstruindo os desejos de verdade, certeza e ordem, comprometidos com o fetiche seguran?a jur?dica, intimamente arraigado ? dogm?tica tradicional que institucionalizou a vis?o de um direito neutro e acr?tico, em total descompasso com a realidade vivida. Afastando-se desse paradigma moderno, mecanicista, calcado nessa certeza criada, prop?e-se uma releitura do valor seguran?a jur?dica com base nos vetores axiol?gicos de um sistema jur?dico aberto, n?o-linear e ca?tico, que abarca a incerteza e a complexidade imanentes ? condi??o humana, dando vivacidade ao Direito por meio de um discurso jur?dico renovado e comprometido com o ideal de Justi?a, sem desconsiderar o padr?o de previsibilidade, n?o-determin?stico, que se revela com os atratores dos sistema, imantados nos direitos fundamentais.
