A área da pesquisa para a elaboração deste trabalho ficou delimitada entre 1889 - em que houve a instituição da República dos Estados Unidos do Brasil - e 1988, quando foi promulgada a Constituição da República Federativa do Brasil. Nesse segmento de tempo o sindicalismo nasceu, desenvolveu-se e se transformou, sendo que as suas alterações mais significativas ocorreram entre 1931 e 1988. Além de uma introdução, este trabalho trata dos temas seguintes: o desenvolvimento da indústria brasileira, a formação e as condições de trabalho do proletariado urbano (capítulo I); os sindicatos, as ideologias e as reivindicações trabalhistas anteriores a 1930 (capítulo II); o positivismo e o liberalismo da Primeira República, a regulamentação do trabalho e a reação empresarial (capítulo III); e a organização sindical imposta pelo estado (Capítulo IV). Os resultados e as conclusões das pesquisas estão expressos a seguir de acordo com o projeto de dissertação, que pretendeu demonstrar que quando o estado organizou os sindicatos teve dois objetivos: torná-los "lícitos", incorporando-os, como instituição, à sociedade brasileira, e sobre eles exercer o controle e a fiscalização necessários para mantê-las afastados da influência de "ideologias perigosas".

Unions and income distribution : a study of the chilean case

Seminario para optar al título de Ingeniero Comercial, Mención Economía / This paper attempts to measure the e ect of trade unions on wage inequality in Chile using panel data. Income distribution analysis is performed through a variance decomposition approach, while income equations are estimated via instrumental variables. Union history of the individual is used as an instrument. We nd that the union premium is 21%, but it is due to non-observable individual characteristics rather than union structure. Once we control for these characteristics, the union premium loses signi cance. Therefore, the e ect on income distribution is null. Comparative evidence shows that Chile lags behind OECD countries in terms of labour legislation, even if the labour reform in process is implemented.

To enable this balance, it is essential the effectiveness of democracy and freedom of association values. Therefore, this dissertation critically analyzes the Brazilian trade union model, set up mainly during the authoritarian governments of Getúlio Vargas (1930-1945). During this period, a corporatist trade union system was established, according to which the union functioned as if it were part of the State. Not only by the rules but also through State institutions, this system acted in order to ward off the class conflict and grant to the State the governing power over labor relations, denying for the parties, employer and employee, the necessary autonomy. To reach this goal, among other measures, the State established a single union rule, compulsory union dues, the union organization by category and the hierarchical structure of trade union organization. These institutes still structure the trade union system, in spite of being undemocratic, contrary to freedom of association and the new democratic constitutional order. The dissertation analyzed the union and democracy binomial, passing by historical precedents of trade unionism and its evolution in Brazil; the crisis in democracy, mainly internally in trade unions, criticizing, in particular, the lack of alternation in power and the low representativeness of trade union leaders. Next, the dissertation examines the guarantee of freedom of association by the 1988 Constitution and international human rights treaties, emphasizing its recognition as a fundamental right. The study highlights the Brazilian labor relations system, that recognizes freedom of association, but denies its effectiveness. Given this challenging scenario, the study proposes a trade union model based on freedom of association and democracy, and collective bargaining as a mechanism enable to do make these values effective. However, to ensure it to fulfill its role, the paper proposes to amend the rules on the matter ¿ constitutional and infra constitutional ¿ the adaptation and guidance of State¿s structure, the use of alternative forms of conflict resolution and the creation of a system to prevent and combat anti-union practices. The reform should replace the corporatist institutions for democratic and freedom mechanisms, respecting the autonomy of the parties. For example: a territorial basis rule, the financing system and the vertical and horizontal organization of the labor trade union should be decided by workers. However, in order to avoid fragmentation and weakening of trade unions and anti-union practices ¿ the dissertation proposes to change the trade unions electoral system, emphasizing the need of elections by workers of a trade union to represent them. The election of directors remains, but it would be secondary. The union membership and union dues would be compulsory, but the workers choose the beneficiary union, on which shall exercise supervisory power, preserving the democratic character and compatibility with the principles of the ILO. The survey revealed that the proposed changes may contribute decisively to strengthen the parties¿ autonomy and the democracy, to reduce public spending, to social pacification, to improve the workers¿ and economic qualification, to socio-economic development, as well as to improve the quality of life and social wellbeing. Socio-economic development. / O desenvolvimento socioeconômico de um país depende, dentre outros fatores, do equilíbrio da relação capital-trabalho. Para se viabilizar esse equilíbrio, é essencial a efetividade dos valores da democracia e da liberdade sindical. Diante disso, nesta dissertação, analisou-se criticamente o modelo sindical brasileiro, instituído, principalmente, durante os governos autoritários de Getúlio Vargas (de 1930 a 1945). Nesse período foi implantado um sistema sindical corporativista, conforme o qual o sindicato funcionava como se fosse parte do Estado. O referido sistema, não só por meio das normas mas também por intermédio das instituições estatais, atuava no sentido de afastar o conflito de classes e outorgar ao Estado o poder diretivo sobre as relações trabalhistas, negando as partes, empregador e trabalhador, a necessária autonomia. Com essa finalidade, entre outras providências, o Estado estabeleceu a unicidade sindical, a contribuição sindical compulsória, a organização sindical por categoria e a estrutura hierárquica de organização sindical. Esses institutos ainda estruturam o sistema sindical, no que pese serem antidemocráticos e contrários à liberdade sindical e à nova ordem constitucional. A dissertação analisou o binômio sindicato e democracia, perpassando pelos precedentes históricos do sindicalismo e a sua evolução no Brasil; discorrendo acerca da crise na democracia, sobretudo internamente no sindicato, criticando-se, mormente, a falta de alternância no poder e a baixa representatividade dos dirigentes sindicais. A seguir, o trabalho examina a garantia da liberdade sindical na Constituição de 1988 e nos tratados internacionais de direitos humanos, ressaltando-se seu reconhecimento como direito fundamental. O estudo destaca o sistema de relações trabalhistas brasileiro, que apesar de reconhecer a liberdade sindical, nega-lhe efetividade. Em face desse cenário desafiador, o estudo propôs um modelo sindical baseado na liberdade sindical e na democracia, tendo como mecanismo viabilizador a negociação coletiva. Todavia, para que essa última possa cumprir o seu papel, o trabalho propõe a alteração das normas reguladoras da matéria - constitucionais e infraconstitucionais -, a adaptação e a orientação da estrutura estatal com vistas a essa finalidade, o emprego de meios alternativos de solução de conflitos e a criação de um sistema de prevenção e combate aos atos e práticas antissindicais. A reforma deve substituir os institutos corporativistas por mecanismos democráticos e livres, que respeitem a autonomia das partes. Por exemplo: a base territorial, o sistema de financiamento e a organização vertical e horizontal do sindicato laboral devem ser decididos pelos trabalhadores. Entretanto, como forma de evitar a fragmentação e o enfraquecimento do sindicato, bem como os atos e práticas antissindicais ¿ propôs-se mudar o sistema eleitoral, passando a haver eleição para escolha do sindicato. A eleição da diretoria permanece, mas será secundária. A filiação ao sindicato e a contribuição sindical serão compulsórias, mas os trabalhadores escolherão a entidade beneficiária, sobre a qual exercerão o poder fiscalizador, preservando o caráter democrático e a compatibilidade com os princípios da OIT. A pesquisa revelou que as alterações propostas poderão contribuir decisivamente para o fortalecimento da autonomia das partes e da democracia, para a diminuição da despesa pública, para a pacificação social, para o aperfeiçoamento da qualificação dos trabalhadores e da produção, para o desenvolvimento socioeconômico, bem como para a melhoria da qualidade de vida e do bem-estar social. The end of the seventeenth century ended a historical period marked by legal uncertainty. The eighteenth century coincided with the Industrial Revolution, a movement that showed the need for social awareness on the rights of human beings as citizens and employees. After the 2nd World War, the feeling of freedom and democracy was further strengthened. In Brazil, with advent of the Federal Constitution of 1988, the company witnessed the democratization of the workers took advantage of this historic moment to organize and form unions for the purpose lidima to ensure the materialization of the rights constitutionally expressed, particularly in relation to social rights. Following the evolutionary pace of employment gains throughout the country, in 1981 was created the National Association of Teachers of Higher Education - National Union. This thesis presents a study on the constitutional foundations and regulatory union organization of university teaching in Brazil, as well as comment on the legitimacy of the ANDES-SN and its performance for the achievement of rights with the scope to ensure the exercise worthy of teaching higher. We conclude that the ANDES-SN developed work of fundamental importance for the country's democratization and the consolidation of Brazilian democracy, and defend in tough education and its agents as fundamental social right. ANDES-SN. / O presente trabalho em discussão utilizou pesquisa bibliográfica, investigativa e histórica na literatura jurídica já publicada em forma de livros, revistas, publicações avulsas, imprensa escrita e matérias disponibilizadas na internet; e documental, através de projetos, doutrinas, leis, normas, resoluções, pesquisas on line, decisões dos Tribunais Superiores brasileiros, dentre outros que tratem sobre o tema, bem como a participação do autor no mais recente Congresso Nacional do ANDES-SN realizado em Salvador BA. O final do século XVII encerrou um período histórico marcado pela insegurança jurídica. O século XVIII coincidiu com a Revolução Industrial, movimento que observou a necessidade de conscientização social sobre os direitos dos seres humanos enquanto cidadãos e empregados. Após a 2ª Guerra Mundial, o sentimento de liberdade e de democracia ficou ainda mais fortalecido. No Brasil, com o advento da Constituição Federal de 1988, a sociedade presenciou a redemocratização do país e os trabalhadores aproveitaram esse momento histórico para organizar e formar sindicatos com a finalidade lídima de garantir a materialização dos direitos constitucionalmente expressos, principalmente no tocante aos direitos sociais. Acompanhando o ritmo evolutivo de conquistas laborais por todo o País, no ano de 1981 foi criada a Associação Nacional dos Docentes do Ensino Superior Sindicato Nacional. A presente dissertação apresenta um estudo sobre os fundamentos constitucionais e normativos da organização sindical do magistério superior no Brasil, bem como tecer comentários sobre a legitimidade do ANDES SN e sua atuação para a conquista de direitos com o escopo de garantir o exercício digno do magistério superior. Conclui-se que o ANDES-SN desenvolveu trabalho de fundamental importância para a redemocratização do país e a consolidação da democracia brasileira, além de defender de forma intransigente a educação e seus agentes como direito fundamental social. El liderazgo de las mujeres trabajadoras en el movimiento sindical: caso CGTP, período 1995 – 2011

La investigación aborda desde un enfoque de derechos humanos y de género, el proceso de liderazgo seguido por las mujeres en la organización social. Analiza su precaria incorporación a la Población Económicamente Activa (PEA) y su posterior integración al movimiento sindical más representativo del país como es la Confederación General de Trabajadores del Perú (CGTP). El trabajo analiza 16 años de vida orgánica de la CGTP, visibilizando la flexibilización laboral de los años 90, que provoca despidos masivos de trabajadores y trabajadoras, donde las mujeres se incorporan como nuevas actoras en el campo del trabajo. Pero que no resuelve la desigualdad laboral entre las mujeres y los hombres sino que la acrecienta convirtiendo a las mujeres en mano de obra barata, confinándola a condiciones laborales precarias, en un contexto donde la demanda fundamental como es la estabilidad laboral es puesta en peligro. La investigación observa como la reforma laboral del gobierno de Alberto Fujimori marca el retroceso de un Estado que abdica de su papel regulador y fiscalizador y que más bien despoja a los trabajadores de sus derechos laborales fundamentales. Señalando como un hito trágico el asesinato de Pedro Huilca Tecse por el grupo Colina el 18 de diciembre de 1992, a nueve meses de haber sido elegido secretario general de la CGTP. Situación y hechos que considera influyen en el debilitamiento de la confederación, reflejada en la disminución de sus afiliados, que en la década previa a los años noventa era de 21.9 % y que entre 1995 y 2006 disminuye a 8 % y 5 %. La tesis toma en cuenta que en el 2003 bajo la dirección de Juan José Gorriti, siendo responsable Susan Portocarrero de la secretaría de la mujer y defensa del niño trabajador, se registran hechos importantes con relación a la participación cualitativa y cuantitativa de las mujeres. Proceso que es fortalecido por la reestructuración orgánica de la central, donde las secretarías se transforman en departamentos sindicales y en el que también se implementa la afiliación sindical directa. En este contexto, la secretaría de la mujer y defensa del niño trabajador, elabora su Manual de Organización y Funciones y la I Plataforma Laboral de Género y los presenta al XII Congreso Nacional de la CGTP en noviembre de 2006. Donde siete mujeres son incorporadas al consejo directivo nacional. Y que elige después de 78 años de vida orgánica a Carmela Sifuentes Inostroza como la primera presidenta mujer de su historia y a Gloria Pérez Saavedra como secretaria de la mujer. Durante el análisis se resalta que con una CGTP reconstituida y con un nuevo discurso centrado en la recuperación de la democracia y los derechos perdidos, el trabajo de la mujer adquiere mayor presencia a través del acciones del reestructurado departamento de la mujer, que consigue incorporar a más mujeres en sus comisiones de trabajo, elabora los sustentos teóricos y políticos de la estrategia de transversalización del enfoque de género, que logra más mujeres con un discurso argumentado, que disponen de herramientas como la escuela sindical para mujeres y también mixtas para hombres y mujeres con este enfoque, donde se visibiliza la importancia de una afiliación sindical con esta visión. Logrando que sus derechos y los de otras mujeres de los sectores más precarios del ámbito laboral, se incluyan como temas específicos en los pliegos y convenios colectivos a través de la Agenda Laboral de las Mujeres Trabajadoras, lo que dinamiza la participación de más mujeres en todas las instancias de la CGTP, particularmente en sus asambleas nacionales. La investigación valora como factores decisivos que contribuyen a la inclusión de la Agenda de Género dentro de la CGTP, las acciones realizadas por las mujeres del consejo nacional, por las del departamento de la mujer y por sus comisiones de trabajo, así como por el apoyo recibido de parte del secretariado ejecutivo. Todo lo cual permite que en noviembre de 2011 presenten al XIII Congreso Nacional Ordinario la moción de Cuota de Género sustentada por la responsable del departamento. La misma que pese a requerir la reforma de los estatutos, se aprueba en la Comisión No.4: Situación Orgánica y Fortalecimiento de la CGTP, ratificada por la plenaria y que está pendiente de ser revalidada por un congreso estatutario. La investigación concluye en que estos 16 años de la CGTP marcan la promoción, negociación y aprobación de acciones afirmativas inspiradas en el modelo sindical europeo13, adaptadas al modelo peruano y a los intereses colectivos de las mujeres trabajadoras. Y que a partir de 2011 comienza una nueva historia para el movimiento sindical de la CGTP sobre este tema. / --- The Women's Leadership in organizations such as the Trade Union’s, is analyzed from the perspective of human rights and gender in the present investigation. Since its intervention in the workplace: the precarious action and its subsequent integration into the most representative trade union movement in the country, such as the General Confederation of Workers of Peru - CGTP. We traveled through 16 years of the organic life of the CGTP, making visible the labor reform of the 90’s that marks the start of labor flexibility, causing massive layoffs of workers and secondly incorporating more strongly to new actors to the world Labour: Women. This addition does not respond to public policy to equip participation and working conditions of women and men in this area and therefore bridge the gaps that support discrimination; This situation reflects the demand for cheap labor in poor working conditions, backed by labor unrest, thus losing the main feature of unionized workers or workers / as: "Job Stability." The labor reform of A. Fujimori government marks the beginning of the retreat of the state not only in its role as regulator, but also to oversight of compliance with labor standards as part of the same government specifically the December 18, 1992, nine months into the General Secretariat, Peter Huilca was killed by the Colina group, both heavy blows to the unions originate the weakening of the most visible of the Country confederation, this is reflected in the declining share of national affiliation in the decade before the nineties was approximately 21.9% and between 1995 and 2006% the percentage fluctuated between 8% and 5%.
