No. of bitstreams: 1 DISS_2014_Giovanna Marielly da Silva Santos.pdf: 2452783 bytes, checksum: d2e17d2f7068ca5d5ae669ed6e18b8ac (MD5) Previous issue date: 2014-03-31 / CAPES / A pesquisa tem por objeto a análise dos limites no processo formativo direcionado aos adolescentes em conflito com a lei, abrigados no Centro Socioeducativo de Cuiabá/MT (Complexo do POMERI), e quais as relações dela com a introdução desse sujeito no campo do trabalho, voltando-se para identificação dos elementos ideológicos e pedagógicos presentes nas políticas públicas, especialmente na política educacional e nas medidas socioeducativas, direcionadas ao contingente desse protagonista, com isso busquei a identificação de quais as medidas, no plano socioeducativo, revelam-se efetivas para que os adolescentes internados nessa instituição possam ser percebidos como sujeitos de direitos humanos e indivíduos em peculiar estado de formação. Pautar-se-á ainda pelas diretrizes da Doutrina da Proteção Integral, que conferem a este protagonista o status de sujeito de direitos, Regras de Beijing (ONU/1984). A pesquisa que se desenvolve é no campo educacional, com abordagens qualitativa e quantitativa, na perspectiva do materialismo histórico dialético. O tipo da pesquisa de estudo de caso, o qual possibilita uma imersão no plano dos fenômenos, reveladora das incongruências inerentes ao processo no qual se insere a problemática do estudo, por permitir, no plano teórico-empírico, um olhar mais apurado, criterioso e circunstanciado da realidade concreta. Os resultados evidenciam que a proposta pedagógica, ora implementada, não contempla uma formação capaz de levar os jovens em conflito com a lei à superação da realidade de violência, exclusão e de opressão em que se encontram. Além disso, a análise sobre as trajetórias de vida dos sujeitos pesquisados foi revelada nessa pesquisa, por meio dos dados que demonstram a constituição familiar, educacional e econômica desse adolescente e, ainda, à luz de teóricos como Kosik (1976), Zaluar (1997) que a desigualdade social, no Brasil, com os altos índices de exclusão, criminalidade e violência, constituem-se como baixo índice de políticas públicas efetivas que poderiam dirimir tal problemática. As medidas socioeducativas, no Brasil, caminham a passos lentos e a sociedade brasileira muito tem a aprender com experiências exitosas de outros países. Nesse sentido, este estudo constata que quanto mais o Estado se afasta de suas responsabilidades sociais, mais problemas de violência e criminalidade afetam a sociedade. As políticas educacionais dirigidas aos adolescentes em conflito com a lei apresentam-se defasadas e inaptas no que tange aos Direitos Humanos e à possibilidade de construção de uma sociedade justa e emancipada. / The research aims at the analysis of limitations in the educational process directed at adolescents in conflict with the law, housed at the Center for Socio Cuiabá/MT (Complex POMERI), and what her relationships with the introduction of this subject in the field of work, turning to identify the ideological and pedagogical elements present in public policy, especially in educational policy and educational measures, directed to the quota this agent, it sought to identify which steps in childcare plan, revealed to be effective for adolescents hospitalized at this institution may be perceived as subjects of human rights and individuals peculiar state formation. Still will be governed by the guidelines of the Doctrine of Integral Protection, which give this protagonist's status as subjects of rights, the Beijing Rules (ONU/1984). The research that develops is in the educational field, with qualitative and quantitative approaches, the perspective of dialectical historical materialism. The type of case study research, which provides an immersion in the plane of phenomena, revealing the inconsistencies inherent in the process which incorporates the problem of the study, by allowing in the theoretical and empirical level, a more accurate, insightful look and the detailed reality. The results show that, well implemented, pedagogical proposal does not include a formation capable of bringing young people in conflict with the law to overcome the reality of violence, exclusion and oppression in which they are. Furthermore, the analysis of the life trajectories of the surveyed subjects was revealed in this study, using data that demonstrate the family, educational and economic constitution of the teenagers and also in the light of theoretical as Kosik (1976), ZALUAR (1997) that social inequality in Brazil, with high rates of exclusion, crime and violence, are formed as the low rate of effective public policies that could resolve this problem. The educational measures, in Brazil, walking at a slow pace and Brazilian society has much to learn from successful experiences of other countries. Thus, this study finds that the more the state moves away from its social responsibilities, more problems of violence and crime affect society. Educational policies targeting adolescents in conflict with the law have become outdated and unsuited regarding human rights and the possibility of building a just society and emancipated.
