Stalking Dickens: Predatory Disturbances in the Novels of Charles Dickens

Stalking in the nineteenth century was a dangerous, increasingly violent behavior pattern circulating in society. It was as much a criminal act then as now, and one the Victorian novel exposes as a problematic form of unwanted intrusion. The realist novel of this period alongside its more sensational counterparts not only depicts scenes of close surveillance, obsession, and harassment as harmful. It exposes the inability of social laws to regulate such conduct. I argue Charles Dickens is the most pivotal figure in observing how stalking emerged as not only a fictional motif, but as an inescapable, criminal behavior pattern. Throughout his work and its nuanced characters, Dickens reveals underlying truths about stalking and stalkers. Early books like Barnaby Rudge and The Old Curiosity Shop feature Gothic villains and predatory motifs adapted from prior literary genres. The works of his middle period foreground stalking in the context of the modern city and institutional power. In the final decade of his life, problems associated with unrequited love examine the pathological patterns of romantic obsession in modern stalker archetypes. Such an analysis and its transformative insight perceive crucial truths about unwanted intrusion, social attachment, and problem of predatory behavior.

Resumé v anglickém jazyce The issue of this thesis is the crime of dangerous stalking, which is set out in section 354 of the Act No 40/2009 Coll., Criminal Code and which criminalizes behavior commonly known under the term of stalking. The thesis aims not only at clarification of the criminal-law aspects of this crime, but also at its presentation in a more complex approach. So the thesis is divided into three parts, which are comprised of seven chapters. The first part, which is comprised of first two chapters, deals with stalking and its victims. This part addresses both the contemporary concept and historical development of this pathological phenomenon, frequency of its incidence, its possible manifestation, impact on pursued individuals and risk, which follow to them from stalking. The second part, which is comprised of third, fourth and fifth chapter, deals with issue of the crime of dangerous stalking itself. This part addresses the process of its implementation in the Czech criminal law and also its criminal- law aspects. So this part analyses this crime and deals also with possibilities of its concurrence with another crimes and with various tools of protection, which for pursued individuals provides the whole legal system. The topic of this diploma thesis is "Criminal Law and Criminological Aspects of Stalking." This phenomenon is well known in history, nevertheless it was only few years ago, that it became a criminal offence. The Czech Republic implemented new definitions of stalking into the provision § 354 act no. 40/2009 Sb. of the Penal code, taking effect on January 1, 2010. Stalking represents a wide range of possible unpredictable forms of harassment, therefore it is necessary to approach this topic from an interdisciplinary point of view. This diploma thesis is divided into 6 chapters, which are presented in a logical order. In the "Introduction", the problem of defining the subject of stalking is presented, together with general information regarding stalking. This is necessary in order to enable a deeper understanding of the phenomenon. The introductory chapter also touches on the history of stalking and the reasons for having anti-stalking laws in the Czech Republic and elsewhere.
