Self-Regulation And Rejection: Effects On Obsessive Relational Intrusion

This 2 x 3 factorial study focuses on roles of different rejection types (instigating force) and lack of self-regulation (weak inhibiting force) on the commission of obsessive relational intrusion (ORI). Rejection was manipulated through vignettes depicting no rejection or one of two types of romantic rejection: an explicit rejection (rejection that makes an internal attribution to the rejected as cause of relationship ending) or a passive rejection that “lets the pursuer down easy” (external attributions for relationship demise). Self-regulation was manipulated through a thought suppression exercise (2 conditions: free writing/no suppression vs. restricted writing/thought suppression). After scenario and writing exercise, participants (N = 221) rated their likelihood of thinking or engaging in ORI. A main effect of rejection and an interaction between rejection and self-regulation were observed. Participants explicitly rejected reported higher scores for aggressive acts compared to participants passively rejected. The difference was exacerbated with depleted self-regulation.

It also covers the penalties that can be imposed on the criminals. Moreover, it also looks at victims of dangerous pursuit and effective ways of helping the victims as well as the criminals.

It deals with the most common types of harassement and its specific relationship to domestic violence. It focuses not just on the personality of offender but also on status of the victims and its possibilities of protection against stalking. It also deals with the penalties imposed for this crime under Czech law and performs comparative study of Czech and international regulations, especially of Austria, German and the United States of America.

This dissertation deals with today still actual phenomenon called stalking, not only with it's more serious form known as a dangerous stalking but even its less serious forms. The work is systematically divided into three key parts - the first one focuses on a term definition followed by the part dealing with criminal points of view and the last one concentrates on criminological aspects. The introductory chapter contains some of the most famous definitions trying to define a difference between a stalking and a dangerous stalking. The readers are as well informed about the history of stalking and its possible forms to make it easy to understand the problem on a common level. The second part is dedicated to a criminal level of stalking. It detailly focuses on a quite interesting process of incorporation of a dangerous stalking offence into a law system of the Czech Republic. It also provides a list of possible sanctions of a stalker before an antistalking legislation introduction (it means before the year 2009). The second part of my work deals with a complex analysis of facts of the case according to the enactment §354 of the Criminal Law that is compared with some foreign norms in which it has found an inspiration. This Thesis focuses on the topic of selected issues of the crime of Stalking according to Section 354 of the Criminal Code. The offence of Stalking affects the socially harmful phenomenon known under its English name "stalking", which represents a wide range of often unpredictable forms of behavior. In this Thesis, I aimed to analyze the constituent elements of the criminal offence of Stalking and to place it in a broader context. At the same time, the aim of the work is to provide de lege ferenda proposals for improving existing legislation, firstly by thoroughly analyzing the constituent elements of the offence, secondly, by looking at practical use of the provision of the law, and thirdly, by comparing it with foreign legal regulations. This Diploma Thesis is divided into four main sections, which are further divided into individual chapters and subchapters. These sections follow consecutively logically and give the reader the opportunity to gradually penetrate into the whole matter. Resumé The aim of this final thesis is to evaluate stalking - the phenomenon which gained infamy over the last few decades - and its legal definition. Stalking or "dangerous pursuit" (literal translation name of the Czech criminal offence of stalking) is also a new offence under Czech Criminal Code no. 40/2009 which was entered into force on the 1st of January 2010. The main goal of this newly introduced criminal offence is to cover the psychological and social phenomenon of the same name, stalking, and the main goal of this thesis is to critically assess whether this criminal offence, "dangerous pursuit", is successful in criminalizing the stalking phenomenon and whether its form is an effective instrument in fighting stalking. The thesis begins with a short overview which aims to unveil the main ratio behind the call for a legal regulation of stalking. Then a psychological and social peek into the depths of this phenomenon follows (encompassing some of the most widely used typologies and even some clinical opinions on punishing and treating stalkers), which allows to critically evaluate the efficiency of that new criminal offence later on. 1 Resumé v anglickém jazyce The thesis is focused on the crime of stalking under s. 354 Criminal Code no. 40/2009, affecting the socially undesirable conduct knows also as "stalking". It provides comprehensive view on issue of stalking, respectively issue of dangerous pursuit (literal translation for crime of stalking in the Czech republic that is used in this resume for the lucidity) with wider contexts than just within the czech and criminal law. in English My thesis is focused on the criminal offence of "nebezpečné pronásledování" (dangerous harrasement as literally translated into English) under the section 354 of Czech Criminal Code. The offence was added to the Criminal Code recently, in order to allow criminal prosecution of stalking. In the past, the absence of special antistalking law has caused serious problems because of insufficient protection of victims. As the criminal prosecution of stalking has been possible for 3 years, I was convinced that the effectiveness of the provision should be evaluated and suggestions for de lege ferenda should be made. The thesis is divided into three major parts and each of them is further subdivided into chapters and subchapters. The first part of the thesis (represented by chapters 1 - 5) focuses on the obligatory elements of a criminal offence, this is the section of the thesis which analyzes and compares opinions of scholars with the opinions expressed in their judgements of judges.
