The right of superficies and its comparison to Austrian law Abstract This thesis describes the right of superficies that was adopted into the Czech legal system by the Act Nr. 89/2012 Sb., Civil Code and compares it with the Austrian right of superficies adopted by Act Nr. 86/1912. The objective of the thesis is to describe the key attributes of the right of superficies according to Czech law and to compare it with the corresponding provisions of the Austrian law. The thesis also deals with provisions of the Czech right of superficies that may be unclear or problematic to interpret and offers the possible way in which these provisions could be interpreted by drawing upon the example of the Austrian right of superficies. The thesis also contains the evaluation of the Czech right of superficies and some ideas for improvement of some its provisions. The right of superficies is described according to Czech and Austrian law in each chapter separately to aid the comprehensibility of the thesis and each chapter also contains the comparison of the concrete attributes of the Czech and Austrian right of superficies, respectively. Alternativní přístupy ke stanovení věcné hodnoty staveb / Alternative ways of setting the material value of buildings

In the process of property appraising, the material value of a building is usually set in these ways: - through a proceeding in compliance with the regulation to the law on property appraising without considering the coefficient of marketability (Kp), - through a detailed item budget or with the aid of aggregated items, - through a calculation based on technical-economic indicators (THU). In all cases, calculation of wear based on the age of the building or its parts is applicated without sufficient considering the real technical condition of the building. The thesis is concerned with working out a more precise option of the last mentioned way of setting material value of a building, i.e.on the base of price indicators. The aim of the thesis is to suggest a method of property appraising through an alternative way that would more precisely consider the real technical condition of the building and its wear. This aim can be reached by using a set of differentiated price indicators and by giving precision to the calculation of wear deduction based on evaluation of the real technical condition of defined particular parts of the building. To reach this aim, the thesis suggests a procedure of using price indicators from the Catalogue of buildings and compounds, a procedure of dividing a building into functional segments, and a procedure of setting wear deduction based on real defects of functional segments and on the level of their degradation. The thesis follows results of a grant task Optimalization of technical-economic characteristic of a building, on which the author participated in a close cooperation with the Qualiform company, RTS company and the Institute of Construction Economics and Control of VUT FAST.

Návrh obnovy roubené stavby

The present thesis deals with a renovation of a log house located in the Beskydy mountains, in the municipality of Morávka. The thesis involved gathering all available information about the previous renovations of the house throughout its existence. In order to provide as accurate output as practically possible, the house was measured and basic drawings were prepared. This included local humidity measurement and determination of fungal hyphae occurrence in identified structures using the Cartwright method. The crucial part of the thesis was the overall evaluation of the current condition of the house wooden elements, incl. the description of the defects and evaluation of their extent. All the activities mentioned above lead to the resulting objective of the thesis, i.e. designs of the log house renovation.
