Možnosti finančního zajištění ve stáří / Options for financial security in one´s old age

This diploma thesis inquires into the system of retirement pensions in Czech Republic which is based on two pillars. The first pillar comprises of mandatory elemental pension insurance which provides for over 94 % of incomes of today's retirees. The second pillar mainly comprises of additional voluntary retirement insurance with benefits and some products of life insurance. Considering actual setting of the pensions system based almost solely on pay as you-go funding (PAYG), though substantially demographically reliant, this situation won't be sustainable in the long term. The main goal of the diploma thesis is to find out approximate retirement pension income for different groups based on different amount of wages and connected drop in income especially considering actual changes which are in effect since October 2011. The crucial part of the thesis is subsequently focused on options for private saving through the third complementary pillar with concentration on development of selected indicators in additional retirement insurance with benefits and calculation of the amount of lifelong pension.

The whole thesis is focused on third pillar of pension system, namely the supplementary pension insurance. The thesis contains difficulties and issues that the pension system faces. There is also analyzed upcoming pension reform and comparison of actual pension scheme with the future one. Part of this thesis is also analysis of pension funds currently operating in the Czech pension insurance market and selection of optimal pension fund.

Nesse contexto, essa dissertação teve como base a teoria de agência, que pressupõe a existência de assimetria informacional, conflito de interesses e disposição distinta para assumir o risco, nas relações entre agente e principal. Um dos instrumentos utilizados, como resposta aos problemas de agência, é a governança. Além desse embasamento teórico, foram empregados os estudos empíricos nacionais e internacionais sobre a governança em EFPC. Ainda, foi analisada a legislação brasileira de governança para EFPC e o manual de governança da Superintendência Nacional de Previdência Complementar (PREVIC), órgão que supervisiona e fiscaliza essas organizações. Com base nesse conjunto de informações, foi construído um total de 34 indicadores representativos de governança para EFPC, os quais permitiram mensurar o nível de adesão às práticas de governança dessas organizações. Tendo como suporte a teoria de agência e a revisão de literatura empírica sobre o tema, estabeleceu-se um conjunto de hipóteses explicativas da adesão às práticas de governança das EFPC. Para que essas hipóteses fossem testadas, elaborou-se um conjunto de variáveis, as quais foram submetidas à técnica estatística de regressão linear múltipla. Essa pesquisa teve como amostra 110 EFPC pertencentes aos grupos A, B e C, da classificação estabelecida pela PREVIC. As evidências para mensurar o nível de adesão às práticas governança das EFPC, foram coletadas nas respectivas páginas eletrônicas disponíveis na Internet, e referem-se ao ano de 2014. Já, os dados utilizados para as variáveis explicativas são relativos ao ano de 2013, correspondendo ao último período em que as demonstrações contábeis e financeiras estavam encerradas, na data da coleta. Os resultados do modelo indicaram que as EFPC que possuem maior ativo, maior volume de recursos investidos, menor número de participantes, menor gasto com terceirização e patrocínio público, apresentam melhor nível de adesão às práticas de governança. Esse estudo poderá contribuir para que participantes, assistidos e demais partes interessadas possam compreender quais características que as EFPC com melhor governança possuem. Também poderá auxiliar na melhoria dos mecanismos de governança por parte das EFPC e no maior uso desses. / This study aimed to analyze the factors which explain the adherence to governance practices in private supplementary pension entities (EFPC) in Brazil. In this context, this thesis was based on agency theory, which assumes the existence of information asymmetry, conflict of interest and distinct willingness to take risk in relations involving agent and principal. One of the instruments used in response to agency problems, is governance. In addition to this theoretical basis, we employed national and international empirical studies on governance in EFPC. Besides, we analyzed the Brazilian legislation for EFPC governance and the governance manual of National Superintendence of Supplementary Pension (PREVIC), the body that oversees and supervises these organizations. Considering this information, it was built set of 34 indicators of governance for EFPC, which allowed measuring the level of adherence to governance practices of these organizations. Supported by theoretical and empirical literature review on the topic, it was established a set of explanatory hypotheses of accession to the governance practices in EFPC. The variables constructed to test these hypotheses were submitted to statistical technique of multiple linear regression. The sample consists of 110 EFPC belonging to groups A, B and C of the classification established by PREVIC. The evidence used to measure the level of adherence to governance practices EFPC were collected on their web pages available on the Internet, and refer to the year 2014. For the explanatory variables, the data used refer to the year 2013, corresponding to the last period in which the accounting and financial statements were closed during data collection. The model results indicated that the EFPC that has greater assets, higher volume of invested resources, fewer participants, lower expenses on outsourcing and public sponsorship, have better level of adherence to governance practices. This study may contribute to participants, beneficiaries and other stakeholders so that they can understand the characteristics that EFPC with better governance have. It may also help to improve the governance mechanisms by the EFPC and greater use of these.

Legal regulation of pension companies and pension funds The Master's thesis concentrates on the main issues of the legal regulation of pension companies, the designated providers of pension savings and supplementary pension savings in the Czech Republic. The thesis evaluates the reform of the pension schemes constituted by Act No. 426/2011 Coll., on Pension Savings, Act No. 427/2011 Coll., on Supplementary Pension Savings, and Act No. 428/2011 Coll., amending Certain Acts in Connection with the Adoption of the Act on Pension Savings and the Act on Supplementary Pension Savings. The thesis is divided into nine chapters. Chapter 1 is an introductory part defining the purpose of the thesis. Chapter 2 describes the pension savings regulation in the Czech Republic prior to the reform's effective date (i.e., 1 January 2013). Chapter 3 describes the pension reform and its justification. Chapter 4 concentrates on the pension companies as the managers of pension funds and supplementary pension funds. The regulation of pension funds is described in Chapter 5 while the regulation of supplementary pension funds is described in Chapter 6. Doplňkové penzijní spoření v České republice: Mikroekonomická evidence reformy z roku 2013 / The supplementary pension savings scheme in the Czech Republic: Microeconomic evidence of the 2013 policy change

The thesis investigates determinants of participation in the supplementary pension savings scheme in the Czech Republic and estimates their change with respect to the policy intervention realized in 2013. Using the time series of cross-sectional microeconomic data provided by the Statistics on Income and Living Conditions, the probability of participation and the level of contributions are estimated separately by probit and multiple linear regressions, respectively. The estimated coefficients of both models are tested for structural differences caused by the policy change, employing the pooled dataset of multiple years with additional coefficients to treat the compared period. The analysis confirms that income, age, education and economic activity have a positive effect on both the probability of participation and expected level of contributions. Whereas gender differences for the level of contributions have not been detected, single women on average show, ceteris paribus, 4.6 percentage points higher probability of participation than single men. Unexpectedly high level of activity was observed in case of retired individuals, who in 2014 represented approximately 15% of all participants and collected 20% of the credited direct state subsidy. Preliminarily, it traces the historical evolution of Social Security in Brazil, as well as the influence of the consolidation of the Social Welfare State in the realization of fundamental social rights, including complementary pension. This, in turn, is understood as the most recent significant change in the civil service pension scheme, which culminated in the creation of a closed private pension entity of a public nature and private legal personality to administer and execute the pension plans of the federal public servants. The legal nature attributed to Funpresp generates a mismatch in relation to private pension funds, insofar as their public character may lead to the incidence of reciprocal immunity, when private foundations of supplementary pensions are not presumed to have a similar immune standard, identical regulatory activities. / O presente trabalho empreende uma análise do princípio da isonomia frente ao tratamento tributário dispensado à Fundação de Previdência Complementar dos Servidores Públicos Federais - Funpresp e aos fundos de pensão privados. Preliminarmente, traça-se a evolução histórica da Previdência Social no Brasil, bem como a influência da consolidação do Estado do Bem-estar Social na concretização dos direitos sociais fundamentais, incluindo a previdência complementar. Esta por sua vez, compreendida como a mais recente alteração significativa no regime de previdência do funcionalismo público, que culminou com a criação de uma entidade fechada de previdência complementar de natureza pública e personalidade jurídica de direito privado para administrar e executar os planos de benefícios dos servidores públicos federais. Calha que a natureza jurídica atribuída à Funpresp gera um descompasso em relação aos fundos de pensão privados, na medida em que seu caráter público pode ensejar na incidência da imunidade reciproca, quando as fundações privadas de previdência complementar não são prestigiadas com norma imunitória similar, malgrado exerçam atividades regulamentares idênticas.

Assim, o objetivo deste estudo foi analisar se existe relação positiva entre o nível de governança e a rentabilidade das EFPC brasileiras. A amostra da pesquisa contempla 141 EFPC brasileiras, com evidências que compreendem os exercícios de 2011 a 2014, reunindo um total de 423 observações. Foi realizada a análise com o uso da técnica de análise de Mínimos Quadrados Generalizados (MQG), com dados empilhados. A variável dependente é a rentabilidade, representada pelo Retorno sobre os Investimentos (RI), e a variável explicativa o nível de governança. O nível de governança foi medido através de um índice construído com um total de 33 indicadores representativos de práticas de governança. Esses indicadores de governança foram estabelecidos através de uma revisão da legislação brasileira sobre EFPC, orientações e recomendações de órgãos públicos e na literatura sobre o tema. Foram incluídas no modelo também variáveis de controle, as quais foram apontadas na literatura revisada como influenciadores do desempenho econômico financeiro. As evidências para todas variáveis foram coletadas dos estatutos e relatórios anuais das EFPC disponibilizados em suas páginas eletrônicas na Internet. O resultado dessa pesquisa indica uma relação positiva entre rentabilidade e governança das EFPC. Ou seja, EFPC com melhores níveis de governança têm melhor rentabilidade dos investimentos. Este estudo poderá contribuir para que participantes e assistidos compreendam melhor a importância da governança nas EFPC e influenciar o maior uso de práticas de governança por estas entidades. / The assets of Brazilian private pension funds (PPFs) are formed by the financial contributions of its sponsors or its founders, as well as of its participants. These fund’s governance structure is established by law and regulated by public agencies. This governance structure aims to mitigate conflicts of interest, towards improved economic and financial efficiency of the PPF. Thus, the objective of this study is to examine whether there is a positive relationship between the level of governance and the profitability of the Brazilian PPFs. The research sample includes 141 Brazilian PPF, with data covering the years 2011 to 2014, resulting on a total of 423 observations. The analysis of the research problem was performed through Generalized Least Squares (GLS) technique, for pooled data. The dependent variable is the PPF’s profitability, with the PPF’s Return on Investments (RI) as proxy. The explanatory variable of interest is the level of governance. The level of governance was measured by an index constructed by a total of 33 indicators representative of governance practices. These governance indicators were established through a review of the Brazilian legislation on PPFs, guidelines and recommendations of public agencies and literature on the subject. Data was collected from PPFs statutes and annual reports, available on their web pages. The result of this research indicates a positive relationship between profitability and governance of PPFs. That is, PPFs with better levels of governance have better return on investments. This study may contribute to the understanding of participants and beneficiaries on the importance of governance in PPFs and, hopefully, foster a greater use of governance practices by these entities.

The thesis deals with the collective investing. The aim is to assess the current state of collective investment in the Czech Republic. The are selected characteristics of the reference sector which are closely analyzed. The main aspects discussed in this work will be liquidity, cost, and in particular the profitability of selected products. On the basis of available information is created a portfolio of collective investment products selected for age and social groups to ensure income for retirement or accumulation of funds for future investments. Attention is paid to selected financial products company on the Czech market. These products include pension funds, investment life insurance and unit trust.
