Magistro darbe analizuojami darbuotojų, dirbančių statutinėse įstaigose pagal darbo sutartis, drausminės atsakomybės ir statutinių valstybės tarnautojų tarnybinės atsakomybės panašumai ir skirtumai. Remiantis galiojančiais teisės aktais nagrinėjama tema, darbe mėginama atriboti šias teisinės atsakomybės rūšis ir palyginti jas teoriniame bei praktiniame lygmenyje. Pirmiausia darbe aptariamos darbo drausmės, drausminės bei tarnybinės atsakomybės sampratos; drausminė ir tarnybinė atsakomybė palyginamos su kitomis teisinės atsakomybės rūšimis; atribojami ir apibūdinami drausminės ir tarnybinės atsakomybės pagrindai. Toliau darbe analizuojama darbuotojų, dirbančių statutinėse įstaigose pagal darbo sutartis, drausminės atsakomybės ir statutinių valstybės tarnautojų tarnybinės atsakomybės panašumai ir skirtumai, aptariant darbuotojų pasiaiškinimo, nuobaudų parinkimo, įforminimo, jų skyrimo procedūros ir kitus susijusius klausimus. Darbe taip pat pateikta glausta drausminės ir tarnybinės atsakomybės praktinio taikymo Lietuvos Respublikos muitinėje apžvalga. Išanalizavus darbuotojų, dirbančių pagal darbo sutartis, drausminę atsakomybę ir statutinių valstybės tarnautojų tarnybinę atsakomybę, pastebėtina, kad šių teisinių atsakomybių reglamentavime yra daugiau panašumų nei skirtumų, todėl galima daryti išvadą, kad šie institutai yra artimi, o jų skirtybes lemia tik statutinės tarnybos specifika. / This Master‘s thesis comprises the analysis of similarities and disparities of disciplinary responsibility of contractual employees and public officials employed in statutory organizations. On the ground of current legislation of the question being analyzed, the paper tries to draw a distinction between these legal responsibilities and compare them on theoretical and practical basis. In the first place, the paper describes the conception of discipline at work and also the conception of disciplinary responsibility and official responsibility. Besides it compares disciplinary responsibility and official responsibility to other kinds of legal responsibilities and also demarcates and defines the basics of those two kinds of responsibilities. Further the paper analyses similarities and disparities of disciplinary responsibility of contractual employees and public officials employed in statutory organizations. This analysis is done on the grounds of such questions as the employee’s explanation, also selection, perfection and the procedure of the appointment of punishments. Besides this Master’s thesis also gives an example of the case analysis of practical application of disciplinary responsibility and official responsibility in Lithuanian Customs.
