Genocido traktuotė tarptautiniuose teisės aktuose ir Lietuvos Respublikos baudžiamajame kodekse / Treatment of genocide in international legal acts and the criminal code of the republic of lithuania

Magistro darbo “Genocido traktuotė tarptautiniuose teisės aktuose ir Lietuvos Respublikos baudžiamajame kodekse” tyrimo objektas yra genocido nusikaltimo samprata tarptautinėje ir nacionalinėje teisėje. Darbas pradedamas atskleidžiant šios sampratos susiformavimo ištakas ir raidą abiejose teisinėse sistemose. Siekiant kuo aiškiau ir išsamiau atskleisti genocido koncepciją, tiriami atskiri šios koncepcijos elementai, remiantis baudžiamojoje teisėje nusistovėjusia nusikalstamų veikų sudėčių analizės schema, t.y. išskiriant objektą, objektyviuosius požymius, subjektą ir subjektyviuosius požymius. Magistro darbe nurodomos problemos, kylančios bandant apibrėžti genocido nusikaltimo požymių turinį, ir vertinant tiek oficialių institucijų, tiek doktrinos atstovų pateikiamus galimus atskirų genocido sampratos aspektų aiškinimus, ieškoma teisiniu ir praktiniu požiūriu priimtiniausio minėtų problemų sprendimo. Darbe didelis dėmesys teikiamas genocido sampratos pagal tarptautinę ir nacionalinę teisę lyginamajai analizei. Aiškinamasi, kiek nacionalinėje teisėje įtvirtinta genocido koncepcija atitinka tarptautinę, identifikuojami pagrindiniai šių koncepcijų skirtumai, tiriamos minėtų skirtumų atsiradimo istorinės, teisinės prielaidos ir esama bei galima įtaka baudžiamosios teisės teorijai ir praktikai. Magistro darbas buvo rašomas remiantis tarptautiniais teisės aktais (Konvencija dėl genocido, Ruandos tribunolo statutas, Jugoslavijos Tribunolo statutas, Tarptautinio baudžiamojo teismo... [toliau žr. visą tekstą] / The subject matter of master thesis is the concept of the crime of genocide in national and international law. Analysis begins by explaining the origins of this concept and following it‘s evolution in both legal systems. In order to give a full and particular account on the notion of the crime of genocide, the concept is examined by splitting it into several different elements, while using the traditional scheme of analysis in Lithuanian criminal law (object, objective side, subject and subjective side are researched separately). Master thesis also points out the problems related to defining the meaning of separate elements of the concept of genocide. By examining and comparing various opinions expressed by official institutions and scientists on these questions, author seeks to find a solution which poses least problems in legal and practical terms. In master thesis attention is also given to comparative analysis of the concept of genocide in national and international law. Author examines the differences between these concepts and historical, legal and political reasons behind said differences and their present and possible impact to criminal law theory and practice. At the outset, it has to be noticed that crimes against international law are committed by men, not by abstract entities, and international law will achieve its goals only if those responsible for crimes will be brought to justice. The principle of individual criminal responsibility of Heads’ of State for crimes against humanity, genocide, war crimes and torture (elaborated in the Nuremberg Charter) is part of customary international law. The principle is embodied in the resolutions of the UN General Assembly – Principles of Law Recognized in the Charter of the Nuremberg Tribunal and the Judgment of the Tribunal (1950); international treaties – Convention for the Prevention and Punishment of the Crime of Genocide (1948), Geneva Conventions (1949), Convention against Torture and Other cruel, inhuman or degrading treatment or punishment (1984), Rome Statute of the International Criminal Court (1998); other international instruments – UN Draft Code of Crimes against the Peace and Security of Mankind (1996), Statute of the International Criminal Tribunal for the former Yugoslavia (1993) (also clarified in the proceedings brought before the former Yugoslavian leader S.
