Previous issue date: 2017-02-22 / This dissertation aims to the analysis of the virtualization of process, observing the scientific movements, the principiological (re)construction, and the constitutional accommodation that derives. For that, it investigates the movements of constitutionalization of the civil process and its virtualization by the use of informational and communicational technologies to demonstrate in what way they converge and are influenced by the contemporary Net Society, especially when is observed inserted in a Democratic Rule of Law. It utilizes the hypothetic-deductive method of approaching, in which it conjectures the scientific-juridical autonomy of the e-process, analysing the construction of a specific principiologic body and its conjugation with the procedural fundamental rights. It concludes that the e-process constitutes a singular institute inserted in the process theory and compound of a specific normative body of rules and principles of its own. From this derives that these attributes must be observed by the Judiciary Power at the implementation of the e-process as a (new) minimum model, suggesting the designation as fair e-process for it aligns with the notion of the fundamental right to a fair trial whereas minimum model of procedural conformation to be offered, guaranteed and observe by State to free up an adequate and effective tool for tutelage of rights and the social pacification. / A presente disserta??o tem por objetivo a an?lise do movimento de virtualiza??o do processo, observando os movimentos cient?ficos, a (re)constru??o principiol?gica e a acomoda??o constitucional decorrentes. Para tanto, investiga os movimentos de constitucionaliza??o do processo civil e sua virtualiza??o por meio do uso das tecnologias da informa??o e da comunica??o para demonstrar de que maneira convergem e s?o influenciados pela contempor?nea Sociedade em Rede, especialmente quando se a observa inserida num Estado Democr?tico de Direito. Utiliza-se do m?todo hipot?tico-dedutivo de abordagem, pelo qual se conjecturam a autonomia cient?fico-jur?dica do e-processo, analisando-se a constru??o dum corpo principiol?gico pr?prio e a sua conjuga??o com os direitos fundamentais processuais. Conclui-se que o e-processo constitui instituto singular, inserido na teoria do processo e composto de corpo normativo espec?fico com regras e princ?pios que lhe s?o peculiares. Decorre disso, o fato de que tais atributos devem ser observados pelo Poder Judici?rio na implementa??o do e-processo como (novo) modelo m?nimo, sugerindo-se seja designado como ?e-processo justo?, por alinhar-se com a no??o do direito fundamental ao processo justo, enquanto modelo m?nimo de conforma??o procedimental a ser ofertada, garantida e observada pelo Estado para viabilizar o instrumento adequado e efetivo de tutela de direitos e ? pacifica??o social.
