Teroro akto traktuotė LR BK, kitų valstybių įstatymuose ir tarptautiniuose teisės aktuose Santrauka 2000 m. – 2003 m. Lietuvos Respublikos Seimas priėmė eilę įstatymų, kuriais ratifikavo pagrindines konvencijas dėl kovos su terorizmu. Šių tarptautinių teisės aktų įgyvendinimas sąlygojo esminius LR BK 250 str. numatytos teroro akto sudėties pakeitimus bei papildymus. Magistro darbe analizuojami LR BK 250 str. numatytos teroro akto sudėties požymiai bei tarptautinių teisės aktų nuostatos ir daroma išvada, kad LR BK nuostatos suponuoja tinkamą tarptautinių teisės aktų įgyvendinimą. Darbe atskleidžiama teroro akto sąvoka, teroro aktą apibrėžiant kaip vieną pavojingiausių nusikaltimų, pasireiškiančiu sprogmenų padėjimu, sprogdinimu, padegimu, žmonių gyvenamojoje, darbo, susibūrimo ar viešojoje vietoje, radioaktyviųjų, biologinių, cheminių kenksmingų medžiagų, preparatų ar mikroorganizmų paskleidimu, kuriuo tiesiogiai kėsinamasi į visuomenės saugumą ir kuris kelia grėsmę žmonių gyvybei, sveikatai, nuosavybei. Darbe pažymima, kad teroro akto esmė pasireiškia tuo, jog darant šį nusikaltimą visuomenėje sukeliama panika, sumaištis, baimės ir nesaugumo jausmas, nes teroro akto pobūdis bei padarymo vieta nulemia tai, kad darant šį nusikaltimą sukeliama grėsmė ne vienam ar keliems asmenims, bet didelei ar neapibrėžtai jų grupei. [toliau žr. visą tekstą] / Definition of act of terrorism according to the Penal code of Lithuania, criminal laws of foreign states and international law Summary At the 2000 – 2003 the Seimas of the Republic of Lithuania adopted a range of new legal acts according to the purpose of implementation of international legal instruments in the national criminal law. In the work the author analyses criminal elements of terror act in the Lithuanian Penal code and in the international legal instruments against terrorism as well as in the national criminal law of foreign countries. The author establishes main problems that occur in the process of qualification of terror act. Also in this work considering the implementation of international rules in force according to the Penal code of the Republic of Lithuania author comes to a conclusion that international provisions is transferred successfully. In the work author establishes the concept of terror act as one of the most dangerous offences witch means the placing of explosives with the intent to cause explosion, cause of explosion or fire to in a place of dwelling, work, gathering or a public place also spreading of radioactive, biological or hazardous substances, preparations or micro-organisms.
