En el Perú existe una insuficiente definición de tortura en el Código Penal y la aplicación de esta afecta los derechos fundamentales de las personas LGTBIQ. Mediante el análisis del reciente caso de Azul Rojas Marín ante la Corte Interamericana de Derechos Humanos se busca demostrar cómo el Estado no ha tomado las medidas correctas con respecto al tratamiento del delito de tortura a la población LGTBIQ al interpretar este delito de manera limitada y no acorde a las normas del Derecho Internacional, omitiendo principalmente el enfoque de no discriminación. / In Peru, there is an insufficient definition of torture in the Peruvian Criminal Code and its application affects the fundamental rights of LGTBIQ people. Through the recent analysis of the Azul Rojas Marín case at the Inter-American Court of Human Rights, we seek to demonstrate how the State has not taken the correct measures with regard to the treatment of the crime of torture to the LGTBIQ population by interpreting this crime in a restrictive way and not in line with the regulations of International Law, mainly omitting the non-discrimination perspective.
