This article studies people relegated to invisibility: the LGTB (lesbians, gays, transsexuals and bisexuals) from constitutional and international law point of view. Thoughts will be focused on transsexuals and their rights to be treated according to an early internalized gender and some rights emerged from this treatment. Peruvian State role in this subject and the existing challenges will also be analyzed in the same way. / El presente artículo es un estudio de una población relegada a la invisibilidad, los LGTB (lesbianas, gays, transexuales y bisexuales), desde el derecho constitucional y el derecho internacional. La reflexión girará entorno a los transexuales y al derecho que tienen estos a ser tratados como personas pertenecientes al género que han internalizado desde temprana edad. Asimismo, se discutirá algunos derechos que se desprenden de este trato. De la misma manera, se analizará el papel del Estado peruano en este tema y los retos que todavía existen.El ensayo es ganador del II Concurso de Investigación Jurídica de Responsabilidad Social, realizado en el segundo semestre de 2012.

Memoria para optar al grado de Licenciado en Ciencias Jurídicas y Sociales / El presente ensayo construye un concepto de misgendering que permite problematizar la relación entre el sistema penitenciario y las personas transgénero privadas de libertad. Desde una perspectiva de identidad de género, se identifican situaciones de violencia que subyacen en esa relación, y se analizan bajo el prisma de la tortura y otros tratos crueles, inhumanos y degradantes. Finalmente, se concluye que estamos frente a una grave vulneración de derechos humanos que podría constituir trato degradante / This essay builds a concept of misgendering, allowing to problematize the relationship between the penitentiary system and the transgender people who are deprived of their liberty. From an identity of gender perspective, situations of violence are identified underlying that relationship, and they are analyze under de prism of torture and others cruel, inhuman and degrading treatments. Finally, it is concluded that we are in front of a serious infringement of human rights that could constitute degrading treatment
