Orientador: Patricia Borba Marchetto / Banca: Maria Amalia de Figueiredo Pereira Alvarenga / Banca: Carlos José Cordeiro / Resumo: A sociedade, enquanto um amontoado de indivíduos com suas ideologias, direitos e deveres, está em uma constante evolução no que se refere ao gênero e à sexualidade e como tais se apresentam socialmente. Desta feita, nota-se um desenvolvimento social cujo objeto se pauta na proteção das diferenças e dos indivíduos que não se enquadram em conjecturas sociais negativamente discriminatórias, como os transexuais, e que em razão dessa discriminação, necessitam da chancela estatal para efetivar a respectiva proteção merecida a tais indivíduos, não olvidando da idêntica necessidade do reconhecimento social pleno a uma categoria de indivíduos que, em razão de uma incompatibilidade entre gênero e sexo morfológico, são colocados à margem da sociedade. Verifica-se, assim, a real importância de se pesquisar a respeito da transexualidade, ainda considerada como doença (transexualismo) pela Classificação Internacional de Doenças - CID (10 F 64.0) bem como seus aspectos legais, uma vez que ainda não há uma real efetivação dos direitos fundamentais para os transexuais. Busca-se, igualmente, defender a necessidade de uma despatologização da transexualidade bem como a desburocratização do acesso à efetivação da transgenitalização. Inobstante a tais questões, destaca-se a importância do estudo sobre os aspectos legais que se apresentam perante a transexualidade uma vez que esta traz reflexos na sociedade e na vida civil dos transexuais de modo a provocar situações ainda não reguladas legalmente ... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: Society, as a bunch of individuals with their ideologies, rights and duties, is in a constant evolution regarding gender and sexuality and how these are presented socially. Thus, there is a social development whose object is guided in protecting the differences and individuals who do not belong to negative discriminatory social conjectures, such as transsexuals, and because of this discrimination, they need the State protection to promote their rights, not forgetting the need for full equal social recognition to a category of individuals who are placed on the margins of society due to a mismatch between gender and morphological sex. Researching about transsexuality is clearly necessary once it is still considered a disease (transsexualism) by the International Classification of Diseases - ICD (10 F 64.0) and its legal aspects, since there is still no real realization of fundamental rights to transsexuals. This study also aims to defend the need for the depathologization of transsexuality and the debureaucratization of access to transgenitalization. Notwithstanding such issues, it is also important to actualize the study on the legal aspects that arise before transsexuality once it brings reflections on society and civil life of transsexuals, revealing situations that still have not been legally regulated that need a plausible answer from the Judiciary to ensure transgender individuals the basic rights inherent to any other individual irrespective of their gender.
