An evaluation of the parametric amendments of legislation relating to the distribution of retirement benefits upon divorce

Magister Legum - LLM / This thesis will examine the effects of divorce on the benefit payable to a member of a retirement fund, where divorce has occurred before the member has reached retirement age. In particular, parametric (that is, piecemeal) amendments to the relevant legislation will be analysed in order to outline the development of the legislation relating to divorce and the consequent distribution of assets (including retirement savings). The previous and current legal position in South Africa relating to divorce and retirement savings will be set out and critically analysed to determine whether the current position can be regarded as an improvement upon the previous legal position, or whether other and/or new problems in this area have been created. Parametric amendments to relevant legislation have thus far been the subject of many cases in our courts and adjudicative tribunals. A systemic overhaul of a particular area of law is a useful tool in providing legal certainty and clarifying the laws applicable to that area. This thesis will therefore argue in favour of a systemic overhaul of the legislation applicable to the allocation of retirement benefits at divorce, as opposed to the ineffectual parametric (i.e. piecemeal) amendments that have been implemented thus far. An essential aspect of this study is a comparative study of South African legal principles relating to retirement benefits and divorce with the legal principles of this subject in the United Kingdom (UK). / South Africa

The diploma thesis is focused on identification and mutual comparison of Czech-British and Slovak-British cultural standards at work environment. The main goal of the thesis is to define British cultural standards from both sides, from the Czech one and the Slovak one, and then to compare, whether the information from qualitative research corresponds with theoretical assumptions. The next goal is to find out how much different is the view on this topic from the Czech and from the Slovak perspective, if it is different. At the end of the thesis will be proposed a few suggestions, how Czech and Slovak should prepare for a longer staying in the United Kingdom in order to avoid possible cultural misunderstandings.

This master thesis deals with the comparison of corporate taxation in the Czech Republic and the United Kingdom. In the first chapter, the terms tax and tax system are described and the Czech and the UK tax systems are analysed and compared. The second chapter deals with corporate taxation, its history and current trends. It is deeply focused on the corporate taxation in the observed countries. In the third chapter the deferred tax is explained and the impact of corporate taxation rules on deferred tax is analysed. The crux of my thesis lies in the evaluation and comparison of both systems of the corporate taxation.

The purpose of this research was to investigate the nature of the South African late adolescent’s adjustment whilst on a working holiday in the United Kingdom. In order to achieve this goal a thorough literature study was done with attention afforded to late adolescence, the developmental tasks of this life stage, culture and culture shock and the adjustment to the latter. An empirical study was conducted whereby semi-structured interviews were utilized as a data collection method. During these interviews questions were posed to the respondents to ascertain what they regarded as pleasant as well as unpleasant in relation to their working holiday in the United Kingdom, the perceived cultural differences between South Africans and Britons, problems experienced with the adjustment, homesickness, triggers thereof including ways in which to cope with it. Ten respondents were individually interviewed during this research. An exploratory research design was followed as the researcher explored the trend of late adolescents who embark on a working holiday in the United Kingdom. The researcher performed qualitative research to answer the research question. The research question that was formulated for the purpose of this study was: what is the nature of the adjustment of the late adolescent whilst living and working in the United Kingdom? The researcher applied the one-group posttest-only design as research procedure because interviews were conducted following a period of at least four months in which the respondents had lived in the United Kingdom. Empirical data was obtained by means of an interview schedule and the following themes were identified: -- Late adolescents experience culture shock upon arrival in the United Kingdom. -- Environmental differences are experienced. -- Cultural differences between South Africans and Britons are noted. -- Independency increases. -- Work experience is gained and money earned in order to meet needs. -- Cohesion and solidarity are experienced with fellow South Africans in London. -- Exposure is experienced. -- Homesickness is experienced. The researcher concludes that the late adolescent experiences initial culture shock that is absorbed by the support of fellow South Africans and results in increased independence. Applying the RE-AIM Model to Asset-Based Community Health Interventions: A Multiple Case Study in Tower Hamlets, London, UK

Public health policy and practice principally acknowledge a needs-based approach when developing, implementing, and evaluating community health programs. This needs-based perspective receives criticism because it focuses too heavily on what is missing or wrong with communities as opposed to building on their strengths. As a result, community members are perceived as passive recipients, which is disempowering, and ultimately risks creating unsustainable and ineffective programs. In recent years, there has been a growing interest in achieving a balance between the needs-based approach and the asset-based approach, which accentuates positive capabilities. While the amount of literature discussing the benefits of this latter perspective has grown substantially, accompanying evaluation required to sustain continued investment has been limited. Compared to needs-based research, there is less literature on asset-based evaluation. Emphasis on such research could contribute to the progression of evaluation methodologies and theories, ultimately encouraging their use. The purpose of this study is to apply an existing public health evaluation framework – the RE-AIM model (Glasgow, Vogt, and Boles, 1999) – to asset-based community health interventions and to examine the utility of such an evaluation structure across a variety of asset-based health projects. A multiple case study design facilitated comparison of the applicability of the RE-AIM model dimensions – Reach, Effectiveness, Adoption, Implementation, and Maintenance across three cases in the East London borough of Tower Hamlets, United Kingdom. These included the Local Links Asset-mapping project, the Healthy Early Years Project, and the Good Moves project. The RE-AIM framework is additionally guided by principles of the Realist Evaluation approach (Pawson and Tilley, 1997). This research study contributes to asset-based research by providing a guideline and conceptual framework to support asset-based intervention evaluation theory and practice.

The aim of this thesis is to analyse the approach of the United Kingdom to immigration and integration of third country nationals. The analysis is joined by comparison with the situation and measures taken within the European Union. The paper depicts the development and changes of the EU integration policy and the current system of immigration policies in the United Kingdom. Attention is also drawn to the public opinion and perception of immigrants in the host societies. Since the 90s, the integration policies of the EU Member States seem to be converging to the "civic integration" model. Emphasis is placed on the individual integration of immigrants, but their group affiliation is also accepted. Integration has to be a two-way process, with efforts made by the immigrants as well as the host society. Despite that, it has rather become a precondition which has to be fulfilled by the immigrants in order to gain more rights. The United Kingdom is also starting to condition the admission and citizenship acquisition by fulfilling language and knowledge criteria, regarding the history, institutions and life in the country. Even though its integration policy is one of the most successful, the current steps raise doubts.

Située dans une perspective d’anglais de spécialité et adoptant des outils d’analyse de discours, cette thèse vise à contribuer à la caractérisation du discours environnemental entendu comme un discours spécialisé. Résultat d’une conception changée de notre environnement, les mouvements de pensée, les pratiques et les discours qui se développent dans le but de sa protection, préservation ou régénération font partie du domaine spécialisé environnemental. Ce domaine émergent, ainsi que ses composants principaux, sont définis dans cette thèse.La première partie de notre thèse présente une vision globale du domaine et de son discours. Les concepts centraux de mouvement environnemental, d’environnementalisme, d’écologie et d’écologisme y sont analysés. Nous offrons ensuite une définition du concept de discours environnemental en partant du contenu des travaux faits par différents auteurs sur cet objet et en aboutissant à la prise en compte de ses spécificités grâce aux outils élaborés dans le cadre des études d’anglais de spécialité. La deuxième partie s’attache plus particulièrement aux discours et aux pratiques des organisations au Royaume-Uni. Dans ce contexte culturel particulier, nous présentons les principales organisations qui ont un rôle à jouer dans le domaine environnemental et décrivons leurs principaux discours de communication dans le domaine en nous interrogeant notamment sur les nouveaux genres de discours, les termes spécialisés et les pratiques discursives récurrentes. L’organisation interne du domaine est également considérée avec la présentation d’une typologie des organisations et des relations entretenues entre elles ainsi que du rôle et de la spécificité des experts dans le domaine. Cette étude est complétée dans une troisième partie par une analyse descriptive d’un genre de discours jouant un rôle prééminent dans le domaine : les rapports sur la responsabilité sociale des organisations. Après avoir présenté son contexte d’apparition et sa fonction principale, nous nous interrogeons sur la représentation des acteurs du domaine offerte par l’étude de ce genre puis sur les phénomènes de normalisation générique de ces rapports d’un point de vue diachronique. / With an English for Specific Purposes perspective and adopting the methodological tools of discourse analysis, this thesis explores the characteristics of environmental discourse considered as a specialized type of discourse. As a result of a change of conception of our environment, the trends of thinking, the practices and discourses that are developing, with the aim of contributing to the protection, preservation, or regeneration of the environment have become part of the specialized domain referred to as environmental. This emerging domain and its main components are defined in this thesis.The first part of the thesis presents a global vision of the domain and of its discourse. The central concepts of the environmental movement, environmentalism, ecology and ecologism are analyzed. A definition of the concept of environmental discourse is then offered, starting with the presentation of the content of various authors' work on the object and concluding with the identification of its specificities thanks to tools elaborated in the French school of English for Specific Purposes. The second part of the thesis is devoted to the discourses and practices of organisations in the UK. We present, within this specific cultural context, the main organisations that have a role to play in the environmental domain and describe their principal environmental communication discourses with a particular focus on new genres, specialized terms and recurrent discursive practices. The internal organisation of the domain is also considered with the presentation of a typology of organisations, of the relations they maintain as well as of the role and specificities of environmental experts.The study is completed in a third part by a descriptive analysis of a genre that plays a decisive role in the domain: reports on corporate social responsibility. After having presented the context in which this type of report emerged and its main function, we question the way these reports represent the main actors of the domain and the existence and influence of generic norms in a diachronic perspective.

La thèse a pour objectif de contribuer à l’étude des processus d’internationalisationscientifique à travers l’étude du cas spécifique de la science politique sur la période1945-2010. Elle s’appuie, pour ce faire, sur une comparaison franco-britannique et surun cadre théorique inspiré de travaux de sociologie des sciences et de sociologiepolitique. Articulé autour de la notion de champ, ce cadre constitue la base d’uneanalyse en trois temps. Le premier consiste en une sociohistoire comparée de deuxorganisations transnationales de science politique – l’Association Internationale deScience Politique (AISP) et le European Consortium for Political Research (ECPR). Ledeuxième repose sur une analyse comparée de trois instances de consécration éditoriales– la Revue Française de Science Politique, Political Studies et le European Journal ofPolitical Research. Le troisième est une analyse comparée des carrières internationalesde politistes français et britanniques, sur la base de récits de vie. Les apports de ces troisterrains amènent à conclure, d’une part, à l’émergence progressive d’un champinternational partiellement autonome des espaces nationaux mais dont les règles du jeusont en partie liées aux rapports de force en vigueur dans le champ américain. Ilspermettent aussi, d’autre part, de mettre en évidence une structuration du processusd’internationalisation des champs nationaux par les phénomènes de décentralisation,d’autonomisation et de spécialisation qui modifient, au fil du temps, leur physionomie. / This work aims at contributing to the study of scientific internationalisation processesthrough a study of the specific case of political science from 1945 to 2010. This is doneon the basis of a comparison between France and Britain and a theoretical frameworkrevolving mainly around the concept of field and drawn from the sociology of scienceand political sociology. The demonstration is divided into three main parts. The first oneis a comparative historical sociology of two transnational political science organisations– the International Political Science Association (IPSA) and the European Consortiumfor Political Research (ECPR). The second is based on a comparative study of threepolitical science journals – the Revue Française de Science Politique, Political Studiesand the European Journal of Political Research. The third lies on a comparativeanalysis of British and French political scientists’ international careers, using materialdrawn from life-history interviews. The combined analysis of these three different typesof data leads us to conclude that an international field of political science hasprogressively emerged and that this field, while partially autonomous from nationaldevelopments, has its structures and rules partly linked to those of the American field. Asecond conclusion is the strong impact of decentralisation, autonomisation andspecialisation processes on the conditions and forms of the internationalisation ofnational fields.
