In addition to promoting the evaluation of the institutions of upper education as well as that of the courses and students in an effort to improve the quality of education, SINAES also seeks to procure the needed data for regulating processes and state supervision. This study was grounded on the theories of educational evaluation developed over the last 90 years. The source of information was collected from legal texts published in the official state journal Diário Oficial da União between 2004 and 2008 which are available on-line on the page of the Secretary of Education. The method of analysis that was adopted herein combined documental analysis procedures and content which identified the existence of rhetoric defining the conceptual betterment of education. Throughout the text however, there seemed to be a strong bias favoring the use of the evaluation as a regulatory instrument rather than for the improvement of educational standards. This investigation concludes that the evaluation is imposed upon the institutions as a form of oversight and a means of regulating education. Also, whether the self evaluation will serve to improve the academic standards or will be adopted merely to abide by the law depends solely upon the particular interests of each institution / Este trabalho tem como objetivo investigar qual o significado da avaliação de instituições presente na legislação proposta para a educação superior, a partir da Lei nº. 10.861/2004, que instituiu o Sistema Nacional de Avaliação da Educação Superior (SINAES), no qual a avaliação tem como finalidade tanto promover a avaliação de Instituições, cursos e estudantes para melhoria da qualidade da educação como subsidiar os processos de regulação e supervisão pelo Estado. O estudo fundamentou-se nas teorias de avaliação educacional desenvolvida nos últimos 90 anos. Tomou-se como fonte os textos legais publicados no Diário Oficial da União, disponíveis on-line, na página do Ministério da Educação. O período de investigação delimitado foi de 2004 a 2008 e o método de análise utilizado combinou procedimentos de análise documental e de conteúdo. A análise dos documentos identificou a presença de um discurso de concepção formativa da avaliação, mas sobre o qual parece predominar a função regulatória do uso da avaliação. Conclui-se que a avaliação é imposta às instituições com caráter fiscalizador, tendo em vista que é meio para regularizar a oferta do ensino pelas instituições e o seu caráter formativo vai depender do interesse particular da instituição no cumprimento da sua auto-avaliação que está prevista na lei
