South Grand Boulevard:user orientation as a catalyst for resiliency

Clement / Contemporary design of the urban environment focuses increasingly upon the quality of space found within the public right-of-way. Landscape architects and urban planners are beginning to ask new questions that deviate from the conventional streetscape designs of the latter half of the 20th century. Under the mantra “complete the streets,” communities all across America are calling for a paradigm shift towards multimodal, pedestrian-scaled urban rights-of-way. At the same time, existing stormwater and combined sewer infrastructure is nearing the end of its productive lifespan in cities all across the country and world. The direct costs associated with repairing this infrastructure combined with the indirect costs of poor water quality and a greater frequency and intensity of flooding events downstream present a strong argument for developing new, innovative ideas about how to best design the stormwater infrastructure of tomorrow. The reintegration of ecological processes into the urban fabric will act as a catalyst for the appreciation of genius loci (spirit of the place) and user meaning while mitigating downstream flooding, increasing water quality, and extending the lifespan of existing stormwater infrastructure. By studying the hierarchical categorization of urban rights-of-way according to increased levels of user orientation, this research project aims to clearly articulate a new theoretical framework for expanding upon the current discourse surrounding “complete streets” and “green streets” theory. In the long-term, it is both economically and socially profitable for cities to use ecological processes to reclaim auto-oriented, urban rights-of-way as valuable public space for the health, safety, and welfare of all their users.

L'aménagement urbain - Contribution à la reconnaissance d'une notion juridique / Urban development – Contribution to the recognition of a legal notion

Dans le cadre des enjeux actuels du droit à la ville et à la qualité de vie, l'aménagement urbain constitue un outil pertinent qu'il convient de façonner en ce sens. Notion pivot de l'urbanisme opérationnel, aucune définition complète ne figure pourtant dans les textes, et les multiples références à l'aménagement dans l'ensemble des branches du droit n'ont fait qu'embrumer davantage les contours de l'aménagement urbain. L'étude du code de l'urbanisme, des débats parlementaires et de la jurisprudence conduit à désigner l'opération d'aménagement urbain comme sa matérialisation concrète. Distinct de l'aménagement du territoire et transcendant la frontière public-privé, l'aménagement urbain désigne les opérations de travaux visant un projet urbain d'intérêt général portant sur un quartier ou du moins sur un lieu de vie. Elle constitue dès lors un instrument local de choix au service de la qualité de vie. C'est pour cette raison qu'un régime juridique de droit commun, qui serait applicable à toute opération d'aménagement urbain, doit être élaboré. De sa conception à sa réalisation, ce régime permettrait de concilier les considérations purement économiques de cette activité avec les exigences modernes de garantie d'un cadre de vie de qualité. / In the context of current issues pertaining to the right to the city and to quality of life, urban development is a relevant tool which should be adapted. As a pivotal notion of operational urban planning, no complete definition yet exists for urban development. Furthermore, the multiple references to development in corpus juris obfuscate the notion. After examining the code de l’urbanisme, parliamentary debates and case law, it is evident that urban development operation should be considered as the materialization of urban development. Distinct from land settlement operations and overcoming the public-private border, urban development can be defined as works of general interest focused on a district or at least a place of life. Consequently, it represents a local tool appropriate to quality of life, which is why general regulations, applicable to every urban development operation, must be elaborated. From conception to realisation, these regulations make it possible to reconcile strictly economic parts of this activity with the modern requirements of a quality living environment.

O direito urbanístico como instrumento de equilíbrio entre a função socioambiental da propriedade e o direito à propriedade privada

O presente trabalho tem por objetivo apresentar o direito urbanístico como instrumento de equilíbrio entre a função socioambiental da propriedade e o direito à propriedade privada. Sendo assim, a aplicação do direito urbanístico busca disciplinar o uso e a ocupação do solo, por meio de instrumentos capazes de impor limitações ao direito de propriedade, superando a ideia da propriedade como um direito absoluto titularizado pelo indivíduo, dando lugar ao atendimento da função socioambiental da propriedade privada. A função socioambiental da propriedade privada busca uma sociedade mais igualitária, menos desequilibrada, na qual o acesso à propriedade e o uso que se faz dela sejam orientados no sentido de proporcionar ampliação de oportunidades a todos, e garantir o desenvolvimento das cidades, a partir da implantação do planejamento. Nesse sentido, o planejamento está condicionado à elaboração dos planos, a qual se dá pela interdisciplinaridade de profissionais envolvidos na elaboração dos mesmos, bem como pela participação da população e de associações representativas em audiências públicas para a aprovação do plano. A efetiva aplicação do instrumento de planejamento garantirá o desenvolvimento integrado e harmônico das cidades, o bem-estar da comunidade, a preservação e o equilíbrio do meio ambiente. In this direction, planning is conditional to plans elaboration, which happens through the involvement of professionals in its elaboration, as well as, for e population and representative associations participation in audiences to approve plans. The effective application of planning instrument will guarantee integrated and harmonic development of cities, well-being of community, preservation and environment balance. For that, city´s project must condition social, ambient, economic, aesthetic and functional practices, becoming cities a space of living and coexisting.
