Assessing Vulnerability in Households and Communities Involved in Fisheries Sector Activities

Global fisheries are in decline in response to intense pressure to feed a growing world population. Many of the world’s fisherpeople live in poverty and suffer disproportionately from this threat to global fish stocks due to competition for resources among other stressors. In recent years the Vietnamese government has encouraged small-scale aquaculture production for economic development and to mitigate declining fisheries livelihoods. Using data from the 2013 Vietnam Transitions Survey this paper examines different measures of household vulnerability to the declining fishery and the resulting uncertain economic future. Analysis reveals that the most vulnerable group among survey participants are those who depend primarily on extensive aquaculture for their household income. Despite the frequency of disease in fish, intensive aquaculture remains an attractive livelihood activity. Households are theoretically willing to face increased risk in exchange for greater prosperity, but are typically unable to do so due to cost-related barriers to entry.

Tato analýza je využita ke zhodnocení vývoje jednotlivých vietnamských regionů a vyslovení závěrů o regionální diferenciaci. Část práce je věnována ekonomickým vztahům České republiky a Vietnamu.

The Role of Values in the Intercultural Adaptation of Canadian Expatriates in Vietnam: An Integrative Approach

This study takes an integrative approach to intercultural adaptation by looking at the role of values (i.e. social norms) in the acculturation of Canadian expatriates living in Vietnam. By viewing intercultural adaptation as a process by which expats and host-members “establish (or re-establish) and maintain relatively stable, reciprocal, and functional relationships” (Kim, 2001, p. 3) with their environment, this study focuses on moments of apparent ambiguity, misunderstanding or malaise experienced by expats in their host-community. This emphasis will enable us to better understand how expatriates make sense of their values and social norms during these instances. This research not only sheds light on the ways in which expats make sense of their values, but also how their narratives and stories participate in creating, constituting, and cultivating certain figures during their intercultural adaptation process. The data gathered reveals that the ways in which expats make sense of their values during moments of malaise with their host-community varies quite meaningfully depending on various situational, institutional and personal factors at play during each interaction, as well as what matters most to expats during those moments. Thus, these findings assist in showcasing that misunderstandings experienced in the host-community are complex, as expats consider many factors in order to make sense of, respond to, and adapt to each individual situation.

The Recognition and Enforcement of Foreign Arbitral Awards in Vietnam

This dissertation delves into the subject of recognition and enforcement of foreign arbitral awards in Vietnam with an emphasis on the comparison with German law and judicial experience. Chapter I draws a broad picture of the development of arbitration law in Vietnam from the feudal period to the modern day. In this regard, various modern legal instruments enacted by the Vietnamese authorities, such as Decree 116/CP, the Ordinance of 2003 and the Arbitration Law of 2010, have been taken into detailed account. Not only written statutes but also case law, comprised of a wide range of situations where such legal instruments have been applied, are closely analysed and deliberated. Chapter II focuses on the core issue of research of the dissertation. The in-depth discussion of the recognition and enforcement of foreign arbitral awards in Vietnam begins with a brief depiction of the history of the matter through an analysis of assorted legal instruments, including the Ordinance of 1995, the Civil Procedure Code of 2004 (amended in 2011) and the Civil Procedure Code of 2015, as well as the case law of the Vietnamese jurisdictional courts. Thereby, specific features relating to the recognition and enforcement of foreign arbitral awards are carefully discussed based on a comparison between the Vietnamese and German statutes and case law.
