No. of bitstreams: 2 license_rdf: 0 bytes, checksum: d41d8cd98f00b204e9800998ecf8427e (MD5) Tese_VerticalizacaoImobiliariaControle.pdf: 2978630 bytes, checksum: c954c07a32ea77f50a04817d146dbde7 (MD5) Previous issue date: 2017-05-16 / Esta tese visou compreender o processo de verticalização imobiliária na mancha urbana do Município de Belém (PA) e sua correlação com o instrumento jurídico-urbanístico da Outorga Onerosa do Direito de Construir (OODC), que pode auxiliar as municipalidades na relevante tarefa de ordenar o uso e a ocupação do solo e do espaço urbano, bem como, promover de modo mais equitativo a distribuição dos benefícios e ônus oriundos do processo de urbanização. A pesquisa, de natureza qualitativa, utilizou-se da técnica da Análise do Discurso, na qual o corpus de pesquisa foi constituído por argumentos contidos nas entrevistas com os agentes discursivos capazes de influenciar na configuração do espaço urbano, assim como, por enunciados constantes em reportagens sobre a verticalização e a OODC veiculadas nos dois e mais importantes jornais impressos da cidade. Por intermédio da análise dos diferentes discursos, considerando-se, inclusive, as entrelinhas dos argumentos emitidos, foi possível identificar, segundo o contexto interpretativo, as diferentes concepções acerca do processo de planejamento do desenvolvimento municipal, em especial, sobre o processo de verticalização e da aplicação da OODC pela municipalidade. Ademais, a metodologia viabilizou identificar as convergências e as divergências discursivas, os conflitos existentes entre os diferentes agentes discursivos, as ideologias por eles veiculadas, o jogo de poder inerente à configuração espacial urbana e as recorrências discursivas. Dentre as conclusões alcançadas com esta tese, a análise dos discursos permitiu constatar que em Belém, atualmente, está em curso uma espécie de aliança não-institucionalizada firmada entre os promotores imobiliários e o Poder Executivo municipal em favor de uma concepção de planejamento do desenvolvimento urbano que inviabiliza a garantia ao direito à cidades sustentáveis prevista no Estatuto da Cidade (BRASIL, 2001), ou seja, tais agentes discursivos emitem argumentos em favor de um paradigma que é nitidamente antidemocrático, segregador, injusto e insustentável, resultando, em especial, na inefetividade da Outorga Onerosa do Direito de Construir em Belém. Ademais, também ficou patente que a ausência de aplicação do instrumento urbano-ambiental em comento, também é justificada pelo inexpressivo poder de organização da Sociedade Civil que, por consequência, resulta em um frágil e tímido poder de mobilização social e de pressão política em favor de um modelo de desenvolvimento socioespacial sustentável no Município de Belém. / This thesis aimed to comprehend the process of real estate verticalization in the urban area of Belém (PA) and its correlation with the Onerous Building Right (OODC), a legal instrument which can assist the municipalities to order the use and occupation of the cities space, as well as to promote an equitable distribution of it benefits and burdens arising from the urbanization process. As methodology, it is provided a discourse analysis, by interviewing the social agents responsible for the urban space distribution and its decision making process, with the aid of the available data, mostly collected from the local press. With the discourse analysis it is possible to capture the different understandings of the local development planning process, specially the verticalization process and OODC enforcement by the municipality. As a result, it was possible to identify the discourse convergences and divergences, the conflicts among different social agents, their ideology and the decision making power game shift inherent to the space urban configuration. Among the conclusions reached with this doctoral thesis, the analysis of the discourses showed that in Belém, a kind of non-institutionalized alliance signed between real estate developers and the municipal executive branch in favor of a conception of urban development planning that makes impossible the guarantee of the right to sustainable cities foreseen in the City Statute (BRASIL, 2001), that is, such discursive agents emit arguments in favor of a paradigm that is clearly antidemocratic, segregating, unjust and unsustainable, resulting, in particular, in the ineffectiveness of the Onerous Building Right in Belém. In addition, it was also clear that the lack of application of the urban-environmental instrument in question is also justified by the inexpressive power of organization of civil society which, as a consequence, results in a fragile and timid power of social mobilization and political pressure in favor of a model of sustainable socio-spatial development in municipality of Belém.
