No. of bitstreams: 1 André Luiz Paes de Almeida.pdf: 981068 bytes, checksum: b21e3f153843f65ba956ca8b7c159768 (MD5) Previous issue date: 2017-02-20 / The present study is based on the historical analysis of Labor Law and the concept of work and its social impact throughout the time, mainly in Brazil, transiting the guiding principles of the discipline especially those that are strictly related to the theme proposed here which are: principle of protection and principle of continuity.A critical examination was made of the world economic scenario and its impacts on the economic market and labor relations to demonstrate that not only the employee has felt such consequences, but also the employer which is facing a critical situation marked by the inability to keep its costs active, due to the reduced capacity of consumption of the population.Having outlined this scenario, we proceeded to the examination of some solutions, such as: the flexibilization of labor standards and the implementation of the Voluntary Disengagement Program suggested by some companies.So excruciating is the proposed subject that the discussion reached the Federal Supreme Court.Finally, we analyzed the judgment of the Supreme Court in the face of all that had been studied: principles, workers' guarantees, involvement of the Public Prosecutor's Office and Union and other precedents in the line of the VDP / O presente estudo parte da análise histórica do Direito do Trabalho e do conceito de trabalho e seu impacto social ao longo do tempo, sobretudo no Brasil, transitando pelos princípios norteadores da disciplina, principalmente aqueles que guardam maior relação com o tema aqui proposto, quais sejam: princípio da proteção e princípio da continuidade. Fez-se um exame crítico sobre o cenário econômico mundial e seus reflexos no mercado econômico e nas relações de trabalho, para demonstrar que não somente o trabalhador tem sentido tais consequências, mas também o empregador, que vê-se diante de um quadro crítico marcado pela incapacidade de manter seus custos ativos, em razão da reduzida capacidade de consumo da população. Tendo delineado este cenário, passamos ao exame de algumas soluções, quais sejam: a flexibilização das normas trabalhistas e a implantação do Programa de Desligamento Voluntário sugerido por algumas empresas. Tão tormentoso é o assunto proposto que a discussão chegou ao Supremo Tribunal Federal. Analisamos, por fim, o julgado pelo Supremo, diante de tudo o que fora estudado: princípios, garantias dos trabalhadores, envolvimento do Ministério Público e Sindicato e outros precedentes na linha do PDV
