Inaction in Proceedings before the Administrative Authorities - abstract The dissertation thesis deals with the issue of inactivity of administrative authorities in proceedings before them, which from the point of view of legal doctrine and application practice represents the most widespread form of inactivity in public administration. It can be considered as one of the most serious negative phenomena in public administration and its execution. Public administration is primarily seen as an executive (active) activity aimed at fulfilling its tasks set by or based on the legal order and carried out within its limits. As a rule, both legislation and scholarly literature contain material concerning public administration activities and their forms. The issue of inactivity often remains neglected, while in application practice it is a relatively common undesirable phenomenon, which the addressees of public administration encounter relatively often. The dissertation thus represents another source of reflection on this topic. The author interconnected two levels - theoretical and application, which allowed him to examine the issue of inactivity of administrative bodies in a broader context. Duty to Publish Information (Abstract) I chose as my topic the obligation to publish official records, its legal grounds and connections with other areas. The analysis includes practical aspects and takes into account rapid changes in technology and the much slower development of ad- ministrative law institutes. In this frame I wanted to develop a procedural plan to make the public authority fulfill its duty to publish information, using legal means. I chose as my topic the duty to publish records, since I believe it to be the easist, most economical and effective way to make public records available to the citizens. This is currently a hot political topic, since new legislatation is being prepared in this area both in the Czech Republic and in the European Union, which is a response to the rapid technological progress. Nevertheless, the jurisprudence has devoted much less attention to the obligation to publish information than to disclosing the records upon a request to an individual. The thesis is divided to introduction, theoretical part, practical part and conclusion. The electronic game business can not develop well as other emerging industries. Through the analysis by the five major frameworks of administrative law, it is that our society always be not trust about the electronic game shop which cause corruption and crime. However, even the government see the economic adventure of the electronic game business to promote development by raising the important policy of the Six Key Emerging Industries including the electronic digital game business development, that want to come up with Japan and Korea. But it ignore the electronic game shop, that the people still feel no good about it. The local governments also avoid it to follow the public opinion. In addition, the central government seem to have no feeling about the local problems of the electronic game business. Though our government want to improve the policy of the management through the history of the electronic game management, but the solution is temporary not permanent, so it is not enough about the management system. By the research, we can find that enduring the electronic game will reduce the development and employment opportunity, and it will cause more serious society problems. So the government should give judicious guidance according to circumstances, reasonable and efficient management. In this way, the electronic game business will be not only a leisure tool, but also an industry with more economic value. A Study of Legal System of the Free Independent Traveler Program for China

In terms of the ¡§basic principles¡¨ of the Free Independent Travelers program(FIT), we need to notice that it is the very first and fresh contact in the cross-straits with the friendliest cooperation. With the change that given by FIT to rebuild the mutual trust between two nations, instead of labeling the ¡§evil nature¡¨ on the people from mainland, the government should remove the discriminative norms and regulations from FIT immediately. In the perspectives of the Constitution and the International Covenant on Civil and Political Rights of UN, the right for people to have the freedom of mobility should be safeguarded. Internally, the authority should be delegated to local governments to enhance the potential benefit from few private and affluent enterprises and Taiwan-based business in China to the local economy with a greater profit. From the aspect of ¡§organization,¡¨ shortening the administrative process is the priority to reduce unnecessary red tape. Ma¡¦s administration attempts to establish offices in different fields in the cross-straits by ¡§building blocks¡¨; however, a more ¡§comprehensive¡¨ service organization is more needed based due to the reality. If this kind of organization can be set up in the important cities in China, FIT applicants can apply the grogram, including ¡§application, submission and receiving certifications¡¨ by a single window. It can not only reduce the cost and the possibility to be exploited for applicants, but it also can force the government to eliminate transferring the unnecessary risk of the possibility for Chinese travelers¡¦ staying illegally to the tourism industry in Taiwan. In relation to ¡§authority,¡¨ the policy should incline to ¡§soft law¡¨ for promoting FIT with ¡§management¡¨ rather than ¡§protecting with strictness.¡¨ If there is a conflict between authority and basic principles, related administrative problems may be even harder to be processed, let alone putting effectiveness of organizations into full play. Regarding to ¡§remedy,¡¨ a comprehensive arbitration mechanism, or an integrated system of mediation for dispute and remedy, is a must for FIT. From the premise of a mutual consensus to make it work effectively, instead of post-incident remedy, pursuing the quality of travelling by ¡§risk management¡¨ is more important. After all, the remedy in current society is so limited that it only covers the mediation for the dispute of product consumption and purchasing. In terms of ¡§supervision,¡¨ related source of law should be made by ¡§legislative sector,¡¨ so that an ¡§internal controlling¡¨ mechanism can be set up while part of the legal system is unable to be intervened by non-executive power, including president¡¦s power. Moreover, the set up of this mechanism should imitate the evaluation for universities. Professional scholars should be invited to do the evaluation, and by way of selecting random case or lot drawing, the power of the president can be redressed. Based on the divisions of responsibilities between administrative and legislative sectors, the ¡§interior controlling¡¨ role that the Congress plays, still, should not infringe the executive power of legislative sector. Nevertheless, it should reinforce practical supervision and identify what the object should be. From the aspect of ¡§exterior controlling,¡¨ an unofficial and professional organization should be established, so as to assist the integration of a comprehensive plan and supervision assessment. The pressure that media puts on the government is limited, not to mention correcting exterior supervision instantly; however, if the assessment can be submitted to Legislative Yuan from time to time, it might leave pressure to the administrative sector, so that the problems can be redressed.

Thesis (DTh)--University of Stellenbosch, 2007. / ENGLISH ABSTRACT: This dissertation addresses the functioning of the Seventh-day Adventist Church in South Africa and the disillusionment and alienation of its members. Its aim is to uncover what the key factors are in the administrative functioning that has contributed to the disillusionment and alienation of the rank and file from the administration of the church. It gives particular attention to five aspects of administration: administrative authority, leadership, power, transition, and organizational structures. The objectives of the study are multifaceted. It wants to sensitize and make the Conference and Union administrations aware of the issues that separate them from the rank and file in the church, and how that the present challenges can be solved on a broad consultative basis. Furthermore, the study wants to make recommendations as to how broader representation can be established. Importantly, the study wishes to help the SDA Church administration to maintain a healthy balance between the church as institution and the church as organism. The study is basically exploratory as it seeks to explore the social phenomenon between the administrative functioning and the grassroots of the church for the reason of gaining insight as well as to explain the reason for its existence. It is also hermeneutical in nature as it seeks to establish a proper understanding of the interrelatedness between the administrative functioning and the laity in the church. Empirical enquiry is an important aspect of the study as it employs structured interviews with church boards and survey questionnaires to pastors in order to establish quantitative and qualitative aspects of the study. The study made use of a practical-theological methodology. The methodology is a hermeneutical sensitive and correlational dialogue that brings different theological parameters into dialogue with the realities of practice of ministry and the world. Chapter one introduces the study. It outlines the various dimensions of the study. Chapters two and three are historical. It deals with the present reality and the identity of the church using literary sources. Chapter five deals with the empirical research and gives a description of the views of ministers and the church boards concerning the five aspects of administration of the church, which has been researched. Chapters four and six deals with the theoretical-theological aspects of the study. Chapter four deals with the tension that exists between the church as institution and the church as organism. Chapter six is a theological evaluation that seeks the will of God or His guidance in terms of the problem which the church faces. Chapter six describes the way forward by making recommendations and gives some strategies that can be used to realize the goals of the study and the church. / AFRIKAANSE OPSOMMING: Hierdie verhandeling ondersoek die denominasionele etos en die administratiewe strukture van die Sewendedag Adventistekerk in Suid-Afrika. Die studie toon aan dat daar ontnugtering en vervreemding by die gewone lede van die kerk ten opsigte van die administratiewe strukture bestaan. Dit gee aandag aan vyf aspekte van administrasie: administratiewe gesag, leierskap, mag, oorgang en organisatoriese strukture. Die doelstellings van die studie is veelvoudig. Dit poog om die Konferensies en die Unie-administrasies sensitief te maak van die strydpunte wat hulle verwyder van die gewone mense in die kerk. 6. SUMMARY The purpose of my thesis is to describe the administrative organization in the People's Republic of China. The reason for my research is the growing interest resulting need for its introduction to the public. The thesis is composed of five chapters, each of them dealing with different aspects of Chinese administration. Chapter One is introductory and in its first subdivision it depicts the methodology used in the process of my research and also defines basic rules for translations of terminology used in the thesis. The second subdivision addresses the issue of literature and sources used in this thesis. Chapter Two introduces the geography, population and territorial divisions of China. The next chapter is subdivided into six parts. Part One specifies the Chinese legal culture, while the second part provides an overview of the legal development in the 20th century. Part Three investigates the legal and political system of nowadays China. Part Four depicts and explains the bodies of state power, while the next part introduces the Chinese Communist Party, which in fact is the main authority when discussing the state power in China and the most important decision-making body. La régulation de la communication audiovisuelle en France et en Corée du Sud

Dans le contexte de la convergence, où une seule « plate-forme » est capable de fournir toutes les formes de communications possible, se pose la question de la fusion des organismes de réglementation distincts qui régulent, d’une part la communication audiovisuelle, d’autre part les télécommunications. C’est ainsi que fut créée une nouvelle institution par la loi n° 8867 du 29 février 2008 relative à la gestion et à l’installation de la Korea Communications Commission (KCC) en remplacement les deux autorités de régulation préexistantes qui dirigeaient l’audiovisuel et la télécommunication. Parallèlement, en France, depuis 2007, suite au rapport du sénateur Bruno RETAILLEAU, les pouvoirs publics se sont positionnés en faveur d’une éventuelle fusion à terme entre le CSA et l'ARCEP, la fusion de ces deux autorités de régulation permettant la gestion de l’audiovisuel et de la télécommunication par une même autorité de régulation. Pour autant, un tel projet de réforme n’est pas encore à l’ordre du jour et laisse de nombreuses questions en suspend, questions que la fusion coréenne n’est justement pas parvenu à répondre. Entre un système coréen qui joue le jeu de la convergence, sans pour autant que soit garanti l’indépendance du régulateur vis-à-vis du pouvoir exécutif, et un système français, garantissant autant ce faire se peut cette indépendance, tout en maintenant une séparation de la régulation de la communication audiovisuelle et des télécommunications, on peut s’interroger sur l’opportunité de chacun des deux régimes et sur le modèle le plus performant pour assurer la régulation du secteur de la communication audiovisuelle, tout en préservant la liberté de la communication, liberté fondamentale essentielle pour nos démocraties / In this convergence environment, only the « plate-forme » could be supply all of the communication formats. We wonder a question about the organization meltdown of the regulation, in the one side, the audiovisual communication and in the other side, the telecoms sector. Thus, a new institution has been created by the 29th February 2008 law n°8867 in matter of the setting and the management of the Korea Communications Commission (KCC) in place of the two preexisting regulation authorities whom run the audiovisual communication and the telecoms. In the same time, since 2007 in France, in consequence of the Senator Bruno RETAILLEAU report, the authorities took one’s stand for a possible fusion between The CSA and the ARCEP. This meltdown shall allow managing the audiovisual communication and the telecoms by the same regulation authority. However, this reform proposal is not still in the agenda, and raises new issues those even the Korean merger was not able to answer. Both the Korean system which runs with the convergence without a guarantee of the regulation independence in front of the State power, and the French system who guaranteed as possible this independence by separating the audiovisual communication regulation from the telecoms. We wonder on the appropriateness of the two systems, and which is the best performing to run the audiovisual communication regulation, to guarantee the independence of communication and the fundamental liberties which rule our democracies

Sedan Internet förändrade hur världen kommunicerar har den teknologiska utvecklingen i dess kölvatten och i synnerhet de sociala medierna inneburit ett paradigmskifte i vår vardagliga kommunikativa verklighet. Även organisationer har hakat på utvecklingen. Men för många råder ovisshet om hur sociala medier påverkar deras verksamhet. I synnerhet våra svenska myndigheter som har att förhålla sig till offentlighetsprincip, yttrandefrihet och ett genomgående medborgarperspektiv. Mot denna bakgrund ville vi undersöka hur sociala medier påverkar arbetet med samhällskommunikation inom en kommunal förvaltning. Vi har därför gjort en kvalitativ studie av en kommunal förvaltning inom Kalmar kommun genom att intervjua de som arbetar med Facebook samt deras ledning. Våra huvudteorier är hämtade från Kent Asp, Jürgen Habermas och John B. Thompson. Vi har kommit fram till att Facebook är en samlingsplats för flera olika typer av interaktion med möjlighet till dialogisk masskommunikation genom nätverk. Medieinnehållet är ett konstant flöde av främst fatisk kommunikation men som för en myndighet öppnar för effektiv kriskommunikation. Informatörsrollen blir mer strategisk och medborgardialogen decentraliserad genom ökad kommunikation via Facebook. Sociala medier skapar ett nytt interaktionsfält som förstärker den borgerliga offentligheten och ökar möjligheten till deliberativ demokrati. På så sätt minskar tendensen för en mediekrati och ökar myndighetens makt över massmedierna. / Since Internet changed how the world communicates the technological development that followed and especially the social medias has meant a change of paradigms in our everyday communication. Even organizations have followed the trend, but for many there is an uncertainty about how social media affects their operations. Especially for our Swedish administrative authorities that have to act according to open records, freedom of speech and the citizen perspective. With this in mind we wanted to study how social medias affect the work with communication to society within a municipality. We therefore have made a qualitative study on Kalmar municipality by interviewing the ones who use Facebook as a work tool and their management. Our main theories are from Kent Asp, Jürgen Habermas and John B. Thompson. We have concluded that Facebook is a meeting place for several types of interaction with possibility to have dialogical mass communication through networks. The media content is a constant flow with mainly phatic communication that for an administrative authority opens up for effective crises communication. The public relations officers role becomes more strategic and the dialogue with the citizens becomes decentralized through increased communication through Facebook. Social medias create a new field of interaction that enhances the public sphere and increases the possibilities for a deliberative democracy. In that way the tendencies for a mediacracy decrease and the administrative authorities power over media increase.

Its aim is, on the one hand, to describe the features of the concept of the decision of administrative authority according to the Administrative Procedure Code and according to the Judicial Administrative Code. on the other hand to define these concepts from a practical point of view and provide insight into the case law definition of these institutes.
