Resumé The official title of my thesis is Application for an appeal review on the points of law in civil procedure. The main objective of this thesis is to describe the development of an institute of an application for an appeal review throughout the legal history of the civil procedure in the area of the Czech Republic up to current state, with a particular focus on the conditions of admissibility of such application and its essentials. My thesis is composed of three chapters. The first chapter is to introduce the reader to the historical development of an application of an appeal review from the very beginning in the 18th century up to date. In particular, the landmark Constitutional Court decision (sp. zn. Pl. ÚS 29/11) is emphasized in the end of the chapter. The second chapter deals with the actual legislation of an application for an appeal review in The Code of Civil Procedure. Its main goal is to describe this institute as whole. It is also to provide the reader with further analysis of some controversial issues of the actual legislation as the conditions of admissibility of an application and its essentials required by the law. The thesis aims to describe the new regulation of the application for appeal review introduced by means of an amendment to the Civil Procedure Code made by the act No. 404/2012 Sb. and to assess its compliance with the Constitution. During the preparation of this amendment a part of the Civil Procedure Code (specifically sec. 237 (1) c)) governing the admissibility of the discretionary application for appeal review was cancelled due to being in conflict with the Constitution by means of the decision of the Constitutional Court of 21 February 2012, file No. Pl. ÚS 29/11. For that purpose, at first, the thesis deals with the application for appeal review itself and certain aspects of it, especially the role it has in the Czech legal system. Based on this general part a special part is built dealing with the admissibility of the application for appeal review. Firstly, the admissibility under the old legislation is described, after that the conclusions of the Constitutional Court are critically examined and, finally, the new legislation is described and confronted with the findings of the Constitutional Court. This thesis focuses on the effective regulation of the application for an appeal review reflecting it from the point of its value background, historical development and the relevant case-law. With an intention to point out the necessary backing for the critical assessment of specific elements and the present form of the application for an appeal review in a civil procedure as a whole, the thesis deals with the theoretical basis of the legal remedies in the civil procedure and with the role of the application for an appeal review in their effective regulation. In the thesis, particular attention is paid to the purposes of the application for an appeal review, i.e. to the unification of the case-law and the protection of the rights of an individual in a particular case, as far as to their relation to the legal certainty resulting from the final decisions, which the use of the application for an appeal review undermines. The Application for an appeal review in civil court proceedings is an exceptional remedy, which may brought against final decisions of the Court of appeal. Through the application for an appeal review the Supreme Court of the Czech Republic not only corrects the defects of legal decisions of courts of appeal, but at the same time it keeps an eye on the unification of the decision-making practice of the courts of appeal. The legal regulation of the application for an appeal review is contained in particular in the Code of civil procedure, as amended, and its minor styling techniques can be found also in the Act on the special legal proceedings, and in the Act on courts and judges. Due to quite complicated legislation and high procedural demands that are placed on the application for an appeal review, is this extraordinary legal remedy a frequent subject of the decisions of the Supreme and the Constitutional Court, whose conclusions are in many decisions fundamentally distinguishing. These contradictions in such conclusions often makes legal regulation of an application for an appeal review even less transparent. This master´s thesis is concerned in problematic of data searching on the Internet which is very actual. It focuses mainly how centralized, decentralized and hybrid searching work. This paper also compares advantages and disadvantages of these methods and describes principles and syntaxes of most-used search engines. Possibilities of use intelligent search agents are shown here as well. The practical part of this thesis is dedicated to development and testing of specialized application for searching. This program enable user to harvest contacts of companies in accordance to defined key-words and creates database file from obtained contacts.

This thesis is aimed at simulation of auditory space. It describes the most frequently used panning method: Vector Base Amplitude Panning. Also is focused on image source method, which allows computing the parameters of direct sound wave and reflections in rectangular room. This method is compared with ray–tracing method, which is also often used. It deals with the matter of the frequency – dependent absorption of materials in reflection of the sound wave against the wall. On the basis of these information two applications were designed in MATLAB development environment. The first one allows the simulation of auditory space. The other one is the application for sound source panning by its azimuth and distance.

This study presents a web-based database application for storing experimental data and related documents at a single location and sharing them among researchers and engineers from all over the world. The database application, accessible from a website was developed for experimental structural engineering researches, and initially tested at Structural and Earthquake Engineering Laboratory of Civil Engineering Department, METU. The application is composed of two parts. The first part is the database that stores information about projects, specimens, experiments, experimental data, documentation, site members, and member groups at the server side. The second part is the website that provides a functional user interface for easy use of application and providing accessibility from everywhere via internet. After the development of the database and the website, these two parts were attached to each other and application functionalities that enabled users to create, modify, search, and delete projects, specimens and experiments / allowed users to upload/download documentation and experimental data / provided abilities to users to plot test data and share their opinions were ensured. ASP.NET framework and C# programming language was utilized for the web application development. Functionality and usability of the database application was then tested by uploading and sharing various experimental results.

[pt] Com o crescimento tecnológico temos visto uma popularização crescente de equipamentos de localização por satélite (receptores GPS) e computadores de bolso (PDA) em diversas áreas: nos transportes aéreo, marítimo e terrestre, mapeamento e geoprocessamento, esporte e lazer. Onde podemos ver, como exemplo, praticantes de caminhadas adquirindo seus próprios receptores GPS. No meio militar, esta popularização também crescente, onde as Forças Armadas de diversos países tendem a adquirir cada vez mais equipamentos de posicionamento por satélite (receptores GPS) e testam equipamentos para interação com os mesmos. O foco deste trabalho a integração do receptor GPS e PDA visando sua utilização em operações militares, com intuito de obter respostas rápidas para um emprego mais eficiente e rápido de frações das tropas envolvidas. Este trabalho envolve a geração de arquivos legíveis aos PDA, a comunicação de receptores GPS com estes, bem como a visualização da informação fornecida por estes receptores de forma fácil e rápida. Abrange também uma comparação entre a utilização de mapas em duas diferentes representações raster e vetorial, possibilitando zoom e movimento da imagem em ambos, além da possibilidade de medir distâncias entre pontos do mapa na tela do PDA e inclusão, exclusão e alteração de observações diversas. Verificou-se a grande vantagem da utilização de imagens raster em relação utilização de imagens vetoriais no PDA para esta finalidade, e também algumas fragilidades do uso de PDA comuns em operações militares e com receptores GPS de usos gerais. / [en] With technological development, we have been witnessing a growing popularization of satellite-location equipment (GPS receivers) and pocket computers (PDA) in several areas: air, sea and earth transports, mapping and geoprocessing, sports and entertainment. We can see hikers, for example, acquiring their own GPS receivers. In the military environment, this popularization is also occurring: the Armed Forces in several countries are obtaining increasing numbers of GPS receivers and are testing equipment to interact with them. The purpose of this work is to integrate GPS receivers and PDAs, with the intention of employing them in military operations in order to obtain quick responses for a faster and more efficient use of fractions of involved troops. This work involves the generation of files readable by PDAs, the communication of GPS receivers with PDAs, and an easy and fast visualization of the information provided by the receivers. It also includes a comparison between the use of maps in two different representations, raster and vector, both allowing for zooming and movement of the image, as well as the possibility of measuring distances between points of the map in the PDA screen, and the inclusion, exclusion and alteration of several observations. The great advantage of using raster images instead of vector images in PDAs for this purpose was verified, as well as some disadvantages in the use of PDAs, common in military operations, with general-purpose GPS receivers.
