O direito à privacidade evoluiu juntamente com a mudança histórica de um Estado Liberal para um Estado Social. Sua compreensão, que partiu de um enfoque negativo, o direito de estar só, agregou um enfoque positivo, que compreende a exigência de ações concretas para sua efetividade.
