The Studies in Liability and Compensation for Breach of Contract of International Sale of Goods in China

Since the reform and opening up in mainland China from 1978, there is quite a dazzling performance in international trade, it has replaced Japan as the world's third largest trading nation in 2004. She has continued to maintain our largest export market and largest source of trade surplus position. Thus, there is a new term called¡yChiwan¡z, that is, China plus Taiwan ,which Will form a new emerging economies of Asia. Contracts of international sale of goods transaction as a starting point and core. People who contracting a contract with the contracting parties intend to make the realization of their own interests. Whereas a party breaches of contract may make the other party's interests had not been achieved . Compensation for breach of contract is the most common and important method of bearing civil liability now, while damages can be considered as the most important one among those forms of compensation. As a bridge between jurisprudence and practice of compensation for breach of contract, the scope of compensation could be regarded as the core of compensation for breach of contract to certain extent.

Studenters upplevelser av psykologiska kontrakt i sina extraarbeten

Extraanställning bland heltidsstudenter har blivit alltmer förekommande i dagens samhälle. Syftet med denna studie var att undersöka uttalade och outtalade förväntningar som heltidsstudenter har på sin arbetsgivare, samt vilka konsekvenser det kan bli av eventuella psykologiska kontraktsbrott. Det genomfördes 10 semistruktuerade intervjuer med studenter som har en extraanställning. Intervjuerna tematiserades där 5 centrala teman identifierades: engagemang och ansvar i utbyte mot högre lön, ömsesidig förståelse, gemensamma sociala aktiviteter, rättvisa kring förmåner samt stöd och återkoppling från chef. Resultatet visade bland annat att deltagarna förväntar sig att få bättre betalt när de engagerar sig i arbetet, samt att få vara mer delaktiga vilket kan gynna deras sociala kontaktnät. Utifrån tidigare forskning kunde det argumenteras att studenterna huvudsakligen innehar psykologiska kontrakt av transaktionell karaktär än relationell. Det diskuterades även att deltagarna finner en acceptans vid eventuella psykologiska kontraktsbrott vilket författarna argumenterar bero på studenternas medvetenhet om skillnader mellan extraanställda och heltidsanställda.

This dissertation deals with how the subject matter of performance under a contract for work is defined and issues related to formulating the rights and obligations ensuing therefrom. At the same time, it seeks common legal sources existing across national laws which provide definitions thereof. It attempts to find a common definition of contracts for work and how they differ from other similar contracts. It further defines some common basic features and problems related to contracts for work which apply in international trade or in cases where parties decide to formulate their contract by reference to international contract conditions. In that context, it primarily refers to construction contracts as the most common type of contract for work in international trade. At the same time, it focuses on the possible consequences of a breach of contract and emphasizes some parties' claims ensuing therefrom. Moreover, this work examines the definition of work defects and conditions for asserting claims as a specific topic, which relates to the definition of the subject matter of a contract for work and its basic features.
