La réforme du droit chinois du transport maritime de marchandises / The reform of the chinese law of carriage of goods by sea

Le transport de marchandises par mer constitue de nos jours un pilier du commerce international et l’un des principaux moteurs de la mondialisation. De ce fait, le droit du transport maritime de marchandises, en tant qu’élément déclencheur du droit maritime, reste toujours la discipline essentielle dans ce domaine. En raison du développement de la technologie de construction des navires et des modifications des modalités de l’exploitation maritime, les normes en vigueur, relatives au transport maritime, se trouvent confrontées aux changements évolutifs dans la pratique. Tout spécifiquement, en raison de l’absence d’une tradition à ce propos, le droit chinois s’est inspiré inévitablement des normes internationales, quant à son développement. À l’heure actuelle, la question qui se pose ici est de savoir s’il convient d’introduire de nouveaux instruments, et en particulier les Règles de Rotterdam, dans le processus de modernisation du droit positif chinois ? L’étude menée vise à présenter quelques avis de recommandation, proposés pour la réforme du droit chinois du transport maritime de marchandises, vis-à-vis les Règles de Rotterdam. Dans le cadre d’une économie mondialisée, la modernisation du droit positif chinois, et surtout en matière maritime, devrait se développer dans les directions suivantes : d’une part la participation et l’intégration au système international, et de l’autre la reconnaissance de sa particularité au sein de la législation / The carriage of goods by sea constitutes at present time a pillar of international trade and one of the principal engines for the globalization. For this reason, the law of the carriage of goods by sea, being as the primary trigger for the maritime law, remains always its essential position in this domain. Due to the technological progress in the construction of the vessels and to the changes of the operational mode of maritime exploitation, the relevant laws in force are confronted with progressive transformation in practice. Particularly in relation to the Chinese maritime law, because of absence of the tradition in this regard, it has been inspired inevitably by the international norms, with respect to its development. At the current time, the question here is whether to introduce some new instruments, and in particular the Rotterdam Rules, in the process of modernization of Chinese positive law ? The present research is intended to provide some recommendation notices, proposed for the reform of the Chinese law of carriage of goods by sea, vis-à-vis the Rotterdam Rules. In the context of a worldwide economy, the modernization of the Chinese positive law, and especially in terms of maritime law, should be deployed with the following sprits: the participation and the integration to the international system on the one hand, and the recognition of its particularities in the course of the legislation on the other hand

This master's thesis covers the construction analysis of an escalator by the Otis a.s. company and the conception of its modernization called "In-truss".This type of modernization consists in preserving the supporting construction of the 506-type escalator into which the components of newer 506-NCE series are to be built in. Such operation requires modifying the construction and creating adaptors used to anchor the new components to it. These modifications lead to the stress testing of the construction, that is done by using the finite elements method in NX-Ideas software. The thesis contains the design of selected subsystems of the escalator, the stress testing of the new supporting construction and the creation of volume model in CREO-Parametric application for further use.

The work contains a description of the superstructure gauging carriage and measuring system APK, whose data were used to compare the track geometry and its spatial position during the observation period. Conclusion of the work includes an assessement of individual measurements and recommendations for practise.

Neisseria meningitidis är en bakterie som kan leda till invasiv sjukdom eller endast orsaka bärarskap i nasopharynx. Bakterien delas in i olika serogrupper och klonala komplex. Vissa av dessa grupper och klonala komplex förekommer endast hos invasiva isolat och andra bland bärare, vilket tyder på att det finns genetiska skillnader mellan invasiva och bärarisolat. I denna studie undersöktes genen pilE som kodar för PilE proteinet och ingår i bakteriens pili. Proteinet finns i två klasser, klass 1 och klass 2. Metoden som användes för att studera eventuella skillnader i förekomst och uttryck av pilE genen var digital droplet PCR (ddPCR). Både DNA och RNA kvantifierades med ddPCR för att undersöka antalet kopior av pilE genen (DNA) samt dess uttryck (RNA) mellan invasiva isolat och bärarisolat, mellan klass 1 pilE isolat och klass 2 samt fördelning av klasserna i isolattyperna. Principen för ddPCR är att dela ett prov till tiotusentals nanodroppar där individuella droppar genomgår PCR för en senare avläsning av flourescens från prober. Resultatet visade skillnad mellan bärarisolat och invasiva isolat där de invasiva isolaten visade mindre uttryck av pilE än bärarisolat. Klass 2 isolat hade signifikant färre genuttryck än klass 1 isolat och invasiva isolat visade klass 2 i högre utsträckning än bärarisolat. / Neisseria meningitidis is a bacterium that can cause invasive disease or carriage in the nasopharynx. The bacteria are divided into different serogroups and clonal complexes. Specific serogroups and clonal complexes are more frequent or are only found among invasive isolates or in carriage isolates. This study has investigated pilE, a gene that encodes the PilE protein located in the bacteria´s pilin and the protein is found in either class 1 or class 2. digital droplet PCR was used to investigate differences in presence and expression of the gene pilE. Both DNA and RNA was quantified to study the difference in copy number of the pilE gene (DNA) and its expression (RNA) between invasive isolates and carriage isolates but also between class 1 isolates and class 2 isolates. The distribution of classes between the isolate types was also investigated. The ddPCR method divides a sample into thousands of nanodroplets and a PCR reaction occurs in each droplet followed by droplet reading where fluoroscens from probes is measured. The difference that could be seen was that the invasive isolates expressed pilE in lower copies. Class 2 isolates had a significantly lower gene expression than class 1 isolates and invasive isolates expressed class 2 in a higher frequency.

Gait Variability for Predicting Individual Performance in Military-Relevant Tasks

Human movement is inherently complex, requiring the control and coordination of many neurophysiological and biomechanical degrees-of-freedom, and the extent to which individuals exhibit variation in their movement patterns is captured by the construct of motor variability (MV). MV is being used increasingly to describe movement quality and function among clinical populations and elderly individuals. However, current evidence presents conflicting views on whether increased MV offers benefits or is a hindrance to performance. To better understand the utility of MV for performance prediction, we focused on current research needs in the military domain. Dismounted soldiers, in particular, are expected to perform at a high level in complex environments and under demanding physical conditions. Hence, it is critical to understand what strategies allow soldiers to better adapt to fatigue and diverse environmental factors, and to develop predictive tools for estimating changes in soldier performance. Different aspects of performance such as motor learning, experience, and adaptability to fatigue were investigated when soldiers performed various gait tasks, and gait variability (GV) was quantified using four different types of measures (spatiotemporal, joint kinematics, detrended fluctuation analysis, and Lyapunov exponents). During a novel obstacle course task, we found that frontal plane coordination variability of the hip-knee and knee-ankle joint couples exhibited strong association with rate of learning the novel task, explaining 62% of the variance, and higher joint kinematic variability during the swing phase of baseline gait was associated with faster learning rate. In a load carriage task, GV measures were more sensitive than average gait measures in discriminating between experience and load condition: experienced cadets exhibited reduced GV (in spatiotemporal measures and joint kinematics) and lower long-term local dynamic stability at the ankle, compared to the novice group. In the final study investigating multiple measures of obstacle performance, and variables predictive of changes in performance following intense whole-body fatigue, joint kinematic variability of baseline gait explained 28-59% of the variance in individual performances changes. In summary, these results support the feasibility of anticipating and augmenting task performance based on individual motor variability. This work also provides guidelines for future research and the development of training programs specifically for improving military training, performance prediction, and performance enhancement. / Doctor of Philosophy / All people move with some level of inherent variability, even when doing the same activity, and the extent to which individuals exhibit variation in their movement patterns is captured by the construct of motor variability (MV). In a load carriage task, variability measures were determined to be more sensitive to difference in experience level and load condition compared to typical average measures of gait. Specifically, variability increased with load, and the experienced group was less variable overall and more stable in the long term. Lastly, a subset of gait variability measures were associated with individual differences in fatigue-related changes in performance during an obstacle course. In summary, the results presented here support that it may be possible to both anticipate and enhance task performance based on individual variability. This work also provides guidelines for future research and the development of training programs specifically for improving military training, performance prediction, and performance enhancement.

The concerns of the shipping industry regarding the application of electronic bills of lading in practice amid technological change

In the sea trade, the traditional paper-based bill of lading has played an important role across the globe for centuries, but with the advent of advanced commercial modes of transportation and communication, the central position of this document is under threat. The importance of the bill of lading still prevails as does the need of the functions that this document served in the past, although in a changed format. In the recent past, the world has witnessed a lot of debate about replacing this traditional paper-based document with an electronic equivalent that exhibits all of its functions and characteristics, both commercial and legal. More specifically, unlike many rival travel documents, such as the Sea Waybill, a bill of lading has two prominent features, that is to say, its negotiability and its acceptability as a document of title in certain legal jurisdictions that are required to be retained in an electronic bill of lading so as to also retain the prominence of this document in the future landscape. This thesis is, however, more concerned about the legal aspects of adopting the electronic bill of lading as a traditional paper-based legal document as well as an effective legal document in the present age. However, the scope of this debate remains primarily focused on the USA and UK jurisdictions. In the course of this thesis, it is observed that, in the past, the bill of lading has been subject to a variety of international regimes, such as The Hague Rules and The Hague-Visby Rules, and presently efforts are being made to arrive at a universal agreement under the umbrella of The Rotterdam Rules, but such an agreement is yet to arrive among the comity of nations. On the other hand, efforts made by the business community to introduce an electronic bill of lading are much louder and more evident. The private efforts, such as the SeaDocs System, CMI Rules, and the BOLERO Project, etc., were, however, received by the fellow business community with both applause as well as suspicion. At the same time, there are a number of concerns voiced by the international business community on the legislative adoptability in national and international jurisdictions and the courts’ approach in adjudicating cases involving electronic transactions and these are making the task of adoption of electronic bill of lading in the sea-based transactions a difficult task. Therefore, in the absence of any formal legal backing from national and international legislations, these attempts could not achieve the desired results. In this thesis, the present situation of the acceptability of electronic transactions in general, and of the electronic bill of lading specifically, has also been discussed with reference to certain national jurisdictions, such as Australia, India, South Korea and China, in order to present comparative perspectives on the preparedness of these nations. On the regional level, the efforts made by the European Union have also been discussed to promote electronic transactions within its jurisdiction. All the discussion, however, leads to the situation where the level of acceptability of electronic bill of lading in the near future is found to be dependent upon the official efforts from the national governments and putting these efforts towards arriving at an agreement on Rotterdam Rules as early as possible. The other area of importance revealed in this thesis is the need for change in juristic approach by the courts while interpreting and adjudicating upon cases involving electronic transactions. On the whole, this thesis has provided a cohesive and systematic review, synthesis and analysis of the history of the bill of lading, its importance as a document of title, and attempts to incorporate its important functions within the fast-paced electronic shipping commerce of today. In such a way it has provided a valuable contribution to the literature by providing a comprehensive resource for jurists, policy-makers and the business community alike, as they work towards adapting the bill of lading so that it might be successfully applied in electronic form.

Title: Appropriateness of choice to walk or run, depending on the speed of a quick relocation with load carriage Objectives: Comparison of physiological response of organism during the walk and run at speed 6 - 7,4 km.h-1 with carried load 15 kg with follow-up determination of critical speed in connection with economy of these activities where there were discovered sizes of correlation with proportional representation of fat free mass and working length of lower limb. Methods: The method applied in this research was the quantitative research based on intra-individual and inter-individual comparative analysis. Results: Based on the measured data it has been found out that there is a critical speed at 7,43 km.h-1 (±0,53), with respect to economy of walk compared to run with 15 kg load. The average heart rate during the critical speed was 129 BPM (±9,67). The average energy expenditure per minute during the critical speed was 11,9 kcal (±2,04). In addition there were discovered sizes of correlation between critical speed and the working length of lower limb where rP = 0,9203 was statiscitally significant. (α = 0,05) and between critical speed and proportional representation of fat free mass, where rP = 0,1529 was not found to be statistically significant (α = 0,05).
