El consentimiento informado es un documento que debe ser trasladado al
paciente por el médico previo a la realización de alguna intervención quirúrgica,
por lo cual el mismo debe contener toda información relevante sobre el servicio
a contratar. Sin embargo, es común que los especialistas en salud solo informen
al usuario sobre los riesgos inherentes de la intervención médica, pero no los
riesgos reales derivados de la salud y condición actual del paciente. Toda vez
que de informar ello podría generar un cambio en la decisión del consumidor si
someterse o no a la intervención médica.
Por ello, el objetivo del presente trabajo de investigación es la de determinar la
importancia de tener un consentimiento informado que posea información
relevante y que el mismo no se agota con la entrega del documento sino que
requiere la comprensión del contenido por parte del paciente.
Por lo tanto, se concluirá que el consentimiento informado debe adoptar una
mayor similitud a lo regulado en la normativa española, toda vez que ello podría
fortalecer la relación médico-paciente; la tutela de los derechos de información,
salud, seguridad e integridad del usuario; reducir las contingencias por infracción
administrativa al deber de información por parte del proveedor; y que permitiría
la conformación de consentimientos informados personalizados cuya
particularidad sería la de comunicar los riesgos reales de la condición actual de
salud del paciente vinculadas a la intervención médica. / The informed consent is a document that must be transferred to the patient by
the physician prior to the performance of any surgical intervention, so it must
contain all relevant information about the service to be contracted. However, it is
common that health specialists only inform the user about the inherent risks of
the medical intervention, but not the real risks derived from the patient's health
and current condition. This information could lead to a change in the consumer's decision whether or not to undergo the medical intervention. Therefore, the
objective of this research work is to determine the importance of having an
informed consent that contains relevant information and that it is not exhausted
with the delivery of the document but requires the understanding of the content
by the patient. Therefore, it will be concluded that the informed consent should
adopt a greater similarity to that regulated in the Spanish regulations, since this
could strengthen the doctor-patient relationship; the protection of the user's rights
to information, health, safety and integrity; reduce the contingencies for
administrative infringement of the duty of information, and would allow the
creation of personalized informed consents whose particularity will be to
communicate the real risks of the patient's current health condition linked to the

Informe sobre Resolución No. 2365-2018/SPC- INDECOPIValvas Roberto, Manuel Renzo 31 July 2023 (has links)
El presente informe jurídico versa sobre el estudio de la Resolución 2365-
2018/SPC-INDECOPI conforme a las infracciones cometidas a los artículos 2.1,
19, 25 y 67,4 literal c) del Código de Protección al Consumidor – Ley N° 29571
(en adelante, el Código de Consumo), por parte de la Clínica San Gabriel (en
adelante, La Clínica) contra la señora Ana Sofía Gonzales Hurtado (en adelante,
el Consumidor) al brindarle un servicio médico deficiente, puesto que del análisis
del caso se puede desprender que las consecuencias o riesgos de la
intervención quirúrgica, denominada litotricia intracorpórea, no fueron
trasladadas de forma oportuna al Consumidor a través del consentimiento
informado..
En tal sentido, la presente Resolución concluyó que la Clínica generó una clara
afectación al artículo 2.1 del Código de Consumo por no lograr demostrar que ha
otorgado una información clara, sencilla, suficiente, oportuna y veraz al
Consumidor referente al riesgo de ruptura ureteral,, toda vez que la señora Ana
Sofía Gonzales Hurtado se realizó la intervención sin tener claro cuales serían
los riesgos de la operación médica denominada Litotrica Intracorpórea, la cual
desencadenó la pérdida de su uréter y riñón derecho, por medio, de una
nefrectomía. Asimismo, la referida Resolución consideró que no hubo afectación
alguna a los artículos 19 y 25 del Código de Consumo referentes a la prestación
del servicio de litotricia intracorpórea, la cual a criterio de la Sala fue generada
de forma correcta y cumpliendo las medidas de seguridad conforme a los
avances de la ciencia y técnica del momento. / The present legal report deals with the research of Resolution 2365-2018/SPCINDECOPI
pursuant to the violations committed to Articles 2. 1, 19, 25 and 67.4
literal c) of the Consumer Protection Code - Law No. 29571 (hereinafter, the
Consumer Code), by the San Gabriel Clinic (hereinafter, The Clinic) against Mrs.
Ana Sofía Gonzales Hurtado (hereinafter, the Consumer) by providing her with a
deficient medical service, since from the analysis of the case it can be inferred
that the consequences or risks of the surgical intervention, called intracorporeal
lithotripsy, were not transferred in a timely manner to the Consumer through the
informed consent
In this sense, this Resolution concluded that the Clinic generated a clear
affectation to article 2.1 of the Consumer Code for failing to demonstrate that it
has provided clear, simple, sufficient and truthful information to the Consumer
regarding the risk of ureteral rupture, since Mrs. Ana Sofía Gonzales Hurtado
underwent the intervention without being clear about the risks of the medical
operation called Intracorporeal Lithotripsy, which triggered the loss of her ureter
and right kidney, by means of a nephrectomy.
Likewise, the aforementioned Resolution considered that there was no affectation
to articles 19 and 25 of the Consumer Code regarding the provision of the service,
which, at the discretion of the Chamber, was generated correctly and complying
with the security measures in accordance with the advances of the science and
technology of the moment.
