The application of Article 76 of the United Nations Convention on the Law of the Sea on the extended continential shelf, with special reference to MalaysiaTorla, Areej January 2013 (has links)
The purpose of this study was to clarify the ambiguity in the law relating to the extended continental shelf in Article 76 of the 1982 United Nations Convention on the Law of the Sea. Another aim was to study the application of the law in a more focused part of the world, the region of East Asia, and in particular, Malaysia. The study also sought to propose solutions to issues relating to the extended continental shelf. The history of the law relating to the continental shelf, the codification of the law, and the enforcement of the law by the Commission on the Limits of the Continental Shelf is presented. Besides that, Article 76 was also thoroughly discussed in order to identify the problems involved. Besides that, the two biggest issues which determine the outer limits of the continental shelf are examined. These are issues relating to ridges and submarine elevations and the application of the foot of continental slope provisions. The study examined the problems involved with the legal and scientific interface found in Article 76 and addressed them by referring to the legislative history of Article 76, State practice and the practice of the Commission. The continental shelf in the East Asian region is also analysed in order to provide an overview of the continental shelf issues in the region. Special reference to Malaysia is made as a State that has made a submission on its outer limits of the continental shelf. A thorough analysis was made based on the findings made in this study. This study also explored possible solutions to the continental shelf issues discussed.

<p>For many of us, the events of 9/11 served as a violent birth into a new era. In subsequent years, we have witnessed a mechanical vacillation between reaction and revenge in the domain of politics, at a time where terrorism and counter-terrorism are virtually indistinct. September 11<sup>th</sup> was by no means the genesis of xenophobia, but it has been complicit in the production of a global climate where an understanding of xenophobic logic is increasingly relevant.</p> <p>In this thesis, I begin with an analysis of the conceptual anatomy of xenophobia and its relation to ideas of sameness and difference, identity, selfhood, “Otherness” and community. In the second chapter, I provide a taxonomy of xenophobia, differentiating this “exclusive” mode of prejudice from “inclusive” modes. I analyze contemporary manifestations of xenophobia under this framework. In the final chapter, I conclude with an exploration of the manner in which communities may be re-envisioned, in order to avoid identity-essentialism and encourage freedom of action in the political domain.</p> / Master of Arts (MA)

Oscilações subinerciais da elevação da superfície livre do mar na Plataforma Continental Sudeste (PCSE) foram estudadas por meio de modelagem numérica computacional. Os campos atmosféricos utilizados nos experimentos foram obtidos da reanálise NCEP-DOE AMIP II e o modelo hidrodinâmico DELFT-3D Flow foi empregado. A validação dos resultados dos experimentos numéricos foi realizada por comparação com observações. Foram realizadas simulações para o verão de 2003, para o inverno de 2004 e para mais quatro cenários de ventos sintéticos, simulando a propagação de frentes frias climatológicas (obtidas neste estudo). Verificamos que na porção sul (norte) da região passaram 3,6 (2,9) frentes frias por mês durante o inverno e 3,4 (1,3) durante o verão. Esta diferença entre as regiões norte e sul mostrou que alguns eventos não percorreram toda a região, sendo isso mais frequente no verão. A passagem de frentes frias provocou a propagação de oscilações subinerciais da superfície do mar, confinadas junto à costa, com comprimento de onda de aproximadamente 2000 km, duração de 50 h e amplitude média de 0,3 m, tanto no verão quanto no inverno. Nas simulações em que as frentes frias não percorreram toda a PCSE, oscilações subinerciais da superfície do mar também foram geradas e se propagaram para o norte com características semelhantes àquelas geradas pelas frentes frias que percorreram toda a PCSE. As oscilações subinerciais na região norte da PCSE estiveram melhor correlacionadas com a componente do vento perpendicular à costa da região de Paranaguá-Cananéia e com a componente do vento paralelo à costa da região de Imbituba-São Francisco. Forçantes externas à PCSE também excitaram oscilações subinerciais, principalmente com período superior a 7 dias. As oscilações subinerciais com períodos inferiores (superiores) a 7 (9) dias foram geradas desde o extremo sul (ao sul) da Plataforma Continental Sudeste até a região de Cananéia-Paranaguá e contribuíram com cerca de 40% (12%) da variância subinercial. As oscilações subinerciais analisadas tiveram características de Ondas de Plataforma Continental. / The subinertial oscillations of the sea level in the South Brazil Bight (SBB) were studied using computational numerical models. Este trabalho foi desenvolvido dentro do contexto da hidrodinâmica da plataforma continental, com o objetivo de estudar a variabilidade subinercial das correntes no extremo norte na Plataforma Continental Sudeste brasileira. A região de estudo está localizada nas proximidades de Cabo Frio (RJ) e Arraial do Cabo (RJ) (aproximadamente 23º S / 42º W). Apesar de ser uma região bastante conhecida e estudada, em função do fenômeno da ressurgência costeira que ocorre em suas proximidades, pouco se conhece sobre a circulação subinercial nessa localidade. Devido à importância das correntes subinerciais, por serem responsáveis pelo transporte de substâncias dissolvidas ou em suspensão nas águas, tais como sedimentos, nutrientes e poluição, este trabalho tenta contribuir com um maior conhecimento desses campos de corrente, a partir da análise, no domínio do tempo e da frequência, de séries temporais de intensidade e direção das correntes e do vento local. Foram utilizados dados coletados no Projeto DEPROAS (Dinâmica do Ecossistema de Plataforma da Região Oeste do Atlântico Sul) a partir de correntógrafos e ADCP fundeados, numa radial em frente a Cabo Frio, sobre as isóbatas de 50, 100 e 200 m, bem como de uma bóia e de uma estação meteorológicas. Trabalhamos com as séries temporais do inverno de 2001 e do inverno e verão de 2003. A partir desse estudo foi possível verificar que a variabilidade subinercial domina o fluxo das correntes na região, principalmente na direção paralela à batimetria. Como no restante da PCSE, verificou-se um balanço geostrófico na direção normal à topografia, responsável por um fluxo paralelo às isóbatas, em especial na PCM e nas profundidades intermediárias afastadas das camadas limite. Foi observado que a corrente costeira, forçada por processos baroclínicos e pelo vento, típica da parte central da PCSE, atinge o extremo norte da plataforma continental, induzindo um fluxo mais frequente com sentido SE, nas camadas intermediária e de fundo, principalmente no inverno. Verificou-se também que os ventos locais têm baixa correlação com as correntes, exceto nos níveis superficiais, evidenciando a importância das forçantes remotas na dinâmica da região, somado à influência da atividade vortical ciclônica gerada na região pela Corrente do Brasil, com influência até a PCM. Evidências de eventos de ressurgência/subsidência apareceram ao longo de todos os períodos estudados, com ocorrência preferencial a W desta localidade. / This work was developed within the context of the continental shelf hydrodynamics, with the aim of studying the subtidal variability of the currents in the far north of the South Brazil Bight (SBB). The area of the study is located in the vicinity of Cabo Frio (RJ) and Arraial do Cabo (RJ) (approximately 23º S / 42º W). Despite being a well known and studied region, due to the coastal upwelling phenomenon that occurs in its vicinity, little is known about the subtidal variability in this location. Given the importance of the subtidal currents, that are responsible for the transport of substances dissolved or suspended in water, such as sediments, nutrients and pollution, this work tries to contribute to a better understanding of these current~ fields, by the analysis in the time and frequency domain, from time series of the currents and local wind intensity and direction. We used data collected in DEPROAS Project (Western South Atlantict Platform Ecosystem Dynamics) from current meters and an ADCP moored in front of Cabo Frio, on the isobaths of 50, 100 and 200 m, and from a buoy and a weather station. We worked with time series of 2001 winter and 2003 winter and summer. From this study it was found that the subtidal variability dominates the flow in the region, mainly in the parallel direction of the bathymetry. As in the rest of the SBB, there was a geostrophic balance in the normal direction of the topography, which accounts for a flow parallel to isobaths, particularly in the middle shelf and in intermediate depths of the remote boundary layer. It was observed that the coastal current forced by baroclinic processes and by the wind, typical of the central part of the SBB reaches the northern edge of the SBB, leading to a more frequent flow in the southeast direction, in the intermediate layers and the bottom, especially in the winter. It was also found that the local winds have low correlation with the currents, except on the superficial layers, indicating the importance of remote forcing in the dynamics of the region, coupled with the influence of cyclonic vortical activity in the region, generated by the Brazil Current, reaching the middle shelf. Upwelling and downwelling evidences were observed in all time series, with the preferential location occurring west of Cabo Frio.

um aspecto intermitente e de baixa amplitude. Apesar disto, tem grande importância
sócio-econômica, por induzir o aumento da produtividade pesqueira, e também pelo
contexto climático do Estado do Rio de Janeiro. A interação de fatores oceanográficos e
atmosféricos, em Cabo Frio, provoca um efeito no clima local, conhecido como enclave
climático. Assim, na tentativa de entender os mecanismos de interconexão entre ventos
e temperatura da superfície do mar (TSM) desta região, em tempos pretéritos, foi
necessário conhecer melhor as relações recentes e seus efeitos sobre este sistema. Como
ponto de partida para interpretar os resultados pretéritos, dados diários de TSM e direção
e intensidade dos ventos regionais, durante a década de 70, foram utilizados no sentido
de apontar relações entre freqüência, persistência e intensidade dos ventos sobre a
ressurgência de Cabo Frio. Assim, o objetivo geral deste trabalho foi verificar as
mudanças da paleoprodutividade na região de Cabo Frio durante o Holoceno,
correlacionado-as com mecanismos sedimentares, oceanográficos e atmosféricos que
possam explicá-las. Os resultados pretéritos foram obtidos com base em dois perfis
sedimentares, coletados a 124m e 115m na plataforma continental de Cabo Frio.
Indicadores orgânicos (COT, Fluxo de COT, C/N e palinofácies) e inorgânicos (minerais e
metais) foram combinados no intuito de observar mudanças na paleoprodutividade do
sistema de Cabo Frio, ao longo dos últimos 13.000 anos cal AP. O estudo da relação atual
entre os eventos de ressurgência e os ventos regionais mostrou que a freqüência dos
ventos NE não estabeleceu uma relação clara com estes eventos e que as advecções
polares, representadas pelos ventos SW, pode não aumentar durante o outono-inverno.
Eventos de ressurgência apresentaram distribuição unimodal tanto durante esta década,
como durante os períodos sazonais, o que indicaria os ventos SW como principal
controlador da ressurgência, considerando que a ação destes ventos persistiu por até 5
dias consecutivos durante o outono-inverno, suficiente para enfraquecer os ventos NE.
No entanto, a intensidade dos ventos regionais parece ser o fator controlador da
ressurgência em Cabo Frio. De outro modo, a evolução da plataforma continental, aliada
à elevação do nível do mar, durante o Holoceno, influenciou de forma determinante a
ocorrência dos eventos de ressurgência na região de Cabo Frio. Desta forma, com base
nas mudanças registradas simultaneamente pelos multi-proxies ao longo das colunas
sedimentares foram caracterizadas três fases: Fase 1 - entre 13.000 e 9.000 anos cal AP
– quando ocorreu uma rápida ascensão do nível do mar, porém, com estabilizações. Este
fato acarretou uma diminuição da contribuição terrígena, ao longo do tempo, registrada
fortemente pelo decréscimo dos metais e palinomorfos figurados. Ocorreu uma
transformação de um ambiente mais raso e dominado por águas oligotróficas (CB), para um ambiente mais profundo e com reflexos primários de águas frias, ricas em nutrientes
(ACAS). Assim, a matéria orgânica oriunda do continente, trazida por meio fluvial e/ou
eólico, foi substituída gradativamente pelo material de origem marinho. Neste sentido, o
material alcançava o fundo cada vez menos refratário, o que pode ter condicionado um
ambiente sedimentar mais óxico ao longo desta fase. Esta situação indicaria um aumento
na produtividade do sistema, em virtude do reflexo da ACAS na região; Fase 2 – entre
9.000 e 5.000 anos cal AP – em que o ambiente tornou-se mais profundo e efetivamente
marinho. Foi marcada pelo estabelecimento da ACAS no fundo da plataforma continental
de Cabo Frio, apontado pelos indicadores orgânicos e inorgânicos. Em seguida, ciclos de
maior ou menor produtividade se alternaram, marcando condições de ressurgência e
subsidência, com o predomínio da ACAS e da CB, respectivamente, na plataforma
continental de Cabo Frio, o que induziu mudanças no metabolismo do sistema e teve um
papel fundamental nas alterações climáticas regionais. Eventos de ressurgência e fatores
atmosféricos interagem por feedback, ou seja, ao mesmo tempo em que o padrão de
ventos regionais pode influenciar os eventos de ressurgência, águas superficiais mais
frias podem determinar um clima local mais seco. Desta forma, o sistema de Cabo Frio
nesta fase já poderia responder aos efeitos climáticos das advecções polares e da ZCIT,
por exemplo, condicionado períodos de ressurgência mais ou menos fortalecidos. No
entanto, apesar da variabilidade da ressurgência nesta fase, a produtividade aumentou
relativamente; e Fase 3 – entre 5.000 e 700 anos cal AP – em que a ressurgência
pareceu estar ainda mais fortalecida, ainda que o sistema tenha apresentado alguma
oscilação. A partir de 2.500 anos cal AP foram observados ciclos regulares, de cerca de
500 anos, nos registros dos metais e da razão C/N. Registros similares também
observados em sedimentos do Golfo da Califórnia, Peru e Venezuela foram relacionados
aos ciclos climáticos com a mesma periodicidade, apontando a variabilidade dos eventos
ENSO como principal causa deste processo. Para Cabo Frio, é possível sugerir que
eventos de dimensões globais possam interferir e perturbar registros regionais e/ou
locais. Neste sentido, o fortalecimento da ressurgência pode ter acarretado uma fase,
relativamente, ainda mais produtiva que a anterior, mesmo que com alguma curta
perturbação cíclica, que poderia estar relacionado com a ocorrência de eventos El Niño
e/ou pela ação de forçantes climáticas regionais, como a ZCAS. / Le système d’upwelling à Cabo Frio est considéré de proportion locale/régionale,
avec un aspect intermittent et une basse amplitude. Malgré ceci, il a une grande
importance économique pour induire l'augmentation de la productivité de la pêche, aussi
bien que pour son influence dans le contexte climatique de l'État de Rio de Janeiro.
L'interaction de facteurs océanographiques et atmosphériques à Cabo Frio provoque un
effet dans le climat local, connu comme une enclave climatique. Ainsi, dans l’essai de
comprendre les mécanismes d'interconnexion entre les vents et la température de la
surface de la mer (TSM) de cette région, dans les temps passés, il a fallu mieux connaître
les relations récentes et leurs effets sur ce système. Comme point de départ pour
interpréter les résultats passés, des données quotidiennes de TSM et de la direction et de
l’intensité des vents régionaux, pendant la décennie de 70, ont été utilisées dans le but
d'indiquer des relations entre fréquence, persistance et intensité des vents sur l’upwelling
à Cabo Frio. Ainsi, l'objectif général de ce travail a été de vérifier les changements de la
paléoproductivité dans la région de Cabo Frio pendant l’Holocène, corrélés avec des
mécanismes sédimentaires, océanographiques et atmosphériques qui puissent les
expliquer. Les résultats passés ont été obtenus sur la base de deux profils sédimentaires,
rassemblés à 124m et 115m dans le plateau continental à Cabo Frio. Des indicateurs
organiques (COT, Flux de COT, C/N et palynofaciès) et inorganiques (minéraux et des
métaux) ont été combinés avec l'intention d'observer des changements dans la
paléoproductivité du système de Cabo Frio, au cours des 13.000 dernières années.
L'étude de la relation actuelle entre les événements d’upwelling et les vents régionaux a
montré que la fréquence des vents NE n'a pas établi une relation claire avec ces
événements et que les advections polaires, représentées par les vents SW, qui peut ne
pas augmenter pendant les mois d'automne et d’hiver. Des événements d’upwelling ont
présenté une distribution uni modale aussi bien pendant cette décennie que pendant les
périodes saisonnières, ce qui pourrait indiquer les vents SW comme le principal
contrôleur d’upwelling, en considérant que l'action de ces vents persiste par jusqu'à 5
jours consécutifs pendant les mois d'automne et d’hiver, assez pour affaiblir les vents NE.
Néanmoins, l'intensité des vents régionaux semble être le facteur contrôleur de
l’upwelling à Cabo Frio. En outre, l'évolution du plateau continental, alliée à la hausse du
niveau de la mer pendant l’Holocène, a influencé de forme déterminante la présence des
événements d’upwelling dans la région de Cabo Frio. Ainsi, sur la base des changements
enregistrés simultanément par des multi-proxies au long des colonnes sédimentaires,
trois phases ont été caractérisées: Phase 1 - entre 13.000 et 9.000 ans cal AP - quand
une rapide ascension du niveau de la mer s'est produite, mais avec des stabilisations. Ce
fait a causé une diminution de la contribution continentale au long du temps, fortement enregistrée par la diminution des métaux et des palynomorphes figurés. Cette situation a
produit une transformation d'un environnement moins profond et dominé par des eaux
chaudes du Courant du Brésil (CB) vers un environnement plus profond et avec des
réflexes primaires d'eaux froides, riches en éléments nutritifs des Eaux Centrales
d’Atlantique Sud (ECAS). Ainsi, la matière organique en provenance du continent,
apportée par moyen fluvial et/ou éolien, a été substituée graduellement par le matériel
d'origine marine. Dans ce sens, le matériel atteignait le fond à chaque fois moins
réfractaire, ce qui a pu avoir conditionné un environnement sédimentaire plus oxygéné
au cours de cette phase. Cette situation indiquerait une augmentation dans la
productivité du système, due au réflexe de l’ECAS dans la région; Phase 2 - entre 9.000
et 5.000 ans cal AP - où l'environnement s'est rendu plus profond et efficacement marin.
Elle a été marquée par l'établissement de l’ECAS dans le fond du plateau continental de
Cabo Frio, indiqué par les indicateurs organiques et inorganiques. Ensuite, des cycles de
plus grande ou moindre productivité se sont alternés, en marquant des conditions
d’upwelling et downwelling, avec la prédominance de l’ECAS et du CB, respectivement,
dans le plateau continental de Cabo Frio, ce qui a induit des changements dans le
métabolisme du système et a eu une fonction fondamentale dans les modifications
climatiques régionales. Des événements d’upwelling et des facteurs atmosphériques
interagissent par feedback, c'est-à-dire, en même temps que la norme de vents
régionaux peut influencer les événements d’upwelling, les eaux superficielles plus froides
peuvent déterminer un climat local plus sec. De cette forme, le système de Cabo Frio
dans cette phase pourrait déjà répondre aux effets climatiques des advections polaires et
de la ZCIT, par exemple, conditionnés à des périodes d’upwelling plus ou moins fortifiées.
Néanmoins, malgré la variabilité de l’upwelling pendant cette phase, la productivité a
relativement augmenté; et Phase 3 - entre 5.000 et 700 ans cal AP - où l’upwelling
semble avoir été davantage fortifié, malgré quelques oscillations subies par le système. À
partir de 2.500 ans cal AP des cycles réguliers d'environ 500 ans ont été observés dans
les registres des métaux et de la raison C/N. Des registres semblables observés dans
d’autres régions de l’Amérique du Sud et du Golfe de la Californie ont été aussi rapportés
aux cycles climatiques avec la même régularité, en indiquant la variabilité des
événements ENSO comme la principale cause de ce processus. Dans ce sens, la
fortification de l’upwelling à Cabo Frio, même avec quelques courtes perturbations
cycliques, pourrait être rapportée avec des événements El Niño et/ou d’autres facteurs
climatiques régionaux, comme la ZCAS.
