Criminalistic theory of victims of crime Abstract This thesis focuses on learning about victims of crime. The aim is to present the doctrine of victims called victimology with a particular focus on criminalistic victimology. The content is divided into four major chapters. The first chapter is devoted to general victimology and explains the key concepts of this field, emphasizing their criminalistic use. Moreover, the chapter discusses the position and classification of this field of science among other disciplines, provides a brief historical insight into the development of this discipline, and finally presents ways of caring for victims of crime. The second chapter focuses on crime reporting from the perspective of the victim. First, it deals with the internal processes that the victim experiences after primary victimization, then lists the factors that motivate or discourage the victim from reporting crime, including potential fear of secondary victimization. The third chapter deals with the role of the victim in the investigation of criminal offenses, especially in the conduct of investigative acts. Methods of investigation of crimes committed by youth Methodology for investigation of crimes committed by youth is a compact system of procedures used by criminalists while investigating crimes committed by youth. For purposes of this thesis the term youth includes the category of age from twelve to twenty-four years. Well-elaborated methodology shall help criminalists to quickly and effectively deal with situations when there is a reasonable suspicion due to found traces, or method of committing a crime, that the offender was a person of this age category. This thesis introduces typical personal and psychological characteristics of youth. The thesis outlines which crimes are committed by this group most commonly and which factors cause the delinquent behavior of youth. The thesis presents typical traces which occur when youth commits crime, and methods of committing which point to the young age of offenders. According to these characters we can assume that the crime was committed by youth offender and therefore it is important to use a special methodology for the investigation. Criminalistic study of crime victims (criminalistic victimology) In this thesis I try to briefly outline some of the most important issues and topics concerning criminalistic victimology. I address both how the victim affects the crime itself and its investigation, but also how the crime investigation affects the victim. When investigating a specific criminal act, there are two major conflicting goals we try to achieve; to investigate as thoroughly and effectively as we can, and to avoid secondary victimization of the victim. Both professional and attentive approach is vital to criminalistics as a whole, not just criminalistic victimology. A successful investigation depends in many cases greatly on whether and how the victim cooperates, and that in turn depends on how the victims and the general public view the police, the courts, and other criminal justice authorities. It is therefore necessary to understand the victim, to comprehend their role in the formation of the criminal act, and to ensure their confidence in the criminal justice. This diploma work deals with the methodology of investigating murders. The aim of my work was to shed a light on this issue and try to explain it from an expert point of view. The diploma is divided into three main chapters. The first one deals with juristic and criminalistic characteristics of murder and with the phenomenon of serial and mass murderers. The second part is dedicated to the most important aspects which influence the course of investigation, namely the specialties of the primary operations, search of crime premises, trace evidence, the interrogation and the role of psychology in it. The last part is trying to give a complex view on sexual murders and its suspect, various typologies of sexual murders and sexual paraphilia which occur very often. The most dangerous of them is sexual sadism and murderers who suffer from this kind of deviation are considered to be the most brutal and dangerous. In the end, this work is trying to explain the important role of psychological profiling in investigating murderers. The cooperation between the investigator and psychologist could only increase the chances of apprehending the offender.

The topic of my thesis is a recognition in criminal proceedings. The thesis deals with recognition in terms of crimilonogy and criminal procedure. The recognition is one of the important evidence, which are often based on evidence in criminal proceedings. At first sight it may seem that a recognition is easy procedure in criminal proceedings, but closer examination reveals its complexity. The aim of the thesis is to introduce the recognition as a special way of proving and its specifics, summarization of the knowledge gained by studying textbooks and monographs, articles in journals and some judicial decisions, as well as outlining the selected questions and poiting out possible problems, especially the obligation of the defendant to attend the recognition. The thesis is divided into eight chapters, which are divided to subchapters. Following the introduction, the first chapter defines the concept of recognition, and then focuses on psychological basics of recognition, historical evolution of recognition as an evidence since 1873 and also its grounding in the Code of Criminal Procedure. Lietuva saugaus eismo požiūriu yra padidintos rizikos šalis, todėl avaringumas yra vienas iš pagrindinių rodiklių, atspindinčių transporto sistemoje vykstančius procesus, jų teigiamą ar neigiamą raidą. Pagrindiniai statistiniai avaringumo rodikliai (informacija apie eismo įvykius, žuvusiuosius ir sužeistuosius) neigiamai apibūdina saugaus eismo situaciją šalyje. Šalyje iki šiol pasigendama racionalios saugaus eismo sistemos struktūros, kuri užtikrintų visų grandžių veiklos nuoseklumą bei tarpusavio sąveiką. Eismo priežiūra ir kontrolė - epizodiškos, todėl vis dažniau vairuojama apsvaigus nuo alkoholio ar narkotinių medžiagų, vis mažiau vairuotojų ir keleivių naudojasi saugos diržais, vaikai vežami ne specialiose saugos kėdutėse, dažnai viršijamas greitis. Nors eismo įvykiai yra atsitiktiniai, tačiau būtina suvokti ir valdyti jų priežastis, aplinkybes ir padarinius, kad būtų užkirstas jiems kelias arba bent sušvelninti padariniai. The main statistical indicators of traffic accsidents (information about traffic accsidents, died or injured people) there negative discribing the situation in Lithuania. There no rational safety traffic system in Lithuania. The traffic observation and control are episodical and there more drunk driving accsidents in Lithuania. The drivers do not using safety belts, children safety chairs, they are over speeding. We know that traffic accsidents are accidental but we must realize and control the causality, circumstances and after-effects. DEVELOPMENT OF AN EXTRACTION METHOD FOR THE MASS SPECTRAL ANALYSIS OF ORGANIC GUNSHOT RESIDUE FROM CLOTHING

This dissertation will focus on the extraction of volatile organic compounds associated with gunshot residue from articles of clothing, followed by analysis with mass spectrometry. During the discharge of a weapon, a cloud of volatile organic gunshot residue (OGSR) is dispersed around a firearm. This will create a high probability of transfer between the OGSR and the clothing of individuals who are near a discharged weapon. The first part of this dissertation will be the development of a method for removal of volatile OGSR from articles of clothing. Extraction of OGSR will be completed by solid phase microextraction (SPME), followed by separation and analysis by gas chromatography-mass spectrometry (GC/MS). Many parameters will require optimization for proper extraction of OGSR from articles of clothing. Following development of a SPME procedure, figures of merit were determined such as linearity and limits of detection/quantification, obtaining levels of detection of 0.206 ng/cm2 on a 100 cm2 cotton cloth. Applications of this extraction method were investigated including the determination of the distance OGSR travels from a discharged weapon and the extraction of OGSR with different clothing materials by SPME. The second part of this dissertation will focus on the development of an on-line solvent extraction method for removal of OGSR from articles of clothing, followed by analysis with paper spray mass spectrometry. Issues using SPME of certain types of clothing materials required the development of an alternative method for removal of OGSR from articles of clothing. Use of an on-line solvent extraction technique of OGSR from articles of clothing followed by analysis with paper spray mass spectrometry allowed for detection of OGSR at comparable levels to a headspace SPME procedure. Use of paper spray with an ion trap mass spectrometer permitted the soft ionization of OGSR compounds followed by tandem mass spectrometry to obtain structural information. Extraction of OGSR from articles of clothing has potential to determine if an individual was present during the discharge of a firearm. Extraction of OGSR from articles of clothing will provide an alternative to traditional methods of gunshot residue analysis currently in use.

The Crime Scene Reconstruction Abstract This diploma thesis deals with the issue of crime scene reconstruction both from the point of view of criminal law and from the point of view of criminological science and practice. With the help of reconstruction as a means of evidence, which is classified in the Criminal Procedure Code as a special means of proof, the authorities involved in criminal proceedings try to find out the facts of the case, about which there is no reasonable doubt. Through reconstruction as a method of criminalistic practice, the factual circumstances under which the investigated crime was committed are restored. The main goal of this thesis is a detailed analysis of the crime scene reconstruction from a criminal and forensic point of view, and the result of this analysis is a chapter devoted to considerations de lege ferenda. The secondary goal of the diploma thesis is to compare the crime scene reconstruction with selected investigative acts with the help of a comparative method. This diploma thesis deals with the problem of the criminalistic method of on-the-spot examination of the testimony, namely with particular questions of its theoretical definition as well as selected questions concerning its practical use within the activities of law enforcement authorities. The overall aim of this thesis is to give a comprehensive view of this institute and to present a detailed analysis of individual aspects of this method of forensic practice, as well as the subsequent identification of particular questions, problems and uncertainties that arise in this context. The first part focuses on the theoretical perspectives of the on-site examination of the testimony. Attention is brought to its process of constitution in Czechoslovak forensic science, its conceptual definition as well as differentiation from other methods of forensic practice.
