Legal and institutional arrangements for damage caused by wildlife in Kenya and Botswana

In both Kenya and Botswana, wildlife is a valuable natural resource in terms of its economic value, nutritional value, ecological value, medicinal value, educational and scientific value, as well as recreational and socio-cultural value. Despite this beneficial value, however, wild animals in both countries also cause damage and impose heavy losses on society. They also disrupt peaceful existence in local communities living in close proximity to wildlife areas. The damage they cause includes attacks on people and livestock, destruction of crops and other property as well as infrastructure. This has resulted in a human-wildlife conflict, with people having negative attitudes towards wildlife. Initially people seem to be the victims when wild animals attack them or destroy their property. Later, the animals are the real victims when people in retaliation start attacking, ensnaring or poisoning them. Contrary to the belief that it contributes to poverty alleviation, many people in the local communities in wildlife areas strongly believe wildlife has contributed to their poverty. Unless the governments of both Kenya and Botswana maintain efficient legal and institutional arrangements for wildlife damage, the future of wildlife conservation in both countries is bleak. These arrangements, if effectively enforced, have the potential to: reduce retaliatory killing of wildlife; ensure incidents of wildlife damage are reported; alleviate the losses and suffering associated with wildlife damage; and bolster public support for conservation programmes. It is encouraging that both countries recognize wildlife damage as a major problem and have put in place legal and institutional arrangements to address this problem. This study evaluated the legal and institutional arrangements in Kenya and Botswana on wildlife damage, assessing their suitability, adequacy as well as their effectiveness. While several studies have been conducted on wildlife damage, most of them mainly focus on institutional arrangements and the actual abatement measures adopted, few of them approach the subject from a legal standpoint, in the way this study does. Those studies do not, for instance, discuss the legal basis of the need for legal arrangements for wildlife damage alleviation and the various approaches and actual forms of legal intervention. This author through the use of semi-structured interviews, self-administered questionnaires, focus group discussions, and literature survey investigated the problem of ii wildlife damage in Kenya and Botswana. A central part of this investigation was on the types of damage, the animals involved, whether and how this problem has influenced public attitudes towards wildlife conservation, and suggestions for solution. Research for this study was conducted in the Laikipia region of Kenya and the Okavango delta region of Botswana between January and December 2006. This researcher interviewed 44 respondents from each country, comprising households from the local communities within wildlife areas, senior ranking government officials, leaders of NGOs that actually work on wildlife issues, experts in natural resource management as well as eminent scholars in environmental and natural resources law and policy. Research for this study established that while the governments of both Kenya and Botswana have established certain legal and institutional frameworks on wildlife damage, there are factors that hamper their efficient operation. These factors include the relevance and suitability of the existing laws, as well as their acceptability to stakeholders; lack of appropriate policy framewoks and dispute resolution mechanisms to support the regulatory regime; institutional problems such as overlapping responsibilities, lack of adequate resources and lack of motivation among staff. These factors together with others have continued to be a major challenge to the quest for appropriate and effective legal and institutional response to the problem of wildlife damage in both countries. The study found that in both countries the law vests in the state the power to manage wildlife wherever it occurs within the national boundaries. Botswana’s community-based wildlife management model, however, offers more incentives for conservation to local communities than Kenya’s state-centered system which largely disregards the role of local communities in wildlife matters. This author has argued that local communities are critical stakeholders and the success of any conservation programmes will depend on their goodwill. Besides, while the state has a duty to protect wildlife from harm by humans, it also has a corresponding duty to protect humans and their property from damage by wild animals and to ensure that wildlife does not undermine the people’s livelihoods and development. This is, however, not usually the case as in practice the state in both countries, and especially in Kenya, iii seems to favour wild animals at the expense of the people. The study has recommended certain reforms which need to be undertaken if Kenya and Botswana have to maintain appropriate and efficient legal and institutional arrangements on wildlife damage.

Evaluation of Wildlife Depredation at Fish Hatcheries in the Intermountain West

During 1993- 1994, I investigated wildlife depredation at Intermountain West fish hatcheries to quantify losses, determined the reliability of bioenergetics models and hatchery manager perceptions to predict losses, and investigated the effectiveness of simple control measures. I observed predators and surveyed managers to quantify the extent of depredation losses and to identify the species responsible. Great blue herons (Ardea herodias), black-crowned night herons (Nycticorax nycticorax), ospreys (Pandion haliaetus), and California gulls (Larus californicus) were the most significant predators of hatchery fish in the field study, and were perceived as such by hatchery managers. Losses to avian predators at two hatcheries were 7.0% and 0.6% of annual production based on my observational data, but hatchery managers believed depredation losses were 15% at each hatchery. I estimated the consumption of rainbow trout (Oncorhynchus mykiss) by great blue herons using bioenergetics models of existence metabolism, existence metabolism plus reproductive costs, and field metabolic rate. compared the model-based predictions to observed consumption rates of free-ranging herons foraging at a fish hatchery. The fish consumption predicted by the existence metabolism model and observed consumption were similar from October- June. During the breeding season, observed consumption was higher than consumption predicted by the existence metabolism model but lower than that expected from the energy requirements for breeding individuals. This result was expected given that only a portion of the bird population was breeding. Although consumption predicted by the field metabolic rate differed significantly from observed consumption for more months than the existence metabolism models, predicted annual consumption from field metabolic rate and observed annual consumption were not signliJcantly different (.E < 0.05). Peak observed consumption occurred during August and September and was predicted by the model. Performance of the three models may be improved with estimates of population structure and more reliable population estimates. I evaluated the effectiveness of perimeter fencing in reducing heron depredation on fish raised in concrete raceways at a trout hatchery in Midway, Utah. Fences were constructed of single-strand monofilament line placed 20 cm above raceway walls. Fences had no impact on the number of birds foraging or their fish consumption rate.

Application of Electrified Fladry to Decrease Risk of Livestock Depredations by Wolves (Canis lupus)

Wolf (Canis lupus) predation on livestock can cause economic and emotional hardships for livestock producers, complicating the balance of wolf conservation with other human interests. New management tools that decrease risk of predation may offer additional flexibility or efficiency for both livestock producers and management agencies. I examined 1) the efficacy of electrified fladry compared to fladry at protecting a food source from wolves in captivity, 2) the efficacy of electrified fladry for reducing wolf use of pastures and preventing depredations, and 3) the applicability of electrified'-fladry. In captivity I tested the reaction from 15 groups (46 wolves) to the presence of fladry, electrified fladry, or no barrier within their enclosures. During trials, a deer carcass was provided in one corner of the pen, and a strand of fladry (n = 5 pens), or electrified fladry (n = 5 pens), was strung across the pen to protect the food resource. Failure of the barriers was defined by at least one animal in a group moving across the barrier. Both fladry and electrified fladry effectively excluded wolves from a food resource for short durations of time (1'-14 days), but electrified fladry was more effective. My research indicated that although electrified fladry has the potential to reduce wolf depredations, animal learning, motivation, and personality play critical roles in the effectiveness of fladry systems. In Montana, I assigned 9 livestock operations to randomly receive a treatment (electrified fladry, n=6 pastures) or control (not receiving electrified fladry, n=6 pastures). I measured cost per kilometer for purchasing materials, number of people and hours required for installing and maintaining, as well as recording observations of potential difficulties with electrified fladry. I formed and distributed an exit'-survey to each rancher who participated in the study to assess opinions about the use of the technique. Wolf activity at the ranches was insufficient and I was not able to determine if electrified fladry was successful or unsuccessful for preventing livestock depredations. I found, however, that electrified fladry may be limited by costs associated with its purchase and that the application and effectiveness of electrified fladry may limit its usefulness for addressing wolf'-livestock conflict. The understanding of human perceptions of management tools is critical to determining the success of implementing management techniques and fostering participation and cooperation among stakeholders.

Predation risk of Double-crested Cormorants (Phalacrocorax auritus) on commercial catfish production in the Mississippi Delta

Double-crested Cormorants (Phalacrocorax auritus) impact United States commercial aquaculture and are considered the greatest avian predators on catfish (Ictalurus spp.) aquaculture facilities in the Mississippi Delta. Recent changes in aquaculture practices, regulatory policies, and decreased overall hectares in production prompted this study that: 1) estimated abundance and distribution of cormorants at their night roosts using aerial surveys, 2) assessed cormorant consumption of catfish in relation to their night roost through cormorant collections and stomach contents analysis, and 3) updated a cormorant bioenergetics model with contemporary data to estimate catfish loss. Models estimated that 4.2 and 5 million cormorant forage days occurred during winters 2016-2018 with an average of 33% of their diet consisting of catfish, or 558.1 and 739.5 metric tons of catfish consumed by cormorants in winters 2016-2018. These results will inform wildlife managers about relationships between cormorant night roost locations and disproportionate consumption of catfish.

C'est dans le contexte délicat du milieu marin, marqué par l'écroulement des stocks halieutiques et la conservation urgente des espèces de prédateurs marins, que s'inscrit cette étude sur la déprédation (i.e. prélèvement des poissons capturés) par les orques et les cachalots sur la pêche à la palangre dans la ZEE de l'Archipel de Crozet. Le premier objectif a été d'évaluer les conséquences socio-économiques du phénomène. Entre 2003 et 2010 les orques ont interagi avec un total de 43,3% des palangres relevées et les cachalots avec 57,5%, les deux espèces étant présentes simultanément sur 27.8% des palangres (n =5 438). Les orques, seules ou associées aux cachalots ont été estimées prélever 926 ± 76 tonnes de légines sur l'ensemble de la période, représentant un taux de déprédation de 17,7%. Trois facteurs opérationnels ont été identifiés comme faisant varier la déprédation par les orques : i) utilisation de palangres courtes (<5 000 m) en absence d'orques, ii) déplacement du navire sur des distances supérieures à 75 km pour quitter une zone confrontée à la déprédation et changer de zone, iii) utilisation de vitesse de remontée des hameçons à bord supérieures à 50 ham.min-1. Le deuxième objectif de cette étude a été d'évaluer les conséquences démographiques de la déprédation sur la population d'orques de Crozet. Le suivi à long terme des individus a permis de mettre en évidence des réponses différentielles des unités sociales en fonction de leur degré d'interaction avec les pêcheries. En effet, les années 1990 sont d'abord marquées par une sur-mortalité des orques interagissant à des hauts niveaux avec les pêcheries, confirmant l'effet de réponses de type létales de la part des navires braconniers sur les individus. Cette tendance s'inverse à partir de 2003 avec une survie et une reproduction supérieure dans les unités à fort taux d'interaction, suggérant un effet bénéfique de la déprédation. Avec l'augmentation des cas de déprédation dans le monde, la portée de cette étude est globale, d'une part par ses résultats positifs issus d'une collaboration entre pêcheurs, gestionnaires et scientifiques, et d'autre part par la précision des priorités de conservation impliquées.

Conflicts Between Humans And Wolf: A Study In Bozdag, Konya Province, Turkey

Canis lupus is one of the most important but least studied species of Turkish fauna, however, livestock depredation and recently increased number of publications on attacks on humans intensifies human-wildlife conflict. In this study, wolf depredation is studied in Bozdag in the province of Konya where conflicts between wolves and livestock holders are well known. The study site holds &gt / 50,000 sheep and covers 9 villages and a small town. A total of 13 shepherds are interviewed in 2004 and 2005 to reveal husbandry methods and vulnerability of livestock to wolf attacks in Bozdag. Each flock is attended by a shepherd and several livestock guarding dogs (LGDs), and experiences 1.96 wolf attacks per year, on average, independent of flock size. The flocks attended by less LGDs experience less attacks and therefore, the quality of the LGDs &amp / #8211 / not their numbers- are more important. Confining sheep in corrals that are attended by a shepherd and good quality LGDs appears to be the most effective husbandry method to decrease depredation. Human attitude towards wolf is also assessed and the perception of wolf is generally negative / 8 out of 11 shepherds are in favour of the eradication of this carnivore. Publicized wolf attacks on humans are compiled from 21 news sources on the internet and records of wolf rabies are sought from various sources. There were five publicized cases of attacks on humans, no verified records of human death between 2000 and 2005. Rabies stands out as the primary reason of wolf attacks, but it requires further research because proper records are missing.
