In my thesis I deal with temporary foster care where the aim of the thesis is to analyse the process of child's introduction and transition into the care of future adoptive parents and to map out the experience and opinions of both future adoptive and temporary foster parents. The partial objective is to identify the opportunities and risks of this process, focusing on the subjective experience of the research participants. In order to reach the set target a method of qualitative research was chosen, namely an interview, specifically the technique of an unstructured interview. The research was divided into two parts. In the first part of the research interviews were conducted with future adoptive parents and in the second part with temporary foster parents who had at least two children in their care. For evaluation of results a cluster analysis was used. The results of the research show that future adoptive parents have considerable reservations about the process of getting acquainted with the child; their experience regarding the actual transition of the child into their care vary. Moreover they perceive the impact of this process on the child rather negatively. Further, the research shows that most temporary foster parents do not have a negative experience with introduction and transition of the child into the care of future adoptive parents. However, the whole research has revealed many pitfalls in this process. Intended merit of this thesis lies in the fact that the results can be used as a source of information for social workers, prospective adoptive parents, temporary foster parents and for staff of support organizations or general public.

Fixed-term employment relationships as demarcated by Czech and French legal regulation Abstract The present paper analyzes fixed-term employment relationships as demarcated by Czech and French legal regulation. The purpose of the study is to discuss similarities and differences within the examined legislations, provide a basic historical background and reflect on whether the French legislation could be used as a source of inspiration for Czech law. In author's opinion, due to the frequent issues arising in connection with the application of the legal regulation of fixed-term employment relationships, this thesis could also serve as a source of interesting facts for both employees and employers. The paper is divided into four chapters. The introductory chapter looks briefly at labour law as a distinct legal branch, highlighting some of the issues which the doctrine of labour law must contend with in the context of the re-codification of private law and defining "an employment relationship" as the basic legal term of the thesis as a whole. Fixed-term employment Abstract The topic of this master thesis is, as its name indicates, legislation of fixed-term employment in the Czech Labour Code. This thesis further develops and in some parts modifies my student work named "Reflection on fixed-term employment not only in perspective of conflict of opinions between the Constitutional Court and the Supreme Court". This topic became relevant again with the ongoing judicial dispute between the Constitutional Court and the Supreme Court, as neither of the courts decided to withdraw of its way of interpretation of section 39 subsection 5 of the Czech Labour Code. The aim of this thesis is to briefly introduce the current legislation and its historical sources, analyse it critically and propose a regulation de lege ferenda. FOSTER CARE IN PUBLIC AND IN PRIVATE LAW Abstract The diploma paper deals with the present legal regulations of foster care in private law as well as in public law. The institute of foster care is placed on the frontier of public and private law and the purpose of my diploma paper is to assess, after a complete analysis, which of these two law branches is the foster care closer to. The diploma paper is divided into nine chapters. The first chapter is dedicated to the institute of foster care in general. This chapter has to introduce the reader into the problems and to acquaint him with the basic way-outs. The second chapter defines the notion of foster care and its purpose. FOSTER CARE FOR A TEMPORARY PERIOD This thesis describes and critically judges the legal regulation, practice and purpose of foster care for a temporary period in the Czech Republic. Children temporarily or permanently deprived of their family environment or children, who cannot be left in such environment, are entitled to a special protection and assistance granted by the state in one of alternative care forms. The Czech Republic is criticized for a long time by the international organizations because of numbers of children placed in any type of institutional care. Consequently, the amendment of the Act N. 359/1999 Coll., on social and legal protection of children, has been approved in June 2006. This amendment has established a new legal institute called "the foster care for a temporary period". The function of this institute is to avoid a placement of children to an institutional care in the case, when the children can not stay in the original family because of whatever reason however there is a presumption of re-entry to that original family. This master's thesis deals with the present legal regulation of foster care as one of the forms of a substitute care. Foster care is a traditional private law institute with public law elements. Its purpose is to ensure substitute care to children whoes parents, or even custodian are not able to care for them because of various reasons. So foster care is a subsidiary to biological parent's care. On the other hand, based on law, foster care has priority over institutional care. Due to the reformation of the substitute care system, foster care went through lots of changes lately. Primarily it was approached to the extensive amendment of Act no. 359/1999 Coll., on the social and legal protection of children and with the effectiveness since the 1st of January the family law regulation has been incorporated to the Act No. 89/2012 Coll., civil code. This diploma thesis deals with the foster care for a temporary period. It examines how the legislation of this problamatics has changed since the reform in 2013 and how it is delivered into practice. The qualitative approach has been chosen for this research, using the primary and secondary data likewise. The primary data has been collected via semistructured interviews with three groups of respondents: the employees of OSPOD (the child's social and legal protection institutions in the foster care system), workers of nonprofit organization dealing with the foster care for a temporary period and parents for a temporary period. The respondents have been enquired with the questions based on the reviewed literature and articles. The whole system of the foster care for a temporary period, including its incorporation in legislation, is described in the text. The mentioned 2013 reform, important for the legislation too, is described as well. The theory of street-level bureaucracy and the theory of child development creates the academic basis for this thesis. Transformace a deinstitucionalizace náhradní péče o děti v České republice / Transformation and Deinstitutionalization in Substitutional Child Care System in the Czech Republic

Substitutional child care is an indispensable part of system of social and legal protection of children. Until 1989, institutional care was preferred, while after the fall of communist government it had been gradually replaced by substitutional family care, because of the inappropriateness of institutional care to fully compensate for family environment. Deinstitutionalization means transforming the system of placing children to alternative care and it is understood as transition from institutional care to types of substitutional family care, eventually to more individual type of care with more family character. An amendment to the Social and Legal Children Protection Act, which aimed at transforming the system of substitutional care towards more individual work with endangered children, came into force in 2013. The amendment restored the institute of temporary foster care and modified the institute of long-term foster care. The Diploma thesis is oriented into the area of a substitute family care in the Czech Republic. There are family functions disturbances in the respekt to the child specified in the first chapter, focusing mainly on those who most frequently, have an influence on a creation of so called "Infant social orphanage". The second chapter is dedicated to the possibilities of providing of substitute children nurture, mainly to single forms of substitute family care and theoretical recourses used for the optimal option of substitute child nurture. The content of the third chapter is a foster care (historical development, forms, infants indications, applicants motivation) and the newest type - the temporary foster care and its specifications compared to other forms of foster care. The fourth charter includes methodological recourses for an empirical research and thein interpretation. There are the Diploma Thesis findings and possibilities of further development of the substitute family care in the Czech Republic compiled in the fifth chapter.
