I chose the topic of my diploma thesis ?Role and Compass and Potential of Non-government Non-profit Organisations when Solving Crisis Situations and System of Co-operation between them and Bodies of Crisis Management? because I believe that non-profit organisations play a key role at providing help to people in distress. I pay high attention to the non-profit organisations which, within their compass, try to help people in distress. They attempt to mitigate the consequences of emergencies or crisis situations, which can affect any human being at any time. It was only when I started studying at the University of South Bohemia and when working for the police that I found out that the non-profit organisations which operate in the Czech Republic depend mainly on the grant policy, sponsorship and human approach of the people who are employed in these organisations or support them in whatever way. Having chosen the topic of my diploma thesis, I have tried to summarize and submit as much information for the readers of this paper to absorb as many data as possible on the non-profit organisations which work within the South-Bohemian region and are available when preparing and solving emergencies and crisis situations. I have made an attempt to describe their role, compass and employment at emergencies. The other objective of my thesis is to describe their communication within the Emergency Services and with the bodies of Crisis Management. The objective of my diploma thesis is to analyse the activities of non-government non-profit organisations when dealing with crisis situations and emergencies. Based on qualitative research, this goal was met. Nowadays, in the time of economic crises both in the Czech Republic and in the world, I must state that to secure funding, material and human resources, which would enable their workers to perform the activities given by their mission, represents for the non-profit organisations a superhuman task. The hypothesis that the system of co-operation of the bodies of Crisis Management and non-profit organisations is sufficient has been confirmed. The hypothesis that the activities of non-profit organisations when dealing with crisis situations and emergencies represent an important factor has been confirmed as well.

Taxation of permanent establishments is one of the most complicated areas within international tax law. The system of permanent establishment is based not only on the national legislations of relevant states, but also (mainly) on the international double taxation treaties. This diploma thesis analyses those issues in the taxation of permanent establishments, which are the most up-to-date or can be considered as the key questions of the whole concept and therefore can be significant for the future development of the permanent establishments. However the technically perfect system of permanent establishments should come hand in hand with the practical feasibility and overall efficiency. This assumption is nowadays challenged by several trends like the growing popularity of offshore tax heavens or the development of information technologies, which complicate the determination of (fixed) place of business through which the business of an enterprise is wholy or partly carried on. The technical analyses in this thesis are, therefore, supplemented by the objective evaluations from the perspective of valid legislation, possible approaches of the tax authorities, as well as of the enterprise considerations and also the global international taxation picture. This involves also the aspects of tax policies at the level of sovereign states, especially the Czech Republic.

This diploma thesis is dedicated to the European patent with unitary effect and reviews effects of the approval of the unitary patent package for clarity, time demands and financial aspects of patent protection. The thesis also deals in detail with assessment of changes in the language question in connection with the regulation of translation or in the event of a dispute concerning a European patent with unitary effect. It further assess changes resulting from the ratification of the Agreement on a Unified Patent Court and its impact on financial costs and time demands of patent litigation for the patent applicant. In the practical part the author conducts a party interested in unitary patent protection through the process, procedure for filing and communication with Industrial Property Office and the European Patent Office, from the filing of a application for a Unitary patent until the grant of a Unitary patent.

Algoritmy shody v dynamických servisně orientovaných systémech / Compliance Algorithms in dynamic service oriented systems

Compliance achievement and assurance of processes and services with regulatory requirements, standards, and business requirements becomes an actual task that should be resolved already in the stage of information systems design and implementation. If the particular business process or business service is supported with an IT system, then the compliance assurance relates also to this supporting system. This dissertation thesis presents the concept of continual compliance management in service oriented systems with a special focus on application of advanced process automation tools. The aim of this thesis was design of methods and procedures for reliability and credibility of business processes both internally in single domain, and in case of business process outsourcing including iterated and/or dynamic outsourcing i.e. in multi-domain environment with a special emphasis on automation level maximization. Particular process and/or service is considered to be reliable and credible if we are able to prove its compliance with the defined requirements in a trusted way. The first part of this thesis is dedicated to traditional methods for compliance achievement and assurance as a basis and inspiration for methods based on high level of automation. The second part of this thesis presents the concept of design, implementation and verification of compliance in service oriented systems. It introduces the terms of ideal target process, Key Assurance Indicator (KAI) and Key Security Indicator (KSA). For multi-domain environment there is the concept of Protection Level Agreement (PLA). This part also covers a new method of business process analysis designed for their automation as well as a concept of business rules design, testing and automation integration. The third part named Conceptual Model of Compliance Assurance in BPMS and Service Oriented Systems Environment brings a method inspired by well-known Deming Cycle (Plan, Do, Check, Act), description of the notations selected for compliance algorithm and target process modelling, and first of all the compliance algorithm design. This concept is demonstrated on two case studies of real business processes analyzed in Hospital San Raffaele in Milan, Italy. First of them is an internal business process regulated by regional law, the second study is an example of compliance with business requirement achievement and assurance in multi-domain environment of iterated dynamic outsourcing. These case studies were verified by simulation with subject matter experts and business process activities performers of the hospital personnel.

The final thesis deals with the theme of termination of employment contracts from the perspective of the law and the practice of the company. The aim of thesis is to introduce the reader to the issue of employment termination, to show the changes of Act No. 262/2006 Coll. Labour Code that became effective on January 1, 2012 with amendment No. 365/2011 Coll. in the theme of this thesis and to identify practices of employment termination in the monitored company. The methods used are observation, comparison, analysis and synthesis. In the theme of termination of employment contracts, the focus is given to termination by the employee, employer or by mutual agreement and also to invalid employment termination. However, the reader is in the first chapters familiarized with employment relations and subjects of these relations as well. A separate part of the thesis is concerned on the practice of company doing business in the banking sector, in this part are described practices of this company in terminating employment relationships and the impact of the amendment to the Labour Code on the monitored company.

The aim of this thesis is to evaluate the range the Czech Republic fulfills the international commitments stipulated by the Paris Declaration on Aid Effectiveness. And, if it needed, to find factors which influence fulfilling of the declaration commitments. This is done by analysis of the documents and interviews. The analysis of the data related to the supplied development aid is the core of the thesis. The aid depends on these key principles: ownership, alignment, harmonization, managing for results and mutual accountability. Two projects of the Czech Development Agency between years 2013 and 2015 in Cambodia and the State of Palestine are analyzed in two case studies. The operationalization of the terms and following own methodical framework application to the output data led to a result, whether the international commitments are (not) complied with. The performed research implies that commitments are fulfilled rather insufficiently in the Cambodia case, whereas the commitments in State of Palestine case were fulfilled completely. A new innovative approach was crucial. The projects are directed by Palestinian partner. The aim of this thesis is to describe the fundamental issues related to the future accession of the European Union to the European Convention for the Protection of Human Rights and Fundamental Freedoms and to provide an overall understanding of the issue. To fulfil this objective, the first part of the thesis deals with the current situation in the european human rights protection system. It introduces the protection system of the Council of Europe as well as the system of protection provided by the European Union. This part aims to describe relationships between them and also gives the overview of the development of the question of accession and of the main features defining the autonomy of the European Union law. The second part then turns the attention to the legal instruments which make it possible European Union to accede. This part provides an analysis of the Accession agreement on the accession of the European Union to the Convention for Protection of Human Rights and Fundamental Freedoms which contains legal, institutional and technical solutions of the European Union's incorporation into the Convention system. This thesis deals with the institute of summary preliminary proceedings in the context of past and current legislation and also the reasons that led to its introduction into law. The paper also outlines the objectives of summary proceedings and the use of the institute for other criminal laws. In this work there are also defined summary preliminary proceedings within individual forms of pre-trial proceedings. In some cases, the work compares the above mentioned institute of summary preliminary proceedings with foreign legislation. This study also defines the essence of summary preliminary proceedings and acts carried out in it. At the same time the author tries to define the legal conditions for holding summary preliminary proceedings, further the course of summary preliminary proceedings. The paper also describes the course of summary preliminary proceedings, from the record of initiation of criminal proceedings, to notification about suspicion, further deals with the question of proving evidence in summary proceedings. The Fourth Republic fell sort of expectations of French nation. The institutional system based on predominance of political parties could guarantee neither inner stability nor the return of France to the world political power. Weaknesses of French governments and their inability to cope with the serious political and economic issues resulted in collapse of the Fourth Republic in spring 1958. Some months later a new political system was established. It enabled to give France back its grandeur and independence. The first decade of the Fifth Republic, closely connected with the personality of President Charles de Gaulle, was greatly affected by the Algerian War of Independence in consequence of which all social and political spheres of the country were impacted. The Evian Agreements of March 1962 established an independent Algeria and enabled Charles de Gaulle to carry out his own political conception, including greater openness to the Soviet Union and its satellites. Czechoslovak-French diplomatic and cultural relations in the years 1948-1968 correspond to large extent extent to the evolution of international policy with its alternation of easing and tightening of the geopolitical tension and they also reflect the changes in domectic political situation in both countries.
